l WHEREAS, the owners of property abutting a
2 portion of Smith Street (formerly Shinn Street) near
3 the intersection of 4th Avenue and Smith Street (form-
4 erly Shinn Street) located in Yesler's First Addition
5 to the Town of Kent, County of King, State of Washington,
6 and which is more fully described hereafter, have peti-
7 tioned the City Council of the City of Kent to vacate
8 said certain portion of said street 1n the City of Kent,
9 King County, Washington, and

\!JHEREAS, the portion of said street sought to
be vacated is described as follows:
King County, vJashington:
Beginning at the Monument marking the
intersection of 4th Avenue and Smith
Street (formerly Shinn St.) said monu-
ment being 4.1 ft. South of the North line
of the existing concrete pavement and run
thence N 88°34 1 51 11 W, 603.85 ft. to the
monument marking the NW corner of Yesler's
First Addition to the Town of Kentt as
recorded in Volume 5 of Plats, Page 64,
records of King County, Washington; Thence
S 00°39 1 54 11 W, along the \~est line of
Yesler's First Addition 40 ft. to the true
point of beginning for this description;
Thence continuing S 00°39 1 54 11 W, 37.62 ft.
to the NW corner of Block 16 of said Yesler's
First Addition; Thence N 89°38'32" E, along
the North line of said Block 16, 569.86 ft.
to the NE corner of said Block 16; Thence
N 1°40'09" E, along the East line of said
Block 16 extended, 19.95 ft. to a point
which is 40 ft. South at right angles to
the centerline of Smith Street; Thence
N 88°34'51" W, parallel to said centerline
of Smith Street, 570.15 ft. to the true
point of beginning.
NOW, THEREFORE, it is hereby
RESOLVED: That the vacation of said street be
accomplished by the City of Kent 1n favor of said peti-
tioning abutting property owners under the procedures
outlined in Chapter 35.79 of the Revised Code of the

State of Washington; and it is further
RESOLVED: That Monday the 15th day of July,
1963, at the hour of 8:00 o'clock P. M. is hereby fixed
as the time and the Council Chambers of the City Hall
of the City of Kent is hereby fixed as the place for a
hearing upon said petition for said street vacation,
and all persons interested are required then and there
to be present and state their objections, if any they
have in the granting of said petition, and the City Clerk
is directed to take such steps as are required for noti-
fication of said hearing under the provisions of R.C.W.
35.79.020 of the Laws of the State of Washington.
Passed by the City Council and regular meeting
assembled the 17th day of June, 1963.
