RESOLUTION NO. ~
A RESOLUTION of the City Council of the City
of Kent, Washington, relative to assurances with
respect to compliance with the land acquisition
requirements of Title III of the Uniform Reloca-
tion Assistance and Real Property Acquisition
Policies Act of 1970.
WHEREAS, the Uniform Relocation Assistance and Real
Property Acquisition Policies Act of 1970, P. L. 91-646, (here-
inafter referred to as the "Act'') establishes uniform policies
for the fair and equitable treatment of persons displaced as a
result of Federal and federally assisted programs, as well as
uniform policies on real property acquisition practices with
respect to such programs; and
WHEREAS, the Act has application to programs and pro-
jects receiving Federal financial assistance from the Department
of Housing and Urban Development; and
WHEREAS, the activities for which such assistance is
sought will involve land acquisition occurring after January 2, 1971,
the effective date of the Act; and
WHEREAS, Section 305 of the Act required the provision
of certain assurances before the head of a Federal agency can ap-
prove any grant to, or contract or agreement with, a State agency
or any political sub-division thereof, under which Federal financial
assistance will be available to pay all or part of the cost of
any program or project which will result in real property acquisi-
tion subject to the requirements of the Act.
NOW THEREFORE, the City Council of the City of Kent,
Washington DO RESOLVE as follows:
A. The City of Kent hereby assures that it has authority
under state law to comply with Section 305 of the Act and agrees
that, in connection with acquisition of real property for the
following project:

1. In acquiring real property in connection with the
foregoing identified projects, contracts or agreements, the City
of Kent will be guided to the greatest extent practicable under

state law, by the land acquisition policies set out under Section
301 of the Act and the provisions of Section 302 thereof;
2. Property owners will be paid or reimbursed for
necessary expenses as specified in Sections 303 and 304 of the
Act; and
3. The costs to the City of Kent of providing payments
and assistance thereunder shall be borne in accordance with Section
211 of the Act.
4. The Mayor of the City of Kent is authorized to
execute any contracts relative to the acquisition of real property
for the above designated project and any amendments thereto, and
such additional documents which the City of Kent agrees to furnish
and be bound by, as the Secretary of Housing and Urban Development
shall determine necessary to effectuate or implement the assurances
provided hereunder.
B. The Mayor of the City of Kent is authorized to
execute this document in two counterparts for each of the above
identified contracts and this document shall be made a part of
and incorporated in said contract (s), and the provisions hereof
shall be deemed to supersede any provision in qny contract identi-
fied above to the extent that any such provision conflicts with
the assurances or agreements provided hereunder.
