I s I 3 A RESOLUTION of the City Council of the City of Kent, Washington, regarding a comprehensive plan amendment to amend the Land Use Element relating to mixed use development, and further declaring an emergency for a comprehensive plan amendment pursuant to Chapter 12.02 of the Kent City Code. WHEREAS, the Kent Comprehensive Plan designates areas for mixed use development, meaning development that combines commercial and residential uses, and outlines goals and policies for these areas; and WHEREAS, after a public hearing before the Land Use and Planning Board, the Kent City Council, on May 7, 1997, adopted Ordinances No. 3345 and 3346 amending the zoning code to allow mixed use development in certain areas, amending development regulations, and establishing a mixed use overlay; and WHEREAS, on July 21, 1998, the Mayor asked the City Council to request that the Land Use and Planning Board consider amending the provisions of the zoning code with regard to mixed uses and stand-alone residential development in the General Commercial zone, and that the City Council concurred with this request; and WHEREAS, on July 23, 1998 the Mayor asked the Land Use and Planning Board to review regulations pertaining to stand-alone residential development; and WHEREAS, at a workshop meeting on August 10, 1998, the Land Use and Planning Board agreed to consider amendments to the mixed use zoning ordinance at a public hearing in September; and 1 WHEREAS, it may be necessary to amend the Comprehensive Plan Land Use Plan Map and goals and policies in order to assure consistency between the comprehensive plan and any proposed amendments to the zoning code for mixed use; and WHEREAS, it is in the interest as expressed by the Mayor, City Council, and Land Use and Planning Board to consider proposed amendments to the comprehensive plan and zoning code in a timely manner with regard to mixed use development in the General Commercial; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON DOES HEREBY RESOLVE AS FOLLOWS: Section I. The requirement under Growth Management that zoning and land use maps and policies be consistent with one another, justifies that any comprehensive plan amendment for the mixed use areas be processed concurrently with zoning amendments, and that concurrent consideration meets the need for the definition of an "emergency" as outlined in section 12.02.035 of the Kent City Code. Section 2. The City therefore declares an emergency to pursue a comprehensive plan amendment for the mixed use area designations and goals and policies in the comprehensive plan, and further declares that any comprehensive plan amendments be considered by the Land Use and Planning Board and City Council at the same time any proposed mixed use zoning amendments are considered.
