A RESOLUTION of the City
Council of the City of Kent,
Washington, relating to the
correction of a backup problem in a
portion of the City's sewer system
in the vicinity of SE 256th St. and
116th Ave. SE, finding that an
emergency exists, and requiring the
immediate construction of a by-pass
to provide short-term relief by
diverting a portion of the City's
sewer system away from that portion
of the system affected by this
problem.
WHEREAS, the City and the Soos Creek Water and Sewer District
share a main sewer trunk line (the "Cascade Interceptor"), which
provides a link to the Metro sewerage system; and
WHEREAS, the City and the Soos Creek Water and Sewer District
have recently experienced capacity problems with the Cascade
Interceptor which have resulted in a sewage backup in the vicinity
of SE 256th St. and 116th Ave. SE that detrimentally affected
certain property owners; and
WHEREAS, the City and the Soos Creek Water and Sewer District
have been investigating the cause of this backup in order to
determine both short and long-term solutions to this problem; and
WHEREAS, while investigating the cause of this backup, the
system experienced another backup on June 4, 1994, which indicated
the increased possibility that this system backup problem may

persist until the City, together with the efforts of the Soos Creek
Water and Sewer District, constructs a solution to the overall
problemi and
WHEREAS, these backups present a real and present danger to
the health, safety and welfare of the users of the City 1 s sewer
utility systemi and
WHEREAS, because of the immediate threats to public health,
safety and welfare, an emergency exists that requires the immediate
construction of a sewer by-pass to provide short-term relief by
diverting a portion of the City 1 s sewer system flows away from that
portion of the system primarily affected by this problem without
first obtaining the benefit of any State Environmental Policy Act
( 11 SEPA 11 ) review, if SEPA review would be applicable to this
project, or of the City 1 s public bidding requirements for public
works projects. NOW, THEREFORE,
The City Council of the City of Kent, Washington, does hereby
resolve as follows:
Section 1. The above-listed recitals are found to be true and
correct in all respects.
Section 2. The City Council finds that the sewer system
backup from the Cascade Interceptor in the vicinity of SE 256th St.
and 116th Ave. SE constitutes a threat to public health, safety and
welfare.
Section 3. The City Council finds that an emergency condition
exists necessitating the immediate construction of a by-pass route
to provide short-term relief by diverting a portion of the sewer
system flows from the Cascade Interceptor in the vicinity of SE
256th St. and 116th Ave. SE to connect to the City 1 s sanitary sewer

system at a point further downstream in the system, to more evenly
distribute capacity pressures on the Cascade Interceptor system.
Section 4. Because the City must take immediate action due to
this emergency, the City Council finds that, if SEPA were to apply
to this project, the City's action would be categorically exempt
from SEPA requirements because of this emergency situation pursuant
to WAC 197-11-880, and the City Council also finds that this action
shall also be exempt from the City's public bidding requirements
for public works projects.
Section 5. As a result of this emergency condition, the
City's Director of Public Works is authorized to implement and
proceed with the design and construction of this sewer system by-
pass route under such terms and conditions as he deems appropriate
to alleviate the emergency condition.
Section 6. The City's Director of Public Works also shall, to
the extent reasonably possible, comply with the substance of both
state and local SEPA laws and all applicable public bidding
requirements.
Section 7. The City's Director of Public Works is directed to
allow side sewer connections to that portion of the City's sewer
system affected by this backup only on the condition that actual
operation of the side sewer will not commence until after final
construction of this by-pass.
Section 8. The costs incurred by the City for the
construction of this by-pass route shall be paid for from the
City's Del Webb Site Acquisition Fund# D14.
