A RESOLUTION of the City
Council of the City of Kent,
Washington relating to the existing
two lane bridge over Mill Creek on
196th Street, finding that an
emergency exists requiring the
immediate demolition of the
structure.
WHEREAS, the' City's Public Works Department has
determined that the existing two lane bridge over Mill Creek on
196th Street is both hazardous and dangerous; and
WHEREAS, the bridge has recently deteriorated and holes
have developed over the bridge in the pavement section increasing
the hazardous condition; and
WHEREAS, the Public Works Committee has recommended that
demolition be commenced to remove the structure; and
WHEREAS, the existing two lane bridge is adjacent to the
Western Processing EPA Superfund Cleanup site; and
WHEREAS, the Principle Responsible Parties (PRPs) to the
cleanup effort are currently in the process of rernediating Mill
Creek at the bridge site and have agreed to remove and store the
contaminated material along the bank at the bridge site; and
WHEREAS, the bridge's existing hazardous condition
constitutes a threat to public safety and constitutes an imminent
danger to private and public property; and

WHEREAS, the appropriate time to remove the bridge is
during the current remediation work, so as to lessen the impacts
on, and threats to, the Mill creek environment; and
WHEREAS, because of the threats to public safety and to
public and private property, as well as the environmental benefits
that will accrue to Mill Creek, an emergency exists that requires
the immediate removal of the bridge without the benefit of the
State Environmental Policy Act ("SEPA") review or of the City's
public bidding requirements; NOW THEREFORE
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON DOES
HEREBY RESOLVE AS FOLLOWS:
Section 1. The above-mentioned findings and recitals
are found to be true and correct in all respects.
Section 2. The city Council finds that the existing
two-lane bridge over Mill Creek on 196th Street is in a hazardous
and dangerous condition that constitutes both a threat to public
safety as well as an imminent danger to public and private
property.
Section 3. The City Council finds that the adverse
impacts to the Mill Creek environment will be minimized by removing
the bridge concurrently with the ongoing Mill Creek remediation
work.
Section 4. The City Council finds that an emergency
condition exists necessitating the immediate demolition of the
existing bridge over Mill Creek on 196th Street.
Section 5. Because
action due to this emergency,
the city must take immediate

City's action is categorically exempt from State Enviormental
Policy Act ( "SEPA") requirements under WAC 197-11-880 and is exempt
from the City's public bidding requirements.
Section 6. As a result of said emergency condition,
the City's Director of Public Works is authorized to implement and
proceed with prompt demolition of the Mill Creek bridge under such
terms and conditions as he deems appropriate to alleviate the
emergency condition.
Section 7. That the City's Director of Public Works
shall, to the extent possible, comply with the substance of both
state and local SEPA laws and all applicable public bidding
requirements.
