A RESOLUTION of the City Council of the
City of Kent, Washington, supporting the action
of King County to adopt legislation relating to
the imposition and collection of impact fees
from new residential development, pursuant to
the Growth Management Act of 1990.
WHEREAS, the rate of residential development in the State
of Washington has caused student populations in many school
districts to rise more quickly than the districts can build
facilities to accommodate them; and
WHEREAS, in recognition of this, the Washington State
Legislature enacted the Growth Management Act of 1990, authorizing
certain counties and cities to address these problems of growth by
imposing school impact fees on new development; and
WHEREAS, the City of Kent acknowledges that the problem
of growth has affected schools within the City and King County; and
WHEREAS, the City of Kent intends to consider and
implement an ordinance which will address the problem through the
imposition of impact fees within its jurisdiction; and
WHEREAS, the City of Kent recognizes the authority, under
the Growth Management Act of 1990, of King County to similarly
fulfill its legislative mandate; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON DOES
HEREBY RESOLVE AS FOLLOWS:
Section 1. That the city Council supports the action of
King County to address the problems of growth on schools through
the adoption of legislation to impose impact fees on residential
development within its boundaries for school districts, provided
that cities shall retain the authority to levy such fees within
their own boundaries.
