SPECIAL MEETING
March 16, 2010

Mayor Cooke called the special meeting to order at 3:00 p.m. and noted that
the purpose of the meeting is to determine whether to engage special
counsel on a case relating to pension pay.
Jensen outlined the research she has done and said because this is an
ambiguous situation, she recommends hiring outside counsel whose specialty
is pension law. She explained that this Board is an agency of the State, not
of the City, and for that reason it makes sense not to rely on the City's
attorneys. She recommended Judge Phil Talmadge and said he is willing to
take this case.
A brief discussion regarding the case, costs, and time lines was held, and
Bond moved to authorize the Chair of the Board to enter into an agreement,
subject to the advice of the City Attorney, to engage Judge Phil Talmadge as
a private consultant in the matter of Chief Tom Foster's request for an
adjustment to his pension pay. Grubbs seconded and the motion carried.
The meeting adjourned at 3:13 p.m.
