CALL TO ORDER
Councilmember Jim Berries called the meeting to order at 4:30 p.m.

Councilmember Thomas MOVED to approve the minutes of November 10,
2014. The motion was SECONDED by Council President Ralph and PASSED
3-0.
Item 2 -Interlocal Agreement between the city of Kent and King County for
Electronic Fingerprint Canture Equipment - Recommend
Chief Ken Thomas presented information regarding the Interlocal Agreement
between the city of Kent and King County for electronic fingerprint capture
equipment. AFIS is seeking formalized agreements between participating agencies
for use of the equipment. The police department now uses at least two mobile
units and continues to receive additional units for capturing fingerprints,
Councilmember Thomas MOVED to recommend Council authorize the Mayor
to sign the Interlocal Agreement with King County for the use and
maintenance of electronic fingerprint equipment provided to the City, with
final terms and conditions acceptable to the Police Chief and City Attorney.
The motion was SECONDED by Council President Ralph and PASSED 3-0.
Item 7. Police Chief's Update
Chief Ken Thomas advised the committee regarding the following current events
affecting the police department:
Upcoming Events:
® Thursday, February 12, 2015, 7:00 p.m. - 9:00 p.m. - Police Community
Meeting at Kent Elementary.
® February 25, 2015, 8:00 a.m. - Coffee with the Chief at Maggie's
o 1s` Coffee with the Chief was held January 7, 2015, at the Golden
Steer Restaurant
It was a successful and positive event.
Budget Update:

® For the 2014 budget, the police department came in over $300,000 under
budget.
Unfilled positions accounted for a large percentage of the savings.
Police officers are purchasing jumpsuits that last for three years - this
accounted for an additional $60,000-$70,000 in savings.
u Corrections medical expenses came in $63,000 under budget - This is due
to Jill Fuller, Administrative Assistant, at the correctional facility working
closely with the medical providers to obtain reductions in charges.
Narcotics
The Police Department's Special Investigations unit successfully seized
$2,291,269.00 worth of drugs in 2014, Additionally, cars, weapons, and assets
were seized that were related to drug crimes.
Chief Thomas hopes to maintain the level of drug arrests in 2015 in an effort to
protect the public. Additionally, the Chief hopes that the criminals choose not to
come to Kent to conduct criminal activity.
Chief Thomas addressed the concerns over whether or not the criminals are going
to jail. Chief Thomas indicated that King County is working on budgetary issues
that affect whether or not criminals are serving their sentences.
Recruiting
Chief Thomas provided details regarding the current statistics regarding the
number of officers:
• Currently 141 officers - Budget authorizes 147 officers
® In the process of extending offers to recruits.
e In January H candidates were hired that included a diverse group.
® 9 Officers are currently in training
® Kent has officers at the academy that will graduate at the end of February
O 6 officers currently on light duty
® Paul Peter retired this past month and at least 1 additional officer will retire
in the near future,

SUBJECT: Interlocal Agreement with Department of Corrections — Recommend
Ratification
MOTION: Recommend Council ratify the Police Chief's execution of an Interlocal
Agreement with the state Department of Corrections, and Amendments 1
through 6 that have been made to that Interlocal Agreement, to allow a state
Community Corrections Officer to continue to use space at the Kent Police
Department in accordance with the Agreement's terms.
SUMMARY:
This matter is primarily one of housekeeping. Under the state Interlocal Cooperation Act,
all interlocal agreements are to be approved by each party's governing body. However,
because this Interlocal Agreement did not involve the exchange of money, it appears that
formal council approval may not have been obtained by prior staff. Therefore, this item
seeks Council ratification of the City's execution of the original Interlocal Agreement in
2007 and the subsequent six Amendments that have been signed over the years. The
lack of formal Council authorization was discovered by the Police Department in mid-
February. However, the Interlocal Agreement was set to expire on February 28, 2015,
therefore the Police Chief signed the current Amendment after discussing the issue with
the City Attorney's Office and then noted this matter before the Public Safety Committee
to obtain the necessary authorization and ratification as soon as practicable.
The original Interlocal Agreement was signed in 2007 by former Police Chief Steve
Strachan. The purpose of the cooperative effort was to allow Community Corrections
Officers with the state Department of Corrections ("DOC") to use space at the Kent Police
Department once or twice a week. Having a DOC corrections officer within the Kent Police
Department has allowed the Department and DOC to foster better cooperation and to
enhance information sharing regarding offenders residing in the City of Kent who are
involved in continued criminal activity.
Additionally, in an effort to minimize criminal activity at community events, DOC and the
Kent Police Department have worked closely together on joint operations pertaining to
offenders under DOC supervision who have negatively impacted these community events
in the past. The cooperation that exists between DOC and the Kent Police Department
has been a resounding success. Information has been shared continually regarding
offenders involved in criminal activity resulting in arrest, charges, and the prevention of

criminal activity in the Kent community. The Kent Police Department would like this
cooperative effort to continue to the benefit of Kent and its citizens.

Department of Corrections, hereinafter referred to as Department, and the City of Kent Police
Department, hereinafter referred to as Agency.
WHEREAS, RCW Chapter 39.34(Interlocal Cooperation Act) permits state agencies and local
Governments to make the most efficient use of their powers by authorizing them to enter into
Agreements with each other, in order to provide services and facilities in a manner best serving
the needs and development of their local communities: and
WHEREAS,the purpose of this Agreement is to allow Department to place Community
Corrections Officers ("CCO's") at the premises ownedioperated by Agency located at 220
Fourth Ave. S., Kent,WA 98032 ("Premises").
NOW THEREFORE, In consideration of the terms and conditions,contained herein, Department
and Agency agree as follows:
1. Agency Responsibilities: Agency shall provide:
A. Office space for one (1) COO at Premises.
B. Provide a dedicated telephone line for use of a laptop computer, and a connection to
incoming telephone lines.
C. That premises will be accessible to the COO seven days a week, twenty-four hours
per day.
D. A mall box slot at Premises to which COO has access.
E. Janitorial service for the office space.
F. Space for a reporting kiosk, if applicable.
2. Department Responsibilities: Department shall:
A. Staff the office one or two days per week, generally from 8 a.m.to 5 p.m.
.B. Keep the office space clean
C. Wear Department identification at all times when within the building.
D. Escort visitors at all times while within the building. .
E. Maintain a visitor's log, and require all visitors to the COO to sign their names in the
log and enter the time at which they enter and exit the building.
F. Schedule offenders visits to ensure that only one offender is in the office at any time.
G. Obtain, install, and maintain a reporting kiosk and phone lines,if applicable.
3. Mutual benefits: This Agreement improves both parties ability to carry out public safety
responsibilities through:
A. Joint Operations covering events, holidays, and home/field contact.
B. Immediate response regarding felons under Department supervision.
C. Joint involvement in Community groups.

4. Access to information:
A. Access to all Department computer systems and files are restricted to the CCO.
_._. .. Department will follow its policy for dissemination of any information from its
computer systems and files.
B. Access to all Agency computer systems and files are restricted to Agency personnel
unless trained and authorized. The Agency will follow its policy and applicable law
concerning dissemination of all Agency information.
5. Term: This agreement shall take effect January 1, 2007 and shall continue in effect until
February 28, 2009. Such term may be extended by the mutual agreement of the parties
hereto for up to two (2) one-year periods. Either party,may terminate this Agreement by
giving thirty (30) days written notice to the other.
6 Hold Harmless: Each party to this Agreement shall be responsible for its own acts
and/or omissions and those of its officers, employees, and volunteers. No party to this
Agreement shall be responsible for the acts and/or omissions of entities or individuals
not a part to this Agreement.
7. Contact Persons: The parties stipulate that the following persons shall be the contact
person for their respective jurisdiction.

8. Nothing herein shall require or be interpreted to:
A. Waive any defense arising out of RCW Title 51.
B. Limit or restrict the ability of either entity or employee or legal counsel for either entity
or employee to exercise any right, defense or remedy which a party to a lawsuit may
have with respect to claims for third parties, including, but not limited to, any good
faith attempts to seek dismissal of legal claims against a parry by any proper means
allowed under the civil rules in either state or federal court.
9. General Provisions:
A. Entire Agreement. This Agreement contains all of the terms with respect to any
matter covered or mentioned in this Agreement.
B. Modification. No provision of this Agreement may be modified except by written
agreement signed by the Parties.
C. Successors. This Agreement shall be binding upon the Parties' successors in
interest, heirs; and ensigns.
D. Severability. Any provision of this Agreement which is declared invalid or illegal shall
i in no way affect or invalidate any other provision.
E. Default..In the event that either of the Parties defaults on the performance of any
j terms of this Agreement or either party places the enforcement of this Agreement in
the hands of an attorney, or files a lawsuit, each Party shall pay all its own attorneys'
fees, costs and expenses.
F. Venue. The venue for any dispute related to this Agreement shall be Thurston
County, Washington.
G. Waiver. Failure of the Agency to declare any breach or default immediately upon the
occurrence thereof, or delay in taking any action in connection with, shall not waive

such breach or default. Time is of the essence of this Agreement and each and all of
its provisions in which performance is a factor.
H. Performance. Timethe-essences-of the-essence of this Agreement and each and all is
provisions in which performance is a factor.
10. Governance: This Agreement is entered into pursuant to and under the authority
granted by the laws-of the state of Washington and any applicable federal laws. The
provisions of this Agreement shall be construed to conform to those laws.
In the event of an inconsistency in the terms of this Agreement, or between its terms and any
applicable statute or rule, the inconsistency shall be resolved by giving precedence in the
following order:
A. Applicable state and federal statutes and rules;
B. (Statement of work; and
C. Any other provisions of the Agreement, including materials incorporated by
reference.

Attachment A
VPN Connectivity Agreement
PURPOSE
The City of Kent[Agency]hosts a Department of Corrections', [Department), Community
Corrections Officer(CCO) at their location. The specific locations are identified in the main
contract, of which this is an addendum. The Agency has agreed to allow the COO use of
their network infrastructure and Internet connectivity for the purpose of connecting to the
Department network via a Virtual Private Networking (VPN) session. This Addendum will
outline agreed upon roles and responsibilities between the Department and the Agency, for
the support of the described connectivity.

PART I—DEPARTMENT RESPONSIBILITIES
I
i. The Department will supply the software client and digital key fob for Department
staff to use in establishing their VPN connection to the Department network. The
software, fob, and resultant VPN connection to the Department network will only be
used by authorized Department staff using their Department owned and managed
computing equipment.
2. The Department will ensure that the VPN software Installed, on their owned
computer, will not allow split tunneling. This means that Department staff will not be
able to connect to the Agency resources on their network, such as printers,files,
terminal services,.desktop faxing, or the like. The sole purpose and use of the
Agency infrastructure and its provision of Internet connectivity will be strictly for the
connection of Department owned computers to the Department network, to access
Department data and resources.
PART II —AGENCY RESPONSIBILITIES
1. The Agency Information Technology department agrees to provide the network
infrastructure and Internet connectivity that will allow the Department staff to
establish a VPN connection to the Department network.
2. When there are scheduled Agency network outages, which may impact Department
staff connectivity to the Department network,the AgeneVagrees to notify the
Department staff as soon as they reasonably can.
3. The Agency Information Technology Director shall have the final authority to
determine the schedule and services, to be provided by the Agency employees, to .
carry out the Agency's responsibilities under this agreement.
4. The Agency staff will not use the Department VPN connection to gain access to
Department data or resources.
PART HI—CHARGES FOR SERVICE (where applicable)
The Agency will be compensated for the services provided herein, as follows:

Councilmember Thomas MOVED to approve the minutes of November 10,
2014. The motion was SECONDED by Council President Ralph and PASSED

Item 2 -Interlocal Agreement between the city of Kent and King County for
Electronic Fingerprint Canture Equipment - Recommend
Chief Ken Thomas presented information regarding the Interlocal Agreement
between the city of Kent and King County for electronic fingerprint capture
equipment. AFIS is seeking formalized agreements between participating agencies
for use of the equipment. The police department now uses at least two mobile
units and continues to receive additional units for capturing fingerprints,
Councilmember Thomas MOVED to recommend Council authorize the Mayor
to sign the Interlocal Agreement with King County for the use and
maintenance of electronic fingerprint equipment provided to the City, with
final terms and conditions acceptable to the Police Chief and City Attorney.
The motion was SECONDED by Council President Ralph and PASSED 3-0.
Item 7. Police Chief's Update
Chief Ken Thomas advised the committee regarding the following current events
affecting the police department:
Upcoming Events:

It was a successful and positive event.
Budget Update:

® For the 2014 budget, the police department came in over $300,000 under
budget.
Unfilled positions accounted for a large percentage of the savings.
Police officers are purchasing jumpsuits that last for three years - this
accounted for an additional $60,000-$70,000 in savings.
u Corrections medical expenses came in $63,000 under budget - This is due
to Jill Fuller, Administrative Assistant, at the correctional facility working
closely with the medical providers to obtain reductions in charges.
Narcotics
The Police Department's Special Investigations unit successfully seized
$2,291,269.00 worth of drugs in 2014, Additionally, cars, weapons, and assets
were seized that were related to drug crimes.
Chief Thomas hopes to maintain the level of drug arrests in 2015 in an effort to
protect the public. Additionally, the Chief hopes that the criminals choose not to
come to Kent to conduct criminal activity.
Chief Thomas addressed the concerns over whether or not the criminals are going
to jail. Chief Thomas indicated that King County is working on budgetary issues
that affect whether or not criminals are serving their sentences.
Recruiting
Chief Thomas provided details regarding the current statistics regarding the
number of officers:
• Currently 141 officers - Budget authorizes 147 officers
® In the process of extending offers to recruits.
e In January H candidates were hired that included a diverse group.
® 9 Officers are currently in training
® Kent has officers at the academy that will graduate at the end of February
O 6 officers currently on light duty
® Paul Peter retired this past month and at least 1 additional officer will retire
in the near future,

SUBJECT: Interlocal Agreement with Department of Corrections — Recommend
Ratification
MOTION: Recommend Council ratify the Police Chief's execution of an Interlocal
Agreement with the state Department of Corrections, and Amendments 1
through 6 that have been made to that Interlocal Agreement, to allow a state
Community Corrections Officer to continue to use space at the Kent Police
Department in accordance with the Agreement's terms.
SUMMARY:
This matter is primarily one of housekeeping. Under the state Interlocal Cooperation Act,
all interlocal agreements are to be approved by each party's governing body. However,
because this Interlocal Agreement did not involve the exchange of money, it appears that
formal council approval may not have been obtained by prior staff. Therefore, this item
seeks Council ratification of the City's execution of the original Interlocal Agreement in
2007 and the subsequent six Amendments that have been signed over the years. The
lack of formal Council authorization was discovered by the Police Department in mid-
February. However, the Interlocal Agreement was set to expire on February 28, 2015,
therefore the Police Chief signed the current Amendment after discussing the issue with
the City Attorney's Office and then noted this matter before the Public Safety Committee
to obtain the necessary authorization and ratification as soon as practicable.
The original Interlocal Agreement was signed in 2007 by former Police Chief Steve
Strachan. The purpose of the cooperative effort was to allow Community Corrections
Officers with the state Department of Corrections ("DOC") to use space at the Kent Police
Department once or twice a week. Having a DOC corrections officer within the Kent Police
Department has allowed the Department and DOC to foster better cooperation and to
enhance information sharing regarding offenders residing in the City of Kent who are
involved in continued criminal activity.
Additionally, in an effort to minimize criminal activity at community events, DOC and the
Kent Police Department have worked closely together on joint operations pertaining to
offenders under DOC supervision who have negatively impacted these community events
in the past. The cooperation that exists between DOC and the Kent Police Department
has been a resounding success. Information has been shared continually regarding
offenders involved in criminal activity resulting in arrest, charges, and the prevention of

criminal activity in the Kent community. The Kent Police Department would like this
cooperative effort to continue to the benefit of Kent and its citizens.

WHEREAS, RCW Chapter 39.34(Interlocal Cooperation Act) permits state agencies and local
Governments to make the most efficient use of their powers by authorizing them to enter into
Agreements with each other, in order to provide services and facilities in a manner best serving
the needs and development of their local communities: and
WHEREAS,the purpose of this Agreement is to allow Department to place Community
Corrections Officers ("CCO's") at the premises ownedioperated by Agency located at 220
Fourth Ave. S., Kent,WA 98032 ("Premises").
NOW THEREFORE, In consideration of the terms and conditions,contained herein, Department
and Agency agree as follows:
1. Agency Responsibilities: Agency shall provide:
A. Office space for one (1) COO at Premises.
B. Provide a dedicated telephone line for use of a laptop computer, and a connection to
incoming telephone lines.
C. That premises will be accessible to the COO seven days a week, twenty-four hours
per day.
D. A mall box slot at Premises to which COO has access.
E. Janitorial service for the office space.
F. Space for a reporting kiosk, if applicable.
2. Department Responsibilities: Department shall:
A. Staff the office one or two days per week, generally from 8 a.m.to 5 p.m.
.B. Keep the office space clean
C. Wear Department identification at all times when within the building.
D. Escort visitors at all times while within the building. .
E. Maintain a visitor's log, and require all visitors to the COO to sign their names in the
log and enter the time at which they enter and exit the building.
F. Schedule offenders visits to ensure that only one offender is in the office at any time.
G. Obtain, install, and maintain a reporting kiosk and phone lines,if applicable.
3. Mutual benefits: This Agreement improves both parties ability to carry out public safety
responsibilities through:
A. Joint Operations covering events, holidays, and home/field contact.
B. Immediate response regarding felons under Department supervision.
C. Joint involvement in Community groups.

4. Access to information:
A. Access to all Department computer systems and files are restricted to the CCO.
_._. .. Department will follow its policy for dissemination of any information from its
computer systems and files.
B. Access to all Agency computer systems and files are restricted to Agency personnel
unless trained and authorized. The Agency will follow its policy and applicable law
concerning dissemination of all Agency information.
5. Term: This agreement shall take effect January 1, 2007 and shall continue in effect until
February 28, 2009. Such term may be extended by the mutual agreement of the parties
hereto for up to two (2) one-year periods. Either party,may terminate this Agreement by
giving thirty (30) days written notice to the other.
6 Hold Harmless: Each party to this Agreement shall be responsible for its own acts
and/or omissions and those of its officers, employees, and volunteers. No party to this
Agreement shall be responsible for the acts and/or omissions of entities or individuals
not a part to this Agreement.

or employee to exercise any right, defense or remedy which a party to a lawsuit may
have with respect to claims for third parties, including, but not limited to, any good
faith attempts to seek dismissal of legal claims against a parry by any proper means
allowed under the civil rules in either state or federal court.
9. General Provisions:
A. Entire Agreement. This Agreement contains all of the terms with respect to any
matter covered or mentioned in this Agreement.
B. Modification. No provision of this Agreement may be modified except by written
agreement signed by the Parties.
C. Successors. This Agreement shall be binding upon the Parties' successors in
interest, heirs; and ensigns.
D. Severability. Any provision of this Agreement which is declared invalid or illegal shall
i in no way affect or invalidate any other provision.
E. Default..In the event that either of the Parties defaults on the performance of any
j terms of this Agreement or either party places the enforcement of this Agreement in
the hands of an attorney, or files a lawsuit, each Party shall pay all its own attorneys'
fees, costs and expenses.
F. Venue. The venue for any dispute related to this Agreement shall be Thurston
County, Washington.
G. Waiver. Failure of the Agency to declare any breach or default immediately upon the
occurrence thereof, or delay in taking any action in connection with, shall not waive

such breach or default. Time is of the essence of this Agreement and each and all of
its provisions in which performance is a factor.
H. Performance. Timethe-essences-of the-essence of this Agreement and each and all is

10. Governance: This Agreement is entered into pursuant to and under the authority
granted by the laws-of the state of Washington and any applicable federal laws. The
provisions of this Agreement shall be construed to conform to those laws.
In the event of an inconsistency in the terms of this Agreement, or between its terms and any
applicable statute or rule, the inconsistency shall be resolved by giving precedence in the
following order:
A. Applicable state and federal statutes and rules;
B. (Statement of work; and
C. Any other provisions of the Agreement, including materials incorporated by
reference.

Attachment A
VPN Connectivity Agreement
PURPOSE
The City of Kent[Agency]hosts a Department of Corrections', [Department), Community
Corrections Officer(CCO) at their location. The specific locations are identified in the main
contract, of which this is an addendum. The Agency has agreed to allow the COO use of
their network infrastructure and Internet connectivity for the purpose of connecting to the
Department network via a Virtual Private Networking (VPN) session. This Addendum will
outline agreed upon roles and responsibilities between the Department and the Agency, for
the support of the described connectivity.

PART I—DEPARTMENT RESPONSIBILITIES
I
i. The Department will supply the software client and digital key fob for Department
staff to use in establishing their VPN connection to the Department network. The
software, fob, and resultant VPN connection to the Department network will only be
used by authorized Department staff using their Department owned and managed
computing equipment.
2. The Department will ensure that the VPN software Installed, on their owned
computer, will not allow split tunneling. This means that Department staff will not be
able to connect to the Agency resources on their network, such as printers,files,
terminal services,.desktop faxing, or the like. The sole purpose and use of the
Agency infrastructure and its provision of Internet connectivity will be strictly for the
connection of Department owned computers to the Department network, to access
Department data and resources.
PART II —AGENCY RESPONSIBILITIES
1. The Agency Information Technology department agrees to provide the network
infrastructure and Internet connectivity that will allow the Department staff to
establish a VPN connection to the Department network.
2. When there are scheduled Agency network outages, which may impact Department
staff connectivity to the Department network,the AgeneVagrees to notify the
Department staff as soon as they reasonably can.
3. The Agency Information Technology Director shall have the final authority to
determine the schedule and services, to be provided by the Agency employees, to .
carry out the Agency's responsibilities under this agreement.
4. The Agency staff will not use the Department VPN connection to gain access to
Department data or resources.

hereinafter referred to as Department, and the City of Kent Police Department, hereinafter
referred to as Agency,for the purpose of amending the above-referenced Contract, heretofore
entered into between the Department and Agency.
WHEREAS the purpose of this contract amendment is to extend the Term and to update the
Contact Persons;
NOW THEREFORE, in consideration of the terms and conditions contained herein, or attached
and incorporated and made a part hereof, the Department and Agency agree as follows:
Paragraph 5. Term is amended, In part, as follows:
5. Term: This agreement shall take effect January 1, 2007 and shall continue in
effect until ((€ebpjapy 28,2043)) February 28, 2015. Such term may be
extended by the mutual agreement of the parties hereto for up to two (2)two-.
year periods. Either party may terminate this Agreement by giving thirty(30)
days written notice to the other.
