OPERATIONS COMMITTEE MINUTES
November 20, 2012
Committee Members Present: Les Thomas, Chair, and Dennis Higgins
The meeting was called to order by L. Thomas at 4:02 p.m.
1. APPROVAL OF MINUTES DATED NOVEMBER 6, 2012.
D. Higgins moved to approve the Operations Committee minutes dated
November 6, 2012. L. Thomas seconded the motion with concurrence from J. Perry,
which passed 3-0.
2. APPROVAL OF CHECK SUMMARY REPORT DATED OCTOBER 16, 2012 THROUGH
OCTOBER 31, 2012.
D. Higgins moved to recommend that the City Council approve the Check Summary
Report dated October 16th, 2012 thru October 31" 2012. L. Thomas seconded the motion
with concurrence from ].Perry, which passed 3-0.
3. CONSULTANT SERVICES AGREEMENT- EBERLE VIVIAN, INC- AUTHORIZE.
C. Hills presented a contract for Third Party Claims Administration Services for Worker
Compensation programs. Eberle Vivian is a Kent based business and was involved in the RFP
process 4 years ago. The city was unable to come to their terms at the time. The current Third
party Claims Administration Services is closing their offices in Tukwila and shutting down operations
in the Northwest. The Manager from the current Consultant Services is moving to Eberle Vivian and
the terms of the contract are acceptable. Also the city will be saving money with the new
consultants.
L. Thomas asked about the savings and questioned the reasoning. C.Hills responded that the
current consultant services had higher overhead costs where Eberle Vivian is local and does not
have overhead costs.
Motion by D. Higgins, seconded by L. Thomas in concurrence from J. Perry, to move to
recommend that the Mayor be authorized to enter into a consultant services agreement
with Eberle Vivian, Inc. which provides Third Party Claims Administration Services for
entities which Self-Insure their Worker Compensation programs. Terms and conditions of
the agreement shall be acceptable to the Risk Manager and the City Attorney. Annual Cost
in an amount not to exceed $51,250 per year for 2013.

4. MEMORANDUM OF UNDERSTANDING — JOINT FUNDING PROGRAM - AUTHORIZE.
Chief Thomas explained that MOU is for joint funding program to address youth violence. The
member cities of South King County are chipping in $30,000 for outreach workers. These outreach
workers try to get in touch with the at risk youth on the streets. The funding for the program will
be coming from the seizure funds. D. Higgins asked if Chief can provide an update back to the
council regarding progress of the program.
Motion by D. Higgins, seconded by L. Thomas in concurrence from J. Perry, to move to
recommend City Council to authorize the Mayor to enter into a Memorandum of
Understanding between the cities of Auburn, Kent, Renton, Tukwila, Algona, Pacific, Fife,
Puyallup and Sumner for planning, funding, and implementation of a joint funding program
with terms and conditions acceptable to the Police Chief and the City Attorney.
S. LEGISLATIVE CONSULTING SERVICES CONTRACT — AUTHORIZE.
M. Wilmot presented the contract for re-authorization for consulting services of D. Levy. She
explained that he has worked for the city since year 2000. He has brought back over 100 million
dollars back to the city. He has helped with Annexation sales tax credit dollars and levy funding. He
reports his findings back to the city regularly.
D. Higgins asked what other cities he works for and M. Wilmot explained that he works for Renton,
Everett and Puyallup to name a few. His work with other cities helps us a lot. L. Thomas added that
D. Levy is highly respected among his peers.
Motion by D. Higgins, seconded by L. Thomas in concurrence from J. Perry, to move to
authorize the Mayor to sign the government relations consulting services agreement for
2013 with Outcomes by Levy, in the amount of $66,000 per year, plus agreed upon
expenses, and upon review by the City Attorney.
The meeting was adjourned at 4:15 p.m. by L. Thomas.
