The ten-foot side yard landscaping is required under Section 15. 07 . 060 (P) of the Kent Zoning Code. B. Variance request to reduce the required ten-foot landscape buffer next to SR 167 (Valley Freeway) to five feet. This landscaping is required under Section 15. 07. 040 (0) of the Kent Zoning Code. BOARD OF ADJUSTMENT MEMBERS PRESENT: Tracy Faust, Vice Chair Beth Carroll Jack Cosby BOARD OF ADJUSTMENT MEMBERS ABSENT: Robert Jarvis, excused Walter Flue, excused CITY STAFF MEMBERS: Fred Satterstrom, Acting Planning Director Kathy McClung, Senior Planner Mary Duty, Planner Lois Ricketts, Recording Secretary APPROVAL OF DECEMBER 13, 1988 BOARD OF ADJUSTMENT MINUTES Beth Carroll MOVED and Jack Cosby SECONDED the motion to approve the minutes of the December 13, 1988 meeting as printed. Motion carried. Vice Chair Faust administered the oath to all who intended to speak. Fred Satterstrom explained that he has been appointed by Mayor Kelleher as the Acting Director of the Planning Department in the absence of James P. Harris, now Acting City Administrator. ONE-SIXTY-SEVEN BUILDING #V-88-6 Mary Duty presented the request by Torjan Ronhovde to reduce the required side yard landscaping from ten feet to five feet on the south property line and a variance to reduce the required ten-foot landscape buffer next to SR 167 to five feet. The property is located on the west side of 74th Avenue South, on the east side of SR 167 and is north of the Foster Industrial Park. The lot is 11,430 square feet in a triangular shape. The property is zoned iM2, Limited Industrial. Other properties surrounding the site are also zoned M2 . The minimum lot size in the M2 zone is 20, 000 Kent Board of Adju tment Minutes January 9, 1989 square feet. This legal nonconforming lot was created at the time the land for SR 1457 exit ramp was acquired. The applicant is proposing a 3,500 square foot office building. The leasable floor area would be on the upper level with parking under the building. It is proposed that,thirty-eight percent of the site be landscaped. i Ms. Duty showed view foils depicting the location of the site and surrounding properties. Videos were also shown. The Planning Department feels t at the variance would not constitute a grant of special privilege, because the subject property is a legal nonconforming lot that is significantly undersized compared to other lots in the area and would not be suitable for most industrial uses. The size, irregular shape and location make this lot nearly undevelbpable. The zoning code requires 15 feet of front yard landsca ing, 10 feet of side yard landscaping, and 10 feet of landscaping next to SR 167. The developer hopes to obtain a conditional use permit for an office building. The Planning Department feels that there are special circumstances relating to the size, shape, topography and location regarding this site. The lot is undersized, and its triangular shape limits the possibilities for Oevelopment. A further constraint would be a ten-foot landscape buffer next to SR 167. The Planning Department feels that granting of this variance would not be materially detrimental to the public welfare or injurious to the property in the area. The intent of the code would be met with the additional landscaping which would be proportionally higher than other lots in the area. The proposed landscaping would provide a visual screen from the parking, but it was suggested that deciduous trees be added to soften the appearance of the building. The Planning Depart m I ent recommends approval with three conditions. Ms. Duty read the onditions. Torjan Ronhovde, of DNA/Ronhovde Architects, representing Wayne Gilthvedt and Glen Armstrong, owners of the property, explained that when the owners purchased the site they were given incorrect dimensions and were not aware of a street widening that had taken place. The original dimensions would have allowed for a larger building. To comply with the ten-foot setbacks on either the south side or the west side would leave little space to develop the required maneuvering space for the parking areas because of the triangular shape. The building envelope is nearly pushed out to the required setbacks for both the parking and for the building itself. Mr. Ronnov a plans to add additional landscaping to soften the effect of the reduction in landscaping. It is designed to be a two-story building with parking below the building. 2 I i i i i w Kent Board of Adjustment Minutes January 9, 1989 Acting Chair Faust asked to be shown renditions of the building. These were studied by the Board members. Mr. Ronhovde expressed willingness to comply with the conditions imposed by this Board, SEPA, state and local agencies, to tie landscaping plans in with the conditional use permit and to add additional deciduous shrubs at the south end of the site. Discussion followed regarding the future visibility from the freeway exit. Mr. Ronhovde added that signage would conform to the requirements of the Planning Department. Mr. Cosby was impressed with the proposed plans for this difficult site. Ms. Carroll did not foresee a problem with the plans. Mr. Cosby MOVED to close the public hearing and move to executive session. Ms. Carroll SECONDED the motion. Motion carried. Acting Chair Faust applauded the applicant for wanting to use such an irregularly shaped piece of property in a constructive way. She stated that they approved the variance with the three conditions suggested by the Planning Department: 1. Any approval of variance is tied directly to the site and landscape plans submitted as part of this application. Any significant changes to the site, landscape or building plans will require a new variance hearing. 2 Add deciduous trees to the south end of the parking lot and to the five-foot strip adjacent to SR 167. The number, type, and spacing of these trees are to be approved by the Planning Department. 3 . Additional conditions may be applied during the conditional use permit process and at the time of development. ADJOURNMENT Mr. Cosby MOVED and Ms. Carroll SECONDED a motion to adjourn the meeting.
