• October 7, 1991
The scheduled meeting of the Kent Board of Adjustment was called to
order by Chair Cosby on the evening of Monday, October 7 , 1991, at
7 p.m. in Chambers West, Kent City Hall.

APPROVAL OF THE SEPTEMBER 9 1991 BOARD OF ADJUSTMENT MINUTES
Mr. Biteman MOVED that the minutes of the September 9, 1991 meeting
be approved as written. Mr. Flue SECONDED the motion. Motion
carried.
Chair Cosby administered the oath to all who intended to speak.
76TH AVENUE ASSOCIATES II AND III #V 91-4
Alice Shobe presented 76th Avenue Associates request for a variance
from Section 15. 07 . 060 (Q) of the Kent Zoning Code which requires
five feet of side yard landscaping in a M3 , General Industrial,
zone. The Mill Creek Distribution Center Building II is located at
21840 76th Avenue South, and Mill Creek Distribution Center
Building III is located at 21810 76th Avenue South. The two
buildings are located on adjacent legal lots which are
approximately 16 acres in size. The Comprehensive Plan designates
the subject property as I, Industrial, and the Valley Floor Plan
designates the property as I. Industry. Each building is located
on a separate legal lot, and full compliance is required for each
legal lot. The Planning Department required the lot line in the
middle of these two buildings to be removed so that it could be
reviewed as one site. The applicant complied with this request.
Since there are separate mortgages on each lot, it was determined
to be infeasible, but this determination came too late in the
process. The project was reviewed and designed as one lot.
Between the two buildings there is a large open space with dock-
high loading doors facing the open space. Trucks maneuver between
• the two buildings. She pointed out that there is a 14-foot-high
wall that has been set back on the driveway so that people driving

into the park seo Distribution Building III on the left and
Distribution Building II on the right. The applicant received a
permit for this wall which is blank with no signage on it. This
wall obscures the area where the landscaping strip would be
required.
1. Variance shall not constitute a grant of special privileges
inconsistent With a limitation upon uses of other properties
in the vicinity and zone in which the property, on behalf of
which the application was filed, is located.
Staff feels that no special privileges would be granted with this
request because the intent of side yard landscaping is to buffer
between adjacent properties and streets. In this proposal it would
be doing neither. The side yard landscaping would not be visible
from the road because of the wall.
2 . Such a variance is necessary, because of special circumstances
relating to the size, shape topography, location or
surroundings Of the subject property, to provide it with use
rights and privileges permitted to 'other properties in the
vicinity and jin the zone in which the subject property is
located.
The circumstance was created when it was determined late in the
development process that the removal of the lot line could not take
place because of separate mortgages on the two properties and
because the site plan was designed reviewed and as one project.
3 . That the granting of such variance will not be materially
detrimental to the public welfare, or injurious to the
property or improvements in the vicinity and zone in which the
subject property is situated.
Since the landscaping would not be visible from the street or
adjacent properties, there is no detriment to public welfare.
Staff recommended Approval of this variance with no conditions.
Bart Brynstad, representing Northward Development, owners of the
subject property, ptated that they have put in a 14-foot-high by
50-foot-wide wall to obscure the truck and trailer parking. He
felt this added aesthetically to the park. He pointed out that
even if they were required to put in the landscaping, it would not
be visible from the street. Since the site is located in the M3
zone, the maneuvering area is basically used by trucks for heavy
industrial uses. Where is little public use of the site. He

stated that this had been done previously in the City of Kent, so
it would not be setting a precedent.
Mr. Ramos asked if there was landscaping in front of the wall.
Mr. Brynstad responded that there is five feet of landscaping on
front side of the wall and 15 feet of landscaping on the back side
of the wall.
Mr. Biteman stated that he was impressed with the amount of green
grass and the conditions of the plants and trees. He said the wall
was almost an architecturally designed wall which ties the two
buildings together. There are linear indentations in the wall of
a sculptured nature.
Mr. Brynstad explained that they have the landscaping
professionally maintained on a weekly basis.
Mr. Biteman added that the site gave an impressive appearance. The
attitudinal intent of the owners was positive, and any changes
required would make the operation less efficient and probably less
attractive.
Chair Cosby adjourned the meeting to a private session.
Chair Cosby called the meeting back into session.
Mr. Ramos MOVED that Board approve the staff recommendation of
approval because it meets the three criteria established for
approval of a variance. Mr. Banister SECONDED the motion. Motion
carried.
Mr. Flue MOVED that the meeting be adjourned. Mr. Banister
SECONDED the motion. Motion carried.
The meeting was adjourned at 7 : 20 p.m.
