The meeting was called to order by Chair Clark at 4:10 P.M.
Approval of Minutes of March 15,2004
Committee Member Harmon moved and Chair Clark seconded a motion to approve the minutes of the March
15,2004 meeting. The Motion carried 2-0 with Chair Clark noting Member White's concurrence.
International Building Codes Updates Ordinance and Resolution
Building Official, Bob Hutchinson stated that the 2003 additions to the Building, Mechanical, Residential
and Fire Codes, and the Uniform Plumbing Code along with the State Amendments becomes affective
July 1, 2004.
Mr. Hutchinson described the proposed draft Ordinance adopting the Building, Mechanical, Residential and
Plumbing Codes along with the State Amendments noting that a majority of the local amendments retain
existing administrative provisions applicable to the Uniform Building, Mechanical and Plumbing Code
which are being replaced by the Intemational Codes. Mr. Hutchinson cited examples of those provisions,
stating that the remainder of this ordinance deals primarily with housekeeping changes.
Mr. Hutchinson stated that changes reflected in the Fees Resolution account for inflation, establishes permit
fees,plan review fees,and fees related to the Intemational and Uniform Codes.
Mr. Hutchinson stated that the building permit fee schedule for the International Building and Residential
Codes are unchanged, that those fees are determined administratively and based on the value of work being
done. He explained the changes made to the International Fire Code fees. Mr. Hutchinson answered
questions from Members Clark and Harmon related to fee rates and free standing out building exemptions.
Fire Marshall Ken Weatherill spoke about the draft ordinance which amends and adopts the Fire Code as part
of the International Code. He stated that this ordinance clarifies areas of the Fire Code not historically
adopted by the State dealing with fire vehicular access, fire lines and fire apparatus. Mr. Weatherill
responded to questions by Member Harmon and Chair Clark concerning fire suppression requirements and
model code language.
Member Harmon moved and Chair Clark seconded a motion recommending that City Council enact
Ordinances adopting the Intemational Building, Residential, Mechanical and Fire Codes and the Uniform
Plumbing Code together with the City's local amendments to those codes and that the City Council adopt the
proposed fees resolution to those codes subject to final review and amendment by the City Attorney. Motion
Carried 3-0 with Bruce White's concurrence.
Countvwide Plannine Policies-Auburn as an Urban Center
Planning Manager Charlene Anderson stated that once the GMPC, Growth Management Planning Council
and King County have approved an amendment to the Countywide Planning Policies, that amendment goes
to the Cities and County for ratification with approval of 30 percent of the Cities and Counties representing
70 percent of the population in order to pass. She stated that Countywide Planning Policies provide a
framework for Comprehensive Plan Amendments for all jurisdictions in the County.
Ms. Anderson defined Urban Centers, stating that Auburn has requested to become an Urban Center. She
stated that staff supports ratification of this amendment. Chair Clark expounded on Urban Centers.
Member Harmon moved to recommend ratification of the amendment to the Countywide Planning Policies
designating Downtown Auburn as an Urban Center as approved under the GMPC Motion #03-2 and to
forward this to the Full City Council for final action. Chair Clark Seconded the Motion. Motion Carried 3-0
with Bruce White's concurrence.
Chair Clark adjourned the meeting at 4:35 p.m.

Regarding: 2004 Comprehensive Plan Update (#CPA-2002-1)
MOTION: I move to recommend/not recommend approval of the 2004 Comprehensive Plan
Update as recommended by the Land Use & Planning Board, and forward this to the full City
Council for adoption.
SUMMARY: The adoption of an updated Kent Comprehensive Plan (Plan) and development
regulations is required under the State Growth Management Act (GMA) by December 1, 2004,
pursuant to RCW 36.70A.130(4). The update ensures compliance with GMA legislation that has
been passed since 1990. The update also integrates by reference or through policy development
various regional and local planning documents, as well as demographics from the 2000 U.S.
Census. Overall, the update does not substantially change the direction, theme, goals, or policies
of the Plan adopted in 1995. As such, the Environmental Impact Statement (#ENV-93-51)
associated with the adoption of the 1995 Comprehensive Plan is still appropriate, requiring
simply an addendum which was completed March 1, 2004.
BUDGET IMPACT: None
BACKGROUND: The 2004 Comprehensive Plan Update addresses the following issues:
• GMA compliance;
• Demographic adjustments based on the City's expanded boundaries and new 2000
Census data;
• Household and employment allocations that were synthesized by the Buildable Lands and
Targets subcommittee (made up of Planning Directors from King County suburban cities
and staff from King County)using forecasts developed by Puget Sound Regional Council
(PSRC) and the State Office of Finance and Management(OFM);
• Refinements based on a variety of new and updated regional planning documents, such as
King County Countywide Planning Policies (2003), and PSRC's VISION 2020 (1993)
and Destination 2030 (2001);
• New language to reflect planning documents the City has adopted, such as the 2003-2007
Consolidated Plan for Housing & Community Development (2002), Interim 2000
Comprehensive Park, Recreation and Community Services Plan (2000), Kent Economic
Development Strategic Plan (2003), and the Downtown Strategic Action Plan (1998);
• 0 Results from the"Innovative Housing Workshop" (2002);

• Performance measures based on Kent Performance Measurement Report (2001), Kent
Fire & Life Safety Strategic Plan (2001), and City of Kent Police Strategic Plan —Draft
(2003) for the purpose of evaluating levels-of-service;
• Appendices with goals and policies from the 1999 City of Kent Shoreline Master
Program; and
• Six-year Capital Improvement Program funding sources for 2004-2009 for the Capital
Facilities Project and Transportation Capital Improvements Program.
The Land Use & Planning Board (LU&PB) began working on the 2004 Comprehensive Plan
Update in May 2002 and held twenty (20) workshops and fourteen (14) public hearings. On
March 8, 2004 the LU&PB forwarded the Plan to the City Council with a recommendation of
approval along with the following concerns expressed by board member David Malik (The
concerns generally do not relate to the update of the Comprehensive Plan, but rather to
implementing regulations.):
• Change zoning on 272nd between Military Road and I-5 —behind Circle K;
• Change zoning on Pacific Highway to allow for the development of car lot sales and
casinos to generate a source of revenue for the City of Kent;
• Review zoning on Mobile Home Parks;
• If storm water regulations are amended, the City should incorporate those changes with
new regulations to notify developers, real estate agents and property owners; and
• • Concerning storm water regulations, staff needs to provide public notification to citizens,
developers, real estate companies, owners or agents and brokers prior to implementing
any proposed changes.
ISSUES: At the March 301h Council Study Session, several issues were raised and later
discussed at the Study Session held April 131h. Some were informational requiring elaboration
on successes that have occurred in downtown because of the Downtown Strategic Action Plan
and the benefits of the Urban Center Designation. Others needed an explanation as to why the
Urban Center targets were removed and the consequences of open space acquisition. There are,
however, issues that need further discussion and possible action:

Staff recommends replacing the word "Prohibit" with the original word "Limit", making the
policy in the Transportation Element read: Policy TR-6.6 — Limit the development of new
cul-de-sac streets except where there are geographic or environmental constraints that
make connections to other streets infeasible.
❖ Urban Density: In response to comments by Washington State Department of Community
Trade and Economic Development(CTED)to Kent's "DRAFT"2004 Comprehensive Plan

was revised:

Board(the Board), in order to adequately support urban services.
Adopting Policy LU-9.1 as written would require further action by the City to be in
compliance with said policy. Staff has identified three options for consideration:
1. Keep the language as written and direct Planning Services via a resolution to add to
the "2004 Work Program" an item to analyze all SF-1 and SF-3 land use designations
based on the Board's above "bright line" minimum urban density and change Kent's
land use designations based on the City's findings;
2. Keep the language as written and do not direct staff to conduct further analysis; or
3. Do not change the language.
❖ Land Use Map Changes: As part of the 2004 Comprehensive Plan Update, an area-wide
review of Kent's land use map designations was made and changes are proposed. The
attached text and color reference map were presented and approved by Land Use &Planning
. Board at the July 28, 2003 Public Hearing on the Land Use Element.
Please bring your 2004 Comprehensive Plan Update binder to the meeting. Staff will be
available to further discuss this issue.

ATTACHMENT
PROPOSED LAND USE MAP CHANGES
Staff recommends the following land use map changes (see attached map Figure 1):
1. Adoption of King County Land Use Atlas (Ordinance #14448, February 2003) for
Kent's Potential Annexation Area(PAA).
• In the Panther Lake PAA area the changes are: Urban Residential 1 Unit/Acre
(UR-ldu/ac) changed to UR- 4-12du/ac; reduction in Parks and Open Space to
UR- 4-12du/ac; and Community Facility land use designation changed to UR- 4-
12du/ac.
• In Agricultural PAA area the changes are: All lands within the Lower Green
River Agricultural Production District (APD) are designated Rural and remain
Agricultural Resource (Ag-R); on the west side of the APD lands changed from
AG-R to UR-ldu/ac, UR-4du/ac, and Other Parks/Wilderness; and on the east
side of the APD lands changed from SF-1 to Urban Separator and Parks and Open
Space.
• In the West Hill PAA area off Military Road South the changes are: From all SF-
6 to Neighborhood Business Center and Industrial where existing uses are storage,
auto/truck repair, and pet cemetery; and off Orillia Road South there are no
changes to the UR-Idu/ac.
2. Eliminate Community Facility land use designation and replace with Parks & Open
Space designation.
All active use parks or passive use open space over 2 acres in size are illustrated
as Parks & Open Space land use designation.
• 2a — Change existing school to Low Density Multifamily (LDMF) to reflect
surrounding land use designation and existing uses.
• 2b—Change existing parks maintenance facility and ice-skating facility to SF-1 to
support the existing zoning district SR-1.
• 2c — Change 1-5 interchange and METRO Park & Ride facility to surrounding C
land use designation.
• 2d—Change existing school to surrounding land use designation of SF-6.
3. Eliminate Mixed-Use Restricted land use designation and replace with Mixed-Use
designation.
• Change designation to reflect zoning code amendment (Ordinance #3440 on
February 1999) that requires multifamily development be combined with
commercial development in the General Commercial (GC) zoning district,
thereby eliminating the need for Mixed-Use Restricted land use.
4. Define Urban Center boundary as indicated in Downtown Strategic Action Plan.
• Change the land use designation of parcel south of Willis located along Central
• Avenue from City Center(i.e. Urban Center) to Commercial (C).

5. Review areas presently zoned Neighborhood Community Commercial (NCC) for
consistent use of Neighborhood Services (NS) land use designation.
• The land use designation of NS typically would be the City's NCC zoning district.
However,most NCC areas currently have a Commercial(C) land use designation.
• 5a — 92nd Ave S/South 2121h Way — Presently NCC zoned parcel is being
permitted for a large grocery chain and the SR-1 zoned parcel is an historic
cemetery. Change from C to NS land use designation.
• 5b—Military Rd S/South 248`h St—Presently there is a mix of NCC and C zoning
in this area, with existing commercial land uses surrounded by established single-
family neighborhood. Maintain C land use designation; this may result in rezone
applications to Community Commercial (CC).
• 5c — South 272nd St/Military Rd S — A mix of NCC and Office (0) zoning, with
existing gas/mini-mart on the NCC and offices in the O. Change from C to NS
land use.
• 5d — Kent-Kangley Road/l 16`h Ave SE — Existing land uses are a small grocery
with three (3) cabins rental in back, two (2) single family homes, and one lot that
will be building a gas/mini-mart. Change the C land use designation to Mixed-
Use (MU) as a transition use from existing more intense land uses to the west and
the single-family uses to the east and south.
• 5e— 152❑d Ave SE/SE 280`h St—Change the C land use designation to NS.
• 5f—SE 240`h St/116`h Ave SE—Maintain existing NS land use designation.
• 6. Review land use designation of area along 92nd Ave SE and north of S 208`h Way.
• The recent Comprehensive Land Use Amendment in the area from SF-3 to SF-6
with a SR-4.5 zoning district in 2002 (Maple Vista— CPA-2002-2[D]), prompted
review of all parcels south to S. 208`h Street.
• Pending Clustering Ordinance may afford property owners a density that makes
the cost of infrastructure improvements viable.
• Change from SF-3 to SF-6 with a possible zoning district change from SR-3 to
SR-4.5.
7. Review of land use designation of area 132nd Ave SE and north of Kent-Kangley
Road.
• The recent Comprehensive Land Use Amendment request from SF-6 to C in 2002
(Knipp—CPA-2002-2[A]) was denied, however, the application prompted review
of the area.
• Surrounded by Commercial to the south and east, located near the transit routes
along Kent-Kangley Rd, and near a Park&Ride facility.
• In support of higher density residential land uses near commercial activities and
transit routes, and to buffer the existing single-family neighborhood to the north
from the existing commercial uses, change from SF-6 to C (Knipp) and SF-8.

Regarding: Supporting Regulations to the 2004 Comprehensive Plan Update (#CPZ-2004-1)
MOTION: I move to recommend/not recommend approval of the process for review of
implementing regulations for the 2004 Comprehensive Plan Update via a Resolution to be
considered by the City Council on June 15, 2004.
SUMMARY: Revisions to the City's Comprehensive Plan must be supported by development
regulations for consistency with the State Growth Management Act(GMA), as required by RCW
36.70A.130(1). Both the update to the Comprehensive Plan and the development regulations
• supporting the update must be in place by December 1, 2004 (RCW 36.70A.130[4]). The intent
here is to outline the process by which the City will proceed to ensure compliance with the
GMA.
BUDGET IMPACT: None
BACKGROUND: The 2004 Comprehensive Plan Update as proposed ensures compliance with
legislation that has been enacted since 1990. The City already has moved forward in regard to
compliance with State legislation and has created, or is in the process of creating appropriate
development regulations. The following is a list of regulatory actions that are in place:
• Critical Areas Regulations—Ordinance#3109 & #3312
• Downtown Design Review—Ordinance#3525
• Urban Separators—Ordinance#3551
• Agricultural Lands Amendment—Ordinance #3612
• Secure Community Transition Facilities—Ordinance#3615
• PUD Acre Amendment—Ordinance#3643
• Cluster Housing—Ordinance#3663
Planning Services is presently working on the following additional regulations:
• Critical Areas Ordinance Update—ZCA-2002-4
• Manufactured Homes—ZCA-2004-1
In addition to creating regulations, the City of Kent has produced or is in the process of
developing strategic plans to guide departmental efforts in their provision of community

• services. The following are strategic or operating plans that support the 2004 Comprehensive
Plan.
• The Downtown Strategic Action Plan(1998)
• Interim 2000 Comprehensive Park, Recreation and Community Services Plan(2000)
• 2003-2007 Consolidated Plan for Housing& Community Development(2002)
• Kent Economic Development Strategic Plan (2003)
Planning Services is presently working on updating the "Downtown Strategic Action Plan".
Workshops will be held in May and June, with an anticipated document by the end of 2004.
Public Works Transportation Division is working on a Comprehensive Transportation Plan
which will provide details on levels-of-service and non-motorized transportation, and possibly
will explore restructuring impact fees. Both future documents are essential to ensure compliance
with GMA.
PROCESS: Planning Services proposes to review the following portions of the City Code to
assess compliance with the GMA:
■ Title 12—Planning and Land Development;
■ Title 15 —Zoning; and
■ Title 11 —Environmental Management.
Appropriate workshops and hearings will be scheduled.
There are several tools provided by the State Office of Community Trade & Economic
Development (CTED) and the Puget Sound Regional Council (PSRC) to assist jurisdictions in
completing development regulations. CTED has a "Development Regulations Checklist" that
organizes all anticipated regulations intended to implement comprehensive plans. PSRC has
recently distributed a "Center Plan Checklist" that provides basic information on GMA
requirements, a checklist to ensure consistency with VISION 2020 and Destination 2030, and
center criteria that was adopted by the PSRC Executive Board in June 2003. The "Center Plan
Checklist" can be used for regional growth centers, activity centers, or subarea plans. Staff will
utilize these checklists to ensure our proposed implementing regulations are in compliance with
GMA.
Planning Services proposes to take a strategic approach to the development of regulations.
1. Regulations that are in direct conflict with the Comprehensive Plan will be reviewed and
updated prior to December 1, 2004. These include zoning map amendments.
2. Depending on the Council's position on urban densities staff may begin immediate
review of the urban density issue as a separate work program.
3. Other regulatory updates to fully implement the comprehensive plan goals &policies will
be proposed as future work programs.
