COMMITTEE MEMBERS PRESENT: Committee Chair Debbie Raplee and Committee Members
Ron Harmon and Les Thomas were present. The meeting was called to order at 4:10 p.m.
ITEM 1 – Approval of Minutes Dated August 03, 2009:
Committee Member Thomas moved to approve the minutes of August 03, 2009. The
motion was seconded by Harmon and passed 3-0.
ITEM 2 – “Best Workplace for Recycling and Waste Reduction” Designation:
Kelly Peterson, Conservation Supervisor stated that the City of Kent was recognized as a King
County “Best Workplace for Recycling and Waste Reduction”. The designation is reserved for
agencies participating in a minimum of 16 recycling activities listed on the application. The City
of Kent actively participates in 21 activities. He noted that the City of Kent is an avid promoter
of recycling and waste reduction in the community and that we sought the designation to let
our residents know that we are “walking the talk” by reducing costs and helping to extend the
life of our area’s last remaining landfill. Kelly introduced Christine Schmidt from Applus
Technologies. They are a provider of vehicle emission inspections for the State of Washington
and were also recipients of this prestigious designation. She was successful in reducing their
toner budget by $25,000. Councilmembers invited Christine to attend the Council meeting on
September 1, to accept the certificate.

ITEM 3 – Consultant Services Agreement/Solid Waste Recycling, Yard Waste & Food
Waste Contract Request for Proposals (RFP):
Kelly Peterson, Conservation Supervisor stated that the City is currently advertising a Request
for Proposals to serve as the City of Kent Solid Waste, Recycling and Yard & Food Waste
Collection contractor. The City and a selection committee consisting of citizens, business
representatives and community groups will utilize an array of consultants and services to
review proposals, facilitate the selection committee and make recommendations to the City
Council.
After a lengthy discussion, committee members agreed to approve the contract for $75,000.00.
This item will go to “Other Business” on the September 1, 2009 Council Agenda.
Harmon move to recommend Council authorize the Mayor to sign necessary
consultant agreements related to the Garbage, Recycling, Yard & Food Waste
Collection Disposal/Marketing if combined together do not exceed $75,000. Each
contract shall be reported to the Public Works Committee so the Committee knows
when they were approved. Upon concurrence of the language therein by the City
Attorney and Public Works Director. The motion was seconded by Thomas and passed
3-0.

ITEM 4 – South 259th Street Raising – Contract with GeoEngineers to Perform
Geotechnical Engineering Services for Levee Certification:
Environmental Engineering Manager, Mike Mactutis gave a short presentation explaining that
Geotechnical engineering services must be performed and stamped reports must be submitted
to FEMA in order to get Federal Certification of Levees. The City’s contract with GeoEngineers
will provide all of the necessary geotechnical studies and reports to meet the requirements for
levee certification for this project.
Thomas moved to recommend authorizing the Mayor to sign a contract with
GeoEngineers to perform geotechnical studies and produce stamped reports
necessary for levee certification for the South 259th Street Raising project, upon
concurrence of the language therein by the City Attorney and the Public Works
Director. The motion was seconded by Harmon and passed 3-0.
ITEM 5 – Citywide Commute Trip Reduction Implementation Agreement:
Commute Trip Reduction Program Coordinator, Monica Whitman summarized that this
agreement is between the Washington State Department of Transportation and the City of
Kent. The City is required by State Law to enforce the regulations specified in RCW 70.94.521.
The City is then reimbursed by the State for costs incurred based on a formula devised by the
State Department of Transportation, Public Transportation Office.
The purpose of this agreement is to allocate two years of funding for the 2009-2011 project
period. The grant pays for our efforts to enforce the state laws. There are currently 35
organizations participating in the program, representing more than 15,000 employees.
Harmon moved to recommend Council authorize the Mayor to sign the Commute Trip
Reduction Grant implemental Agreement #GCA6247, in the amount of $103,170.00,
upon concurrence of the language therein by the City Attorney and the Public Works
Director. The motion was seconded by Thomas and passed 3-0.
ITEM 6 – Information Only/Transit Update:
Commute Trip Reduction Program Coordinator, Monica Whitman went over the nine point action
plan that King County is proposing in regards to their budget action plan. Whitman will bring
this item back again at a later date.

Street Superintendent, Bill Thomas gave an informative PowerPoint presentation, sharing Street

ITEM 8 – Update/Operations 2009 2nd Quarter Status:
Operations Manager, Don Millett gave an informative PowerPoint presentation regarding Public
Work Operations 2009 Half-Year Report.

Item 9 –Local Purchasing Preference Ordinance:
City Attorney, Tom Brubaker passed out the draft ordinance and noted that Councilmember
Danielson had asked that an Ordinance be drafted in regards to procurement preference fo r
purchasing from or contracting with local businesses. Brubaker stated that the City of Kent
annually spends a lot of money on a lot of contracts and we should do what we can to include
local vendors to get a contract through the City.
After a brief discussion, committee members agreed to approve the Local Purchasing Preference
Ordinance and agreed that this item will go to “Other Business” on the September 1, 2009
Council Agenda.
Thomas moved to recommend Council adopt the proposed ordinance, in a form
substantially similar to that presented to the Committee, to add a new section
3.70.045 to the Kent City Code establishing a procurement preference for purchasing
from or contracting with local Kent businesses. The motion was seconded by Harmon
and passed 3-0.
Item 10 – Information Only/Puget Sound Strategic Freight Corridor Grant
Applications:
Deputy Public Works Director Tim LaPorte, stated that the Transportation Master Plan is largely
unfunded and that this is a once in a lifetime opportunity to take advantage of entering into a
joint partnership with other jurisdictions to share in grant money. He stated that we would like
to move ahead with the grant application in hopes that we would be a contender for $15 million
of that grant. LaPorte noted that the City would need to come up with an additional $5 million
if we are to move forward with the Willis Street Union Pacific Railroad Grade Separation project.
Committee members agreed that the grant application should be filled out. LaPorte will bring
this item back to committee with a recommendation on the over/under pass.

Motion:
Move to recommend Council authorize the Mayor to sign the Consultant Contract
Agreement with Landau Associates to provide geotechnical, environmental and
natural resources services for the 72nd Avenue South Extension Project funds will
be directed towards this project, upon concurrence of the language therein by the
City Attorney and the Public Works Director.
Summary:
72nd Avenue South exists from South 180th Street to South 196th Street and from South
200th Street to South 228th Street. The 72nd Avenue South Extension Project will complete
the missing link between South 196th Street and South 200th Street. The project will cross
Mill Creek and is located across the Western Processing Superfund Site (regulatory
oversight is administered by the U.S Environmental Protection Agency and the Washington
State Department of Ecology) and across the Bayside Automotive Property, aka the LIDCO
site (which is under an order from the Washington State Department of Ecology for remedial
action). Landau Associates has 26 years of experience as a consultant for the Western
Processing Trust and was also the City’s geotechnical consultant for the S outh 196th Street
project which also crossed Western Processing.
Based on Landau Associates experience and expertise, and given that the City does not
currently have the expertise to perform these tasks, Landau Associates was selected to
perform geotechnical, environmental and natural resources services for this project.

Subject: Downey Farmstead Restoration Project Agreement to Accept a
$100,000 Grant Award from King Conservation District WRIA 9 Forum
Summary:
The project site is located across the Green River from the Riverbend Golf Course driving
range and north of SR 516. Just downstream of the project is the mouth of Lower Mullen
Slough. This project is located on four parcels (21.81 acres) owned by the City of Kent but
located outside of city limits and in King County.
The overall project goal is to create floodplain storage and side channel refuge habitat for
salmon in the Green River. Very few areas along the Green River are available for this type
of restoration project which will benefit Chinook and other salmonids. The new channel will
be approximately 1200 feet long and will include fish habitat friendly features including large
woody debris and native riparian plantings.
On August 10, 2009 the City of Kent was awarded a $100,000 grant from the King
Conservation District KCD. Grant funds will be used for the demolition of existing structures
and foundations, site clearing, and removal of construction debris. The structures are part of
a former landscape nursery business operation known as Marco’s Landscape Nursery.
Pending review of the grant agreement language by the Public Works Director and by the
City Attorney, our request is for council to recommend the Mayor to accept the $100,000
grant to be used for the project or any adjusted amounts made as a result of modifications
by the KCD WRIA 9 Forum. Using these grant funds will progress the work on this important
salmon habitat restoration project.
Motion:
Move to recommend Council authorize the Mayor to sign the King Conservation
District (KCD) WRIA 9 Forum’s Agreement for the City to receive a $100,000 grant
award from KCD or any adjustments to this amount made as a result of
modifications by the KCD WRIA 9 Forum to be used for the city of Kent’s Downey
Farmstead Restoration Project upon concurrence of the language by the Public
Works Director and City Attorney.

Summary:
The project is located on City Park Department property known as Riverview Park which is
located along the Green River just south of Willis Street and west of SR 167. The site currently is
a passive use park. There are informal access points for fishing along the Green River and the
Green River trail runs along the east side of the site.
Through creation of a new off-channel habitat area, the project will provide summer rearing
habitat and high flow winter refuge for salmon along the Green River. The new channel will be
approximately 800 feet long and will include fish friendly habitat features such as large woody
debris, and native riparian plantings. The project provides much needed salmon habitat and
refuge in a key reach of the Green River and across the river mouth of Lower Mill Creek-Auburn.
On August 10, 2009 the City of Kent was awarded a $250,000 grant from the King Conservation
District KCD to complete the designs of the project. These grant funds from KCD will be used as
the City of Kent’s payment to the Army Corps of Engineers to finalize designs of the Riverview
Park Restoration Project.
Pending review of the grant agreement language by the Public Works Director and by the City
Attorney, our request is for council to recommend the Mayor to accept the $250,000 grant to be
used for the project or any adjustments to this amount made as a result of modifications by the
KCD WRIA 9 Forum. Using these grant funds to complete the designs is an important step to
furthering the completion of this critical salmon habitat restoration project.
Motion: Move to recommend Council authorize the Mayor to sign the King
Conservation District (KCD) WRIA 9 Forum’s Agreement for the City to receive a
$250,000 grant award from KCD or any adjustments to this amount made as a result
of modifications by the KCD WRIA 9 Forum to be used for the City of Kent’s

Summary:

On May 17, 2007 the City of Kent and the Army Corps of Engineers (Corps) entered into a
Design Agreement for the Riverview Park Restoration Project. The Design Agreement
stipulated the financial terms of the project’s design cost: 75% to be paid by the Corps, and
25% to be paid by the city of Kent. At that time, a payment of $112,800 was authorized to
pay for the city’s share of the designs for the project. To fund these design costs, the city
obtained a $150,000 grant award from the Salmon Recovery Funding Board (SRFB).
Most recently the Corps has provided an updated design cost which shows a higher estimate
to complete the designs than what was provided in 2007. The higher costs are from
additional design work as a result of comments received from the SRFB to design the
channel with more fish friendly habitat features. As such, on June 26, 2009, the Corps
requested additional payment from the city in the amount of $201,062 to complete the final
designs.
As a result of a grant application request by the city to King Conservation District (KCD), the
City of Kent was awarded a $250,000 grant on August 10, 2009 to complete the project
designs. These grant funds from KCD will be used as the City of Kent’s payment to the
Corps to finalize designs of the Riverview Park Restoration Project.
Payment to the Corps to complete the project designs will allow this important project to
progress towards construction. The Riverview Park Restoration project is a critical project for
salmon habitat restoration in the Green River.
Motion:
Move to recommend Council authorize the Mayor to make a payment to the Army
Corps of Engineers in the amount of $201,062 to complete the final designs for
the Riverview Park Restoration Project, upon concurrence of the language
therein but the Public Works Director and City Attorney.

Army Corps of Engineer’s Design Agreement and Budget Establishment
Summary:
The Upper Russell Road Levee project, also known as the Lakes Levee, is about one mile in
length and is located along the east bank of the Green River, north of James Street and
ending just south of the S 231st Street Bridge near Russell Woods Park. The project is a
separable element of the Army Corps of Engineers’ (Corps) Green /Duwamish Ecosystem
Restoration Project (GDERP) and is subject to a cost share program to fund the design and
construction of the project.
Under the Corps’ GDERP program, the City of Kent can choose to partner with the Corps to
complete the project. The main benefit in pursuing this partnership is the ability to share in
the design and construction cost of the project. For design, the City of Kent is obligated to
pay 25 percent of the design cost, while the Corps pays 75 percent. For construction cost,
the city of Kent pays 35 percent while the Corps pays the remaining balance of 65 percent.
To enter into this contractual relationship, a Design Agreement (DA) must be executed
between the City of Kent and the Corps. The DA stipulates the 25/75 percent cost share and
a payment to the Corps is required to complete the designs. For the Upper Russell Road
Levee project, the city’s share in the design costs is $200,000.
Signing the DA and making a payment to the Corps initiates the designs of the project. The
project will improve the levee’s safety by making the levee’s side slopes less steep and by
setting the levee back further away from the river.
Budget Impact:
The budget impact for this project is $200,000. If the city chooses to not enter into a DA
with the Corps and does not make payment to fund the designs, then funding the design and
construction to rebuild the Upper Russell Road Levee will be the city’s full responsibility.
Motion: Move to recommend Council authorize the Mayor to sign a Design
Agreement between the City of Kent and the US Army Corps of Engineers to initiate
the Upper Russell Road Levee (Lakes Levee) Ecosystem Project and establish a
budget for this project, upon concurrence of the language therein by the Public
Works Director and City Attorney.

Subject: Deferred Agreements to Public Improvements
Summary:
A concern of the City Council over the years has been the patchwork construction of
transportation improvements (curb, gutter, sidewalk, paving, drainage, signing, street
lighting, and landscaping). This patchwork effect is due to residential-commercial-industrial
development occurring at different times requiring the transportation improvements to be
transitioned each time a new development is approved adjacent to a street in Kent.
Streets identified on the attached Exhibit “A”-Listing of Unimproved Streets in Kent, and
Exhibit “B”-Map of Unimproved Streets in Kent will be over the course of the next few years
be the subject of proposed development projects that will increase this patch-work effect. To
help reduce the impact of the proliferation of a patch-work street system by requiring
transportation improvements on each development or project adjacent to undeveloped
streets in Kent staff proposes the following be done:
1) Approve Exhibit “A” and Exhibit “B” attached to this document as streets eligible
for No Protest Agreements to the Formation of a Local Improvement District.
2) Utilize a Standard Form for securing the No Protest Agreement for Formation of a
Local Improvement District with the understanding that in the event the property
on which the transportation improvements are required that those improvements
are secured in the manner provided for in Chapter 06.20. See Exhibit “C”.
There is an understanding that in some cases property owners may not be aware of these
conditions if they have not thoroughly reviewed the title report for the property in question,
but the City will make every effort to secure these conditions.
Motion: Move to authorize the inclusion of the following streets to the List of
Street Improvement Projects making them eligible for Grant Funding and other
Public Funding opportunities. Also, provide for the use of No Protest Agreements
to the Formation of Local Improvement for Projects or Developments occurring
along or adjacent to the streets identified herein.
