West, Jr. , Attorney Staff Present Charlene Anderson Jim Harris Kathy McClung Fred Satterstrom Dan Stroh REGULATORY REVIEW REQUEST - EXPAND USES PERMITTED IN THE PROFESSIONAL AND OFFICE (0) ZONING DISTRICT Dan Stroh presented staff's position on a Regulatory Review Request by Bill and Sharon Goodwin to designate limited commercial or retail uses as principally permitted uses in the Professional and Office zoning district. Dan stated staff could support two modifications to the Professional and office zoning district: designate business and professional services as a principal use and designate personal services as a conditional use subject to being part of a planned development at least 50% occupied by office uses. It is staff s position that through the conditional use permit process, the higher- density personal service uses could be reviewed on a case-by-case basis to ensure that the character of the "O'" zoning district is maintained. Bob West, Attorney for Bill and Sharon Goodwin, stated the request was not necessarily for an across-the-board zoning code change but the changes requested could perhaps be applied at specified locations. Attorney West questioned whether some of the Personal Services and Business Services defined by the zoning code are higher-density uses than some of the uses presently permitted in the 110" zoning district, e.g. , barber and beauty shops versus banks, which are allowed. It was clarified that Bill and Sharon Goodwin could apply for a Conditional Use Permit to allow 50% retail uses within their office building, considered as a complete unit; each retail operation desiring to locate within the building need not then apply separately for a Conditional Use Permit. Jim Harris clarified for Councilman Dowell that the Goodwin's Conditional Use Permit application of 2-1/2 years ago which was denied by the Hearing Examiner at that time could no longer be reconsidered; a new application would be required and would consider facts as they exist today. Further, Planning Director r CITY COUNCIL PLANNING COMMITTEE MINUTES OF 7-9-87 MEETING PAGE TWO discretion is interpreted conservatively to allow for uses similar in character to those uses specifically described in the zoning code; discretion would not be used to allow code changes. The committee referred this Regulatory Review Request to the Planning Commission and encouraged minor or major modifications to the principal and conditional uses of the "O" zoning district. Attorney West suggested that the Planning Commission consider carefully the uses listed in each classification in the zoning code so as not to indiscriminately exclude some uses. MULTIFAMILY REDUCTION INTERIM REPORT Dan Stroh distributed the Report on Multifamily Density which provides narrative, graphs and tables detailing the study of multifamily-zoned lands in the City of Kent. Listed in the report are six options for attaining an average density reduction of 20% on all undeveloped multifamily-zoned lands in Kent as outlined in City Council Resolution No. 1123 . Fred Satterstrom stated he is seeking a determination from the City Attorney on the legal issues related to options for reducing density at The Lakes development. Dan Stroh clarified for Chairwoman Woods that Option "D" relating to newly-annexed lands would not effect a reduction in density on lands presently zoned multifamily; however, by not limiting density in newly-annexed areas, the multifamily density within the city would be exacerbated. Councilman Biteman commended Dan Stroh for his work on the report and stated he would like to have a comparison of Kent with other cities in terms of percentage of multifamily versus single family. ' Councilman Biteman added there was a recent newspaper article concerning another municipality's 17% multifamily reduction success and he would like details of that accomplishment. Councilman Dowell would like a determination from the City Attorney on the legal issues surrounding the density reduction options. Councilman Biteman questioned whether implementation of the density reduction options would encourage single- family development or simply stop development entirely.
