April 17, 1986
The regular meeting was called to order by Chairman T. Ric ;acrd tRied. In
attendance: Commissioners Michelle G. Hinz and Joseph A. 5 ; t, Chief
Frederiksen, Assistant Chief LaBore, Captain Byerly, and Battalion Chief
Bond. Also Present: Tom Shephard and R. Kevin Kearns.
Chairman welcomed Chief Frederiksen to his first Commission Meeting.
Mr. Street moved and Ms. Hinz seconded to approve the minutes of the meeting
of March 20, 1986. Motion carried.
Mr. DiJulio reported on the Towne case. The orders of disiissal have been
entered, the officers have received their checks, and the gate is closed.
Assistant Chief LaBore invited the Commission to the firefighter graduation
exercises at Kentwood Senior H,igh, School on Friday, April 25, at 7:30 p.m.
Chief Frederiksen reported that the department is in the,proces,�s of
reorganization, and he may have a presentation of proposalis''an ranks of
personnel for the Correctional Facility at the next meetln4':'4
The letter dated March 20, 1986 from Tom W. Smith of the,4.k T.C. granting
permission to R. Kevin Kearns to take the examination fvrTirefighter First
Class was read. Firefighter Kearns' letter of request was tabled at the March
meeting pending receipt of J.A.T.C. approval . Ms. Hinz mbd to approve the
exam. Mr. Street seconded, and the motion carried.
On the issue of the proposed revision of Rule XVI, Section' 4, Mr. DiJulio
explained that the current rule is not clear as to benefits :such as seniority
to a returning resigned employee. He clarified for Mr. Street that the
probationary period for a returning employee is at the di�critjon of the
Chief. As to the Union's proposal , he noted that the Union ;has included the
probationary period but also includes "seniority from the,"4ate of original
hire, less the period of resignation." Should the Chief' ' ine that the
person is not to be reinstated, the person could go befot*,,,, the Commission to
be placed on the eligibility list.
To better clarify Rule XVI, Section 4.1.1 , it was proposed to add as follows:
With the approval of the Chief, upon such conditions as determined by the
Chief, "such conditions may include" but not limited to a probationary period,
and upon consent of the Commission 'such employee may be reinstated in the
position resigned from, if vacant, or if a vacant position is the same or
comparable class, "including seniority from the date of original hire, less
the period of resignation." Chairman referred to the phs,ke, 1 "period of
resignation." It was corrected to "period of absence fo'i" Wing resignation."
Mr. Street moved to approve the amended revision of Rule XVI, Section 4, with
the changes in 4.1.1. inserting "such conditions may incl de" and "including
seniority from the date of original hire, less the period of absence following
resignation." Ms. Hinz seconded, and the motion carried.

The correspondence from Andrew Speier.requesting placement on the eligibility
list and reinstatement to the firefighter position he left, if vacant, was
accepted into the records. Mr. DiJulio explained that Mr. Speier has the
right to be placed on the eligibility list following return from resignation
under either the old rule or the proposed rule and under Rule XI an employee
"returning from resignation pursuant to Rule XVI, Section 4, shall be given
preference over original applicants in inverse or order to layoff."
Mr. Street moved to approve Andrew SpMer's placement on the eligibility list
for firefighter. Ms. Hinz seconded, and motion carried.
To clarify further, Mr. DiJulio stated that were an individual to be hired by
the Chief under Section 4.1 .1 , returning from resignation, the person retains
seniority from the date of hire less the period of absence during
resignation. If the Chief appoints Firefighter Speier from the eligibility
list pursuant to Section 4.1 .2, there is no seniority attached to his hire.
This is not a change of rules. Mr. Ried questioned that if a vacancy occurs
even if he is on the eligibility list, the Chief has the option to take him
off the list and reinstate him, and W, DiJulio acknowledged that is correct.
The memo of March 26, 1986 from Assistint Chief LaBore was read. It told of
the promotion of Jeffrey Barsness to Firefighter First Class, effective
March 1 , 1986. Mr. Street moved, MS.. Hinz seconded, to accept the memo into
the record. Motion carried.
The letter of April 14, 1986 from Patrick Ohern requesting early testing for
First Class Firefighter was read. Included with the letter was a certificate
showing 990 clock hours. Also read was a letter from Tom W. Smith, J.A.T.C.
secretary, stating Firefighter Barsn6" has completed his J.A.T.C.
requirements and is eligible to take Oe First Class exam pending his
practical exam which is to be taken vtr April 17, 1986. Ms. Hinz moved to
approve the early testing of Jeffrey Sarsness pending successful completion of
his J.A.T.C. requirement. Mr. Street ileconded, and motion carried.
The next meeting will be held on May 1 , 1986 at 8:00 a.m. in the Council
Chambers.
Mr. Street moved to adjourn the meeting, and Ms. Hinz seconded. Meeting
adjourned at 8:30 a.m.
