The Kent Planning Commission meeting was called to order by Chairman Stoner at
7:30 p.m. on Tuesday, June 26, 1984, in the City Council Chambers.

APPROVAL OF PLANNING COMMISSION MINUTES

PUBLIC HEARING TO AMEND SECTION 2.3.2
PRELIMINARY PLAT PROCEDURES, PARAGRAPH Ms. Ball presented the proposal to

Plat Procedures, Paragraph 8, Ex-
piration Date, of the City of Kent Subdivision Code to allow for an extension
of time for filing of the final plat beyond the current one-year time extension.
A 1983 amendment to the State Subdivision Code allowed any city, town or county
to adopt procedures to allow for additional time extension for final plats beyond
the one-year extension provided for by state law.
Section 2.3.2, Paragraph 8, of the Kent Subdivision Code currently reads as
follows:
Expiration Date. Preliminary Plat approval shall lapse three (3)
years from the date of approval unless a final plat based on the
preliminary plat, or any phase thereof, is submitted within three (3)
years from the date of preliminary plat approval . One one-year
extension shall be granted to an applicant who files a written re-
quest with the City Council and Planning Department at least thirty
(30) days before the expiration of this three-year period, if the
applicant can show that he has attempted in good faith to submit
• the final plat within the three-year period.

In the case of a phased subdivision, final plat approval by the
City Council of any phase of the preliminary plat will constitute
an automatic one (1 ) year extension for the filing of the next phase
of the subdivision.
The Planning Department proposes the following amendment:
Expiration Date. Preliminary Plat approval shall lapse three (3)
years from the date of approval unless a final plat based on the
preliminary plat, or any phase thereof, is submitted within three
(3) years from the date of preliminary plat approval . One one-
year extension shall be granted to an applicant who files a written
request with the City Council and Planning Department at least thirty
(30) days before the expiration of this three-year period, if the
applicant can show that he has attempted in good faith to submit
the final plat within the three-year period.
Additional time extensions beyond this one-year time period may be
granted by the City Council if the applicant can show unusual circum-
stances or situations which make it impossible to file the final plat
within the four-year time period. The applicant must file a written
request with the Cit Council and Planning Department for this addi-
tional time extension; this request must be filed at least thirty 30)
days prior to the plat expiration date. The request must include
• documentation as to the need for the additional time period. Additional
time extensions shall be granted in not greater than one 1 year in-
crements.
In the case of a phased, subdivision final plat approval by the City
Council of any phase of the preliminary plat will constitute an
automatic one (1 ) year extension for the filing of the next phase
of the subdivision.
Ms. Rudy asked what would happen if an applicant requested an extension but
had not done anything up to that point about the situation.
Ms. Ball responded that the situation would be reviewed by the Planning staff,
and that the applicant would have to substantiate the fact that work had been
done on the situation.
Mr. Harris pointed out that this amendment would give the applicant extra time
when extenuating circumstances had made it impossible for the applicant to
pursue a building program, i .e, depressed economic times, pending L. I . D. , etc.
Ms. Ball emphasized that this amendment would not set a time limit, but the
applicant would be able to request for an extension each year, and this ex-
tension would be reviewed yearly.
Mr. Ward asked for examples of unusual circumstances in which an applicant
would not be able to file the final plat for a four or five year period.

Ms. Ball felt that an L. I . D. project, street project or utility extension
would be examples of situations.
Mr. Ward remarked that it would be some situations beyond their control , such
as a death in a partnership.
Commissioner Cullen MOVED and Commissioner Lambert SECONDED the MOTION that the
Planning Commission amend Section 2.3.2 of the Kent Subdivision Code as presented
by the Planning Department. MOTION approved unanimously.
