HomeMy WebLinkAboutCity Council Committees - Planning and Economic Development Committee - 06/17/1986 R- • KENT PLANNING COMMISSION MINUTES June 17, 1986 The meeting of the Kent Planning Commission was called to order by Chairman Ward at 7:30 p.m. on Tuesday, June 17, 1986, in the Council Chambers. COMMISSION MEMBERS PRESENT: Raymond Ward, Chairman Robert Anderson Robert Badger Richard Foslin Linda Martinez Jill Spier COMMISSION MEMBERS ABSENT: James Byrne, absent Chuck Lambert, excused Nancy Rudy, absent PLANNING STAFF MEMBERS PRESENT: James P. Harris, Planning Director Fred Satterstrom, Project Planner Bruce Creager, Associate Planner Ed Heiser, Assistant Planner Lois Ricketts, Recording Secretary APPROVAL OF PLANNING COMMISSION Commissioner Spier and Ms. Pam MINUTES FOR MAY 20, 1986 Stephens asked to have their names corrected. Commissioner Spier MOVED and Commissioner Foslin SECONDED a motion to approve the minutes as amended. Motion carried. Mr. Harris announced that the Planning Committee would meet on Thursday, June 19, at 3 p.m. Neither Chairman Ward nor Commissioner Spier would be able to attend this meeting, but Fred Satterstrom would represent them. HOME OCCUPATIONS CONTINUED This hearing was continued from May 20, 1986, public hearing. Mr. Harris presented the following list of actions, alternatives and conditions in response to the Commission 's request. He felt that these could be reviewed singly or in combination. 1 . Establish a review procedure for the regulation of complaints resulting • from the operation of Home Occupations. (He felt there was a system that was already in operation. ) 1 Kent Planning Commission Minutes June 17, 1986 2. Permit the sale of goods and/or services at the residence only if at least two additional on-site parking stalls can be provided. (He felt this one could be omitted. ) 3. Permit the retail sale of only those goods produced or fabricated on the site. (He felt this was a possibility. ) 4. Permit the sale of goods or services on site but limit to one customer at a time and restrict to appointment only. (He felt this was a very viable solution. ) 5. Require a Conditional Use Permit for any business which requires the transfer of goods or services directly to the consumer at the residence. (He felt this was too complicated for what it was trying to solve. ) 6. Limit the hours of operation for any Home Occupation directly serving the consumer at the residence. (He felt this was a valid point. ) 7. Insure the ability of the City to inspect all Home Occupations. 8. Insure that all Home Occupations are in compliance with any and all other codes, ordinances, laws or regulations applicable. 9. No outside or nonresident employees shall be permitted. (He added that • perhaps no more than one outside employee should be permitted. ) 10. Advertising signs shall not be permitted on the premises. (He commented that none are permitted currently. Political and real estate signs are put up only temporarily. ) Commissioner Badger asked, regarding number 1 , if there were a minimum amount of complaints that must be received before any review procedure is initiated. Mr. Harris responded that, under the present code violation review, as soon as the Planning Department receives a phone call or an inquiry, a file is started. This would fit in with the overall zoning violation category which already has procedures. He felt that no special procedures were needed. Commissioner Badger wondered if the complaints would be registered because of traffic problems, visual problems, noise problems or signs as a result of home occupations. Commmissioner Badger pointed out that if a person runs a computer business off his telephone line in the basement of his home, he could make a sizeable income and not affect the outside of the house. He felt that dollar volume of business was not a concern. The City would be concerned about the feeling of the neighbor- hood and the impact it would have on the surrounding area. Mr. Harris pointed out that the sale of goods or services was the issue. • Commissioner Anderson, regarding number 8, wondered if physical things, such as the proper number of exits and stairs wide enough to meet the code, should -2- r . Kent Planning Commission Minutes June 17, 1986 • be discussed. If the electrical wiring were changed, would a state electrical inspector check the changes that were made. Mr. Harris responded that any changes in structure or electrical wiring would be inspected by the proper authorities. Commissioner Spier felt that 8 p.m. was too early for the summer months. She felt that 9 p.m. was a more reasonable hour. She had trouble with the concept of limiting hours. Mr. Harris felt that the neighbors would not want customers arriving at 12 mid- night or 6 in the morning, either summer or winter. He suggested the use of regular working hours. The computer in the basement would not be bothering the neighborhood, but customers driving up to the house could make a difference. Chairman Ward suggested that the hours of service be limited to customers coming to the home. Mr. Harris pointed out that there would be two different kinds of home occupa- tions--the accountant or computer person who never sees a customer, and the home occupation which has customers or clients coming to the home. • Commissioner Foslin asked about number 4, the sale of goods and services. If we say yes, are we opening up the door to any sort of sale. What if someone buys a few cars, takes them home and puts them out in his front yard for sale. Mr. Harris responded that all home occupations must be in compliance with other codes or ordinances. A resident can repair his car at his home, but repairing the car of his friend becomes a problem. He felt that if a difficulty arises, the Commission could meet again and see if an adjustment could be made. Ms. Martinez MOVED that Section 15.08.040 D3 be amended to limit the sale of goods or services to one customer at a time, by appointment, and only between the hours of 7 a.m. and 9 p.m. Ms. Spier SECONDED the motion. Motion carried unanimously. ADJOURNMENT Commissioner Badger MOVED to close the meeting. Commissioner Foslin SECONDED the motion. Motion carried.
