The following information will be discussed: Memo dated July 30th, 1990 from Chief Fronsdahl requesting permission to begin the testing process for Probationary Firefighter. (ACTION ITEM FOR DISCUSSION) Also on the same memo a request to adopt a new Medical Standard entitled "Minimum Medical Standards for Firefighters in Washington Cities and Fire districts - Large Cities and Fire Districts" to be used during the hiring process for Is future Firefighter candidates. IT IS PUBLISHED JOINTLY BY THE ASSOCIATION OF WASHINGTON CITIES AND THE WASHINGTON STATE ASSOCIATION OF FIRE CHIEFS. THIS NEW STANDARD HAS BEEN DEVELOPED AFTER YEARS OF STUDYING THE PHYSICAL DEMANDS AND LEVELS OF STRENUOUSNESS PLACED ON FIREFIGHTERS. WE ARE PREPARING TO PROCEED WITH A REQUEST FOR PROPOSAL PROCESS TO DETERMINE WHO WILL BE CONDUCTING OUR MEDICAL PHYSICALS FOR THE NEXT THREE YEARS, SO OUR PROPOSED ACTION IS TIMELY. WE DO THIS EVERY YEAR SO THAT WE HAVE AN ACTIVE LIST THROUGHOUT THE YEAR AND THAT LIST WOULD RUN OUT JUST AS WE ARE ESTABLISHING A NEW LIST. IN REVIEWING THE MAY MINUTES OF THE CIVIL SERVICE COMMISSION, I DO NOT SEE THAT ITEM COVERED. THIS BEING THE CASE, I WOULD LIKE TO ASK THE BOARD TO EXTEND THE LIST RETRO-ACTIVE TO JUNE 20 TO EXTEND 14SL DECEMBER 20TH AT WHICH TIME WE WILL BE CERTIFYING A NEW LIST. APPLICABLE RULE: CIVIL SERVICE RULE XI RELATES TO ELIDGIBLE LISTS (AND PROMOTIONAL LISTS) . ` SECTION THREE OF THAT RULE IS ENTITLED " EFFECTIVE LIFE OF LISTS" AND PROVIDES AS FOLOWS: " 2 . 2 . ENTRY. ELIGIBLE LISTS AT THE ENTRY LEVEL SHALL REMAIN IN EFFECT SIX (6) MONTHS, AND MAY BE EXTENDED BY ACTION OF THE COMMISSION FOR UP TO AN ADDITIONAL SIX (6) MONTHS. NO ELIGIBLE LISTS SHALL BE IN EFFECT FOR MORE THAN A TOTAL OF TWELVE (12) MONTHS. " ASSIS: THE RULE IS SILIENT ON THE ISSUE OF RETROACTIVITY. IT DOES NOT PREVENT RETROACTIVE EXTENSION. THE RULE DOES GIVE THE COMMISSION AUTHORITY TO EXTEND THE LISTS FOR UP TO AN ADDITIONAL SIX MONTHS. THE ONLY LIMIT ON THE COMISSION AUTHORITY TO EXTEND THE LISTS, IS THE PROHIBITION AGAINST A LIST BEING IN EFFECT FOR MORE THAN TWELVE MONTHS. ACCORDINGLY, SINCE RETROACTIVITY IS NOT SPECIFICALLY PROHIBITED, THE COMMISSION HAS THE AUTHORITY TO EXTEND THE LIST REYTROACTIVELY WITHIN THE SCOPE OF THE RULES. HOWEVER, THE COMMISSION CANNOT EXTEND THE LIST BEYOND THE DATE WHICH IS TWELVE MONTHS FROM THE DATE THE LIST FIRST BECAME EFFECTIVE . EXAMPLE: IF THE LIST WAS EFFECTIVE JANUARY 1, 1990 AND EXPIRED JULY 1, 1990-- THE COMMISION COULD EXTEND ONLY THROUGH THE DATE OF JANUARY 1, 1991, IRREGARDLESS OF WHEN THEY ACTED TO EXTEND.
