Cline, Lt. Shepard, Captain C.E. Miller, Guild President, Officer John Pagel, Sue Viseth, Human Resources Director, Captain Jim Miller, Guild Representative Dave Santos, Detective Kathy Holt, others present. Chair Pattison called the meeting to order at 8:11 a.m. I. COMMISSION BUSINESS: 1. Chair Pattison moved to approve and accept into record the updated Civil Service Secretary & Chief Examiners Position Description. Seconded and carried. 2. Chair Pattison moved to approve and accept into record the memo dated September 8, 1995 from Sue Viseth, Human Resources Director to the Commission. Seconded and carried. II. HEARINGS • III. OLD BUSINESS A. Accept into Record 1. Chair Pattison moved to approve and accept into record the minutes from the September 21, 1995 Civil Service Commission Meeting. Seconded and carried. B. Action items for Discussion 1. Chair Pattison opened for discussion clarification regarding the extension of the Word Processing Technician/Transcriptionist. Eligibility List. Lt. Shepard of the Firefighters Union stated that the motion to extend the list was to be given immediately and then it was found out that the list could not be extended. He recommended that the motion be cleaned up to reflect what actually happened. City Attorney Lubovich: 'The resolution was passed at the last meeting to make a rule change to allow for extensions and then ruled subsequent to that to extend the Word Processing List. The Rules require a thirty day change before they become effective. This slipped by me and so the Rules Change was not effective immediately as we had thought. The Resolution that was drafted does say thirty days before it is effective. So the motion did not have any effect on the Word Processing List. Maybe there could be a point of clarification that is approved by the Commission to make note of that. The point is that the List did not get extended. The Rule is still in effect...it was adopted • effective thirty days subsequent." • Page 2 October 24, 1995 Civil Service Special Meeting Chair Pattison: "I see on the Agenda that the last item is a request to begin the process for the Word Processing Technician. So in essence we will be making that motion again just so we're sure that we're legal." C/A: "I'm not sure if Lt. Shepard wanted me to do it by formal action to clarify." Lt. Shepard: "Just to clarify in the minutes or something so that there is no question later on... C/A Lubovich: If the Commission agrees with my clarification or if you want to move to recognize that as part of the official action." Chair Pattison: "We'll make our intent clear on the motion, what our thinking is." The Examiner asked that the process be clarified regarding resolutions for Rule changes. She stated that previously the City Attorneys office had prepared a rough draft which was sent out to each Department, the Unions and also to the Fire and Police Chief for their input and any changes, additions or deletion before it was brought before the Commission. This process was circumvented at the last meeting and the Fire Department did not get an opportunity to give their input. She asked for a process to be • put in place to avoid any further confusion. C/A Lubovich: "Actually that is an administrative rule. If you want,just make sure that notice gets out unless there is an emergency circumstance. That is typically the history is to submit Rule Change so that there is enough input. That could be ordered as an administrative rule." Chair Pattison: "So ordered." Examiner: "Normally it is submitted at a Civil Service Meeting we normally ask for all input back to either the City Attorneys office or my office in time for the next meeting." IV. NEW BUSINESS A. Approval and Accept into Record C/A Lubovich clarified for the record items 1 and 2. He recommended that the Commission not act as an approval because the items could be appealed before the Commission. If it was approved by the Commission and an appeal was made, as the Commission would already have acted on it they could not hear the appeal. He recommended that the Commission just accept the two items into record as letters at this time and not act as an approval by the Commission. Moved by Commissioner Banister and seconded by Chair Pattison. Carried. • 1. Chair Pattison moved to accept into record the letter of reprimand dated September 29, 1995 to Corrections Officer Michael D. Armstrong from Captain Charles E. Miller. Chair Pattison moved to accept into record the letter of reprimand dated October 2, 1995 to Corrections Officer Bernard Jenkins from Corrections Lieutenant Lutz. Seconded and carried. 3. Chair Pattison moved to approve and accept into record the letter dated October 5, 1995 from Chief Crawford to Entry Level Corrections Officer candidate John D. Cagle confirming his employment effective October 16, 1995. Seconded and carried. 4. Chair Pattison moved to approve and accept into record the letter dated October 5, 1995 from Chief Crawford to Entry Level Corrections Officer candidate Joel D. Langsea confirming his employment effective October 16, 1995. Seconded and carried. 5. Chair Pattison moved to approve and accept into record the letter dated October 12, 1995 from Chief Crawford to Barbara E. Thomas notifying her that she has successfully passed her probation effective September 1, 1995. Seconded and carried. V. Action Items for Discussion 1. Chair Pattison opened for discussion the memo dated September 29, 1995 from Lt. Cline requesting the removal of Entry Level Police Officer candidate David Toney from the Entry Level Police Officer Eligibility List due to his failure of the background portion of the selection process. Chair Pattison noted for the record that the Commission had before them the file of Mr. Toney. Lt. Cline stated that he would let the file stand at this point and if the Commission had any specific questions he would be glad to answer them. Chair Pattison moved to remove Mr. Toney from the Entry Level Police Officer List. Seconded and carried. 2. Chair Pattison opened for discussion the memo dated October 10, 1995 from Lt. Cline requesting permission to begin the selection process for a Word Processing Technician/Transcriptionist. Lt. Cline stated that the Department is in need of a new list as the current Word Processing List has now expired. They wish to hire someone in early 1996. Commissioner Banister moved to give approval to begin the selection process for the Word Processing Technician/Transcriptionist. Seconded and carried. Chair Pattison asked if there was any additional business. Captain C.E. Miller of the Police Department: " advised the Commission that the Police . Department would be making a proposal at the next meeting for a possible Rule change to assist them in complying with a Federal decision involving the searching of inmates. There is a Federal decision which prohibits males from searching females but does not work the other way. I need t, • Page 4 October 24, 1995 Civil Service Special Meeting to be able to address the issue of being able to hire more female Corrections Officers even though they may not be at the top of the list. We will be presenting this to you at the next meeting." Chair Pattison asked for material to be sent to the Commission prior to the meeting so that the Commissioners could read up on it before discussing it. Captain CE Miller handed the Commission some paperwork at that time. C/A Lubovich: "I can give you a brief of what it is. The idea is to allow for a Rule Change to allow special needs. Basically a sub list our of a list. The department calls up for a special needs like Female Corrections Officers because of the Federal Law. Either the secretary or the Commission certify those that qualify under that need. In other words they would take the top three female applicants on the list and certify it and submit it for a selection. The Rule change is basically not limited to just females, but for special needs when something comes up there is a special need. I would recommend that the Commission be the one to certify the list rather than the Secretary. This way there could be input whether or not that is a need ornot at that time. The wording in the paperwork states secretary but Steve DiJulio states that it could be the Commission and I would recommend by the Commission. It creates a new certification from an existing list for special needs once it is determined by the Commission." • Chair Pattison: "So this will be on our next Agenda? Catherine, make sure that Callius gets a copy of this paperwork. There being no further business to come before the Commission 1 move that we adjourn. Those in favor of adoption say aye." Chair Pattison & Commissioner Banister. "Aye". Chair Pattison: "Motion Carries, thank you." The next Regular Meeting will be held on Thursday, November 16, 1995 at 8:00 a.m. in Council Chambers West.
