SUBJECT: VEHICLE SAFETY REVIEW BOARD (BURKE)
ON 11-3-93 THE VSRB MET AND REVIEWED 93-6562 . THIS IS AN ACCIDENT
INVOLVING LT. BURKE AND SHANNAN HAMMINGTON.
"REPORT OF FINDINGS"
1 . THE INVESTIGATION AND REPORTS WERE COMPLETE AND SUFFICIENT TO
PERMIT A FINDING. I DID CONTACT ONE WITNESS (STARKSON) WHO
VERIFIED THE FACTS AS REPORTED .
2 . POLICY K-03 ON SAFETY OF OPERATION AND CITY CODE 9 .36 . 020 WERE
REVIEWED. THE CITY CODE IS INATTENTIVE DRIVING. THE POLICY IS
GENERAL AND NOT SPECIFICALLY VIOLATED. INATTENTIVE DRIVING SEEMS
TO BE THE APPROPRIATE STATUTE TO REVIEW FOR THIS CASE AND APPEARS
• TO HAVE BEEN VIOLATED AND WOULD HAVE BEEN CITED HAD A CITATION BEEN
ISSUED.
3 . LT. BURKE WAS DRIVING VEH #11 IN AN OFFICIAL 'CAPACITY. THE
VEHICLE SUSTAINED ABOUT $500 DAMAGE TO THE FRONT END. THE
HAMMINGTON VEHICLE SUSTAINED $1000 DAMAGE TO THE LEFT REAR. NO
INJURIES TO BURKE. HAMMINGTON WAS TRANSPORTED VIA AMBULANCE FOR
NECK INJURIES .
NO WITNESS APPEARED AND NO ADDITIONAL WRITTEN STATEMENTS WERE GIVEN
FOR THE BOARD TO CONSIDER_ PRIOR NOTICE WAS GIVEN VIA E-MAIL. THE
FACTS ARE AS FOLLOWS . HAMMINGTON TURNED RIGHT ON RED AFTER
STOPPING. HE THEN STOPPED FOR A TRUCK TURNING INTO THE 7-11 LOT.
BURKE, WITH A GREEN LIGHT, TURNED RIGHT AND COLLIDED WITH THE REAR
OF HAMMINGTONS VEHICLE . OFFICER DURHAM STATES IN HIS REPORT THAT
SOME SHRUBS MAY HAVE OBSTRUCTED VISION.
4 . THIS IS CLASSIFIED AS AN ACCIDENT.
5 . THIS IS CLASSIFIED AS PREVENTABLE. EVEN WITH THE GREEN LIGHT
LT. BURKE WAS REQUIRED TO PROCEED WITH CAUTION AND WAS REQUIRED TO
STOP FOR OTHER TRAFFIC STOPPED ON THE ROADWAY AHEAD OF HIM. HE WAS
INATTENTIVE AND HAD A CITATION BEEN ISSUED THE BOARD BELIEVES HE
WOULD HAVE BEEN CITED FOR THE VIOLATION.
6 . SANCTIONS RECOMMENDED ARE DEPENDANT ON PREVIOUS HISTORY. BASED
ON THE HISTORY THE BOARD WOULD RECOMMEND ORAL INTERVIEW WITH
WARNING, OR WRITTEN REPRIMAND. THIS DECISION SHOULD BE MADE AFTER
A REVIEW OF PREVIOUS RECORDED DRIVING / PERFORMANCE PROBLEMS .
