J. M. MILLER VIA: LT. D. A. EVERETT AND SGT. B. R. JONES RE: POLICE ON-DUTY ACCIDENT, CR92-06459 On 07-31-92/Friday, at about 1802 hours, I responded to an OFFICER-INVOLVED MOTOR VEHICLE ACCIDENT at James and Washington Street. Upon arrival, I observed damage to two (2) vehicles. Vehicle #2 , a 1986 HONDA, was registered to Joju MICHEL. The damage appeared extensive and Kent Fire Department Personnel were evaluating at least two people at the scene. I requested Officer P. J. LOWERY, the Patrol Supervisor, and an additional Patrol Unit to respond to assist with the investigation. . Officer LOWERY photographed vehicle damages, evidence located on the roadway, vehicle positions, and marked roadway evidence for scene measurements. I identified and interviewed six (6) witnesses, both drivers, and one (1) passenger from vehicle #2 . I also assisted Officer Lowery with the measurements. Per witness statements and statements from both drivers, vehicle #1, (KPD Unit #352 , operated by Officer S. C. McVICAR) , was in the southbound outside lane, at N. Washington/W. James, and stopped for a red light. Vehicle #2, (1986 Honda) , was eastbound, in the outside lane, on W. James/N. Washington. Per Officer McVicar, he observed a traffic infractions committed by a vehicle executing a left turn from James onto Washington. Officer McVicar states he checked traffic coming eastbound on W. James Street and thought there were no vehicles whose right-a-way he would violate although he entered on a red light for southbound traffic. Officer McVicar also noted the sun was at an angle which somewhat inhibited his view of oncoming traffic. As Officer McVicar entered the intersection, he became aware of Vehicle. #2 , but was unable to avoid a collision. • Page 1 of 2 • a Y POLICY K-21 STATEMENT August 10, 1992 Mr. Michel stated the light for eastbound traffic was green as he entered the intersection. He said he was unaware of the Police vehicle until the time of impact. Statements from witnesses confirm the basic positions and movements of Vehicle #1 and Vehicle #2 . There were inconsistencies regarding whether the Police vehicle's emergency lights were activated before, upon, or after impact. Witness Joseph O'DELL, states he spoke with a blind pedestrian who said he heard a siren, then a collision. I was unable to identify or locate this person for statement verification. All other witnesses stated they heard no siren prior to the collision taking place. Refer to Case Report 92-06459 for further details of the investigation.
