MINUTES
April 20, 1989

The meeting was called to order at 8: 03 a.m. by Chairman Jarvis.
REPORTS
Personnel Director, Mike Webby - absent
Police Chief, Rod Frederiksen - absent
Fire Chief, Norm Angelo - commented on the recent fire in
Auburn; the Kent Fire Department made a significant
contribution during the 56 hours involved in fighting
this fire; it was noted that no injuries were incurred,
a great accomplishment in itself; he also expressed
his pride in the Department and recent training. The
Commission agreed with recognizing this outstanding
accomplishment.
OLD BUSINESS
Chairman Jarvis entertained a motion to approve the
minutes of the March 16, 1989 meeting. Motion was made
by Mr. Dreblow, seconded by Mr. Thornton.
Motion carried.
NEW BUSINESS
Chairman Jarvis entertained a motion to extend the
Eligibility List for Probationary Firefighter which
expires June 15, 1989, 6 months, with the new
expiration date to be December 16, 1989. Motion was
made by Mr. Dreblow, seconded by Mr. Thornton.

Chairman Jarvis entertained a motion to accept into the
record a letter from the Department of Retirement
Systems dated March 16, 1989 regarding the disability
of Thomas E. Campbell, Jr. to be classified as incurred
in the line of duty; disability retirement allowance is
granted effective on or about March 21, 1989. Motion
was made by Mr. Dreblow, seconded by Mr. Thornton.
Motion carried.
Chairman Jarvis entertained a motion to accept into the
record a memo dated April 13 , 1989 from Jed Aldridge,
Assistant Fire Chief regarding the promotion of Terry
McCartin from Temporary Lieutenant to Probationary
Lieutenant, effective April 16, 1989. Motion was made
by Mr. Dreblow, seconded by Mr. Thornton. Motion
carried.
The Commission was informed by Fire Chief Norm Angelo, that
the Fire Department is planning to test for Fire
Lieutenant in July, and for Firefighter in September.
The exam and proposed dates will be presented to the
Commission at the May or June Commission meeting.
Don Winters of the Kent Police Department and a member of
Executive Board of the Police Union 1088 asked to be
recognized in order to present the Commission with
information regarding the coverage of Record's
Specialists and Corrections Officers by the Civil
Service Commission.
Chairman Jarvis stated that it was unclear as to
whether or not the Commission was empowered to make a
determination as to the coverage of the Record' s
Specialists and Corrections officers by the Commission.
Mr. Winters stated that it was the right of the Police
Union to petition the Commission to study the proposal
and history of the coverage, and to make a
recommendation. Sandra Driscoll, City Attorney advised
that the City Council has the power to make a decision
regarding coverage and at that this time coverage was
being discussed as a bargaining subject. The
Commission could determine whether or not to hear
Police Union presentation.
Chairman Jarvis, Mr. Thornton and Mr. Dreblow expressed
an interest in hearing the presentation. Mr. Winters
was then advised to make the presentation.

The presentation consisted of a request that the
Records Specialists and Corrections Officers be
represented by the Civil Service Commission with a
history of previous status changes and regarding the
coverage status of other areapolice department's staff.
A copy of the presentation is attached. After
discussion, Chairman Jarvis informed Mr. Winters that
the Commission would take the matter under advisement,
to review the information and will respond at a later
date.
There being no further business, the meeting was adjourned at
8: 15 a.m.
Next regular meeting date is scheduled for May 18th at 8:00 a.m.
in the Council Chambers.

CIVIL SERVICE PROTECTION
INFORMATIONAL REPORT FOR RECORDS AND CORRECTION'S STAFF
The purpose of this report is to request Civil Service Protection for
all members of the Kent Police Department. Currently, our Record ' s Specialists
and Correction' s Officers are not afforded Civil Service Protection. We feel
it is in the best interest of the Kent Police Department and the City of Kent
to allow these groups to participate in this very important process. This
report will illustrate our position.
Prior to 1978, Civil Service Protection was extended to cover the Record' s
section. Previous police chief, Jay Skewes requested that this protection
be removed. This was authorized by the Civil Service Commission at that time.
Civil Service Protection has never been afforded to our Correction' s staff.
Prior to 1986 when our new Correction' s Facility was completed, the Correction's
staff was very small and many were attempting to gain employment elsewhere. Today,
things are quite different. Our Correction's Facility houses 63 inmates, 15 of
whom are federal prisoners and the staff now numbers 16 Correction' s Officers.
Our new Correction' s Facility is nationally recognized and had adopted the New
Generation Philosophy of dealing with criminal inmates.
Our Washington State Law, RCW 41 .12.050 states, "The classified civil service
and provisions of this chapter shall include all full paid employees of the police
department of each city, town or municipality coming within its purview, except that
individuals appointed as police chief after July 1 , 1987 to a department with six
or more commissioned officers, including the police chief, may be excluded by the
legislative body of the city, town or municipality. " We feel that the law is quite
clear and mandates the participation of all employees. We have taken the liberty of
contacting other police departments around the state and found the following
agencies have Record' s Specialists and Correction' s Officers currently protected
by .Civil Service. Addendum "A" contains the names of those agencies which offer
Civil Service Protection to their Record' s Specialists. Addendum "B" contains
the same information for Crorection's Officers.
The Kent Police Union feels that Civil Service Protection acts as a checks
and balances by holding management accountable for its actions in hiring, promotions,

discipline and terminations. Without question, Civil Service Protection promotes
good police management for all parties. It reduces the cities liability by having
an "independent" Civil Service Commission participate and oversee important
management functions. Currently, there are some members of the Records and
Correction' s staff that feel they are not "equal " members of the Kent Police
Department team. Civil Service Protection promotes good feelings and positive
attitude about the city and the police department by affording all members the
Civil Service Protection that is currently afforded to the command staff and
commissioned police officers.
In the past, many Kent Police Officers have had a lack of confidence in the
Civil Service Process. Many perceive past Civil Service Commission' s as merely
"rubber stamping" management' s decisions. We would like to see independence,
integrity and prestige built back into the Civil Service Commission and the
Civil Service Process by granting Civil Service Protection to all members of the
Kent Police Department. We feel this is a very positive first step towards that
goal .
. We as the Kent Police Union, USWA Local 1088 totally support the Civil
Service Commission and Civil Service Protection. We feel that Civil Service
Protection is a positive "check and balance" tool that should be afforded all
full paid employees. In order for that process to be effective, all members
of the Kent Police Department must be given the opportunity to participate.
Both our Record' s Specialists and Correction' s Officers are being denied that
privilege and we feel this must be changed if we as an organization truly believe
in equal , fair and consistant treatment. These people are dedicated, caring
professionals who do an outstanding job for this city and it' s community. We
therefore encourage and solicit your support in this endeavor.
