BYERLY, KENT POLICE DEPARTMENT SUBJECT: APPEAL OF DISCIPLINARY ACTION On 9-21-89 , this officer was notified that I was the subject of an internal investigation. This investigation, IAC #89-073 , alleged "censurable conduct" . Within this complaint it was determined that Chief Rod Frederiksen, was the complaining party. On this same date, 9-21-89, I was notified that the person conducting the investigation into this matter was Chief Rod Frederiksen, and, also, that the allegation had been "sustained" . A sustained disposition means "the allegation is founded in fact and is sustantiated by evidence reported" . On September 28, 1989 I was notified of the disciplinary action relevant to this allegation and sustained disposition. ' As a result of this allegation of "censurable conduct" (determined to really mean dishonesty) , this officer has received a written reprimand. As per Kent Police Department Policy and Procedure, this disciplinary action has been appealed to Chief Frederiksen. Because he is the complaining party, the investigator, the finder of fact and the disciplinarian as well as the person that reviews any appeal of his decision, my appeal has been denied. Due to the fact that the alleged conduct never happened, I am now officially requesting an appeal of Kent Police Department allegation #89-073 to the City of Kent Civil Service Commission as provided in Kent Civil Service Rules and Regulations, Rule IV; hearings, investigation and complaints. Copies of this allegation and all related communication are on file with Chief Frederiksen as well as my office. Thank you for your review of this important matter.
