June 23, 1987
This special meeting was called to order by Chairman T. Richard Ried at
8:00 a.m.
Also in attendance: Commissioners Joseph A. Street and Michele G. Hinz,
City Attorney Driscoll and Captain Byerly.
The purpose of this meeting is to give a decision to the request from Nancy
Maxson to consider her qualifications relative to qualifying for Lateral Entry
for the Kent Police Department. Decision on the request was deferred from the
last meeting until an opinion could be obtained from the City Attorney.
Ms. Driscoll indicated that our rules state very clearly what the minimum
qualifications are and among the qualifications are a minimum of two years
experience as a full-time commissioned general authority law enforcement
officer and there is nothing in the rules that permits the Commission to waive
that requirement, taken into consideration any factor. At this time there is
no legal authority to waive those requirements. She said that in the future,
if the Commission wanted to change the rules to allow consideration, then they
would have the authority to do that, but for this particular lateral entry
applicant, there is no authority in the rules to allow it. One of the factors
that enters into that is that there are other individuals who might have
applied for the position had they known the Commission would waive the
• requirements under certain conditions.
Mr. Street moved to accept the recommendation of the City Attorney concerning
Ms. Maxson's application and she be so advised. Ms. Hinz seconded. Chairman
amended the motion to include "and deny the request for consideration of
Lateral Entry". Mr. Street seconded and the amended motion carried.
The special meeting adjourned at 8:10 a.m.
