• CIVIL SERVICE COMMISSION MEETING MINUTES
APRIL 16, 1987
The regular meeting was called to order by Chairman T. Richard Ried.
In Attendance: Commissioners Michele T. Hinz and Joseph A. Street, City Attorney
Driscoll, Administrative Assistant Webby, Chief Angelo, Chief
Frederiksen, Battalion Chief Fronsdahl, Captain Byerly and Lt.
LaBelle. Firefighter Applicant Andre' Yoakum and friend were also
present.
Mr. Street moved to accept the minutes of March 19, 1987, meeting as submitted.
Ms. Hinz seconded, and the motion carried.
Battalion Chief Fronsdahl reported that the new firefighters are in their fourth
week and doing well.
Ms. Hinz moved to accept the letter of April 8, 1987, from firefighter applicant,
Andre' M. Yoakum, the psychological report from Dr. Arthur Peskind of Allenmore
Psychological Associates, Secretary's response to Mr. Yoakum, and memo to the
Commission. Mr. Street seconded and the motion carried.

Mr. Yoakum was sworn in by Chairman Ried. He gave his name: Andre' Michael
Yoakum, and address: 100 South 114th, Tacoma, Washington. He asked that his
letter be considered for the position on the Firefighter Eligibility List because
he felt that Dr. Shaw's psychological report is inaccurate. He believes the second
report, by Dr. Peskind, done on March 18, is more accurate, and that Dr. Peskind's
recommendation should be taken into consideration. He stated he had sought a
second evaluation to refute Dr. Shaw's recommendation.
Battalion Chief Fronsdahl was then sworn in. He gave his name: Donald C.
Fronsdahl, Battalion Chief of the Kent Fire Department, Administrative Officer.
Chief Fronsdahl explained that Dr. Shaw does all of the psychological testing for
the Department with a battery of tests, and he knows what the Department is looking
for. Because of Mr. Yoakum's falling below the bottom line in this testing, the
Psychologist feels that he would not survive the probationary period. Therefore,
he could not recommend him for a firefighter position. Chief Fronsdahl stated the
Department will abide by Dr. Shaw's original recommendation.

Mr. Street moved to accept the recommendations of the Fire Department and
Secretary, and to reaffirm the removal of Mr. Yoakum from the Kent Firefighter
Eligibility List. Ms. Hinz seconded, and the motion carried.
Chairman asked the City Attorney if Mr. Yoakum has any further action, as far as an
appeal is concerned. Ms. Driscoll responded, it is not under the Commission's
procedures.
Ms. Hinz moved to approved the Eligibility List for the position of Police
Lieutenant as follows:
James M. Miller (tied for 1st Place)
William B. Mitchell (tied for 1st Place)
Michael P. Sweeney
Robert Cline
Knute W. Hammer
James D. Towne, Jr.
Mr. Street seconded, and the motion carried.
• Captain Byerly distributed copies of the latest proposal of amendments to be
incorporated in the Lateral-Entry Program, with changes in language. He went over
each of the changes, which are underlined in the draft. Clarification was made
of: "Any lateral entry applicant who has successfully completed the Washington
State Law Enforcement Academy Training with a break in continuous law enforcement
office employment of 37 months or greater shall be ineligible for lateral entry."
Thirty-six months will be determined by the hiring date and termination date.
Other minor changes were made to make the wording consistent throughout the rules.
Ms. Hinz moved to approve the Lateral-Entry Program with the proposed changes, as
amended. Mr. Street seconded and the motion carried. Chairman noted the amendment
will become effective in 30 days.
Ms. Hinz moved, Mr. Street seconded, to renew the I.P.M.A. dues of $185. Motion
carried.
Copies of the letter of April 2, 1987, from the Department of Retirement System
. informing of the Disability Retirement of Officer Lawrence W. Wandrey, effective
April 3, 1987, were sent to the Commission members prior to the meeting. Mr.
Street

• moved, Ms. Hinz seconded, to accept the letter into the records, motion carried.
The memo dated April 2, 1987, from Battalion Chief Fronsdahl, confirming William
Kennedy's re-employment, effect May 11, 1987, was read. Mr. Street moved, Ms. Hinz
seconded, to accept the memo into the records. The motion carried.
Copies of the letter of April 10, 1987, to Sgt. Larry Jilbert, from Chief
Frederiksen, were also sent to the Commission. Ms. Driscoll confirmed for Mr.
Street that this would be the final action by the Commission regarding the
termination, unless there is an appeal . Mr. Street moved to accept the letter into
the record. Ms. Hinz seconded. Chief Frederiksen confirmed for Ms. Hinz that Sgt.
Jilbert was given a pretermination hearing and he also has a letter sent earlier to
Jilbert and his attorney, to provide them due process proceedings. He said he met
with them within the 48-hour time period. The motion carried. Chairman stated,
unless it becomes further necessary, as a result of an appeal , he would not want to
go into Executive Session at this time to discuss any aspect that might affect the
appeal. Motion carried.
• The memo of April 6, 1987, from Chief Frederiksen, informing of promotions, was
read. It told of the promotions of Sgt. William H. Mitchell to the position of
Lieutenant, and Officer Randy Bourne to the position of Sergeant, both effective
April 16, 1987. Mr. Street moved to accept the memo into the records. Ms. Hinz
seconded and the motion carried.
The next meeting date will be May 21 , 1987 at 8 a.m. in the Council Chambers.
Meeting adjourned at 9 a.m.
