DECEMBER 19, 1985
The regular meeting was called to order by Chairman T. Richard Ried. In
attendance were: Commissioner Joseph A. Street, Chief Angelo, Acting Chief
Byerly, and Battalion Chief Bond. Administrative Assistant Webby and
Thomas D. Waldron of Waldron and Company appeared after the meeting
commenced. Commissioner Michele G. Hinz was absent because of the birth of
her daughter. City Attorney DiJulio had trial today.
Mr. Street moved to approve the minutes of the meeting of November 25, 1985.
Mr. Ried seconded. Motion carried.
Battalion Chief Bond reported that the firefighter physical agility exam was
completed yesterday with 91 out of 103 applicants reporting with 79 passing.
He said the next phase of the testing is the assessment lab on January 7
and 8, and the oral board for the full week starting January 13, 1986, which
is under the direction of Assistant Chief Berg. In response to Chairman's
question, Chief Angelo clarified that after the completion of this phase of
the testing process, the medical and psychological exams are given, and after
hiring, a physical evaluation is done by the physical fitness consultant.
Chief Angelo reported that Andrew Spier, who wants to return to the Department
as noted in our previous minutes, has been given a psychological exam, but a
written report from the psychologist has not been received yet. He also said
he has interviewed Mr. Spier, who he feels will be an asset to the Department,
but at the same time, the Chief feels a strong need to consider a probationary
period. Chief Angelo requested the Commission consider having the City
Attorney research, either from the standpoint of the Commission or the Union,
and interpret the rules for the possibility of a probationary period. Secre-
tary was instructed to direct the City Attorney to research the possibility.
Chief Angelo also took the opportunity to thank the Commission regarding the
pre-employment agreement. He said he is still interested in seeing it as a
reality. He said the City Attorney is going to prepare a draft of an agree-
ment for the Department.
It was determined to discuss new business next with Acting Chief Byerly so
that he could leave soon after. Discussion of the Chief of Police position
will be held during executive session at the conclusion of the meeting with
Mr. Webby and Mr. Waldron.
Acting Chief Byerly related that after conferring with the Secretary, he has
come to the conclusion that there is not the need for continuous testing at
this time. There is the concern of accepting applications and fees with no
position available, plus with the freeze on hiring, it may be a long time
before a test is scheduled. He proposed discontinuing continuous testing for
the present. After reviewing Rule 11 , Section 5, Chairman expressed his
impression that the rule does not have to be changed since it refers to
eligibility lists as the result of continuous testing. Mr. Street moved to
have the City Attorney check Rule 11 referring to continuous testing and

determine what changes, if any, will have to be made to end the continuous
testing. Mr. Ried seconded. Motion carried.
Secretary noted that the amended Rule 12, Section 4, Provisional Appoint-
ment", will become effective December 26, 1985 if there is no dissenting
correspondence regarding the amendment.
Chief Angelo stated that with the recent snow, the Department is considering a
different time of year, such as spring or early fall , for the testing, which
would mean either a shorter or longer eligibility list. He requested the
option to send all 79 applicants who passed the physical agility exam through
the rest of the testing process in order to have a longer list, contingent
upon the City Attorney's approval . Mr. Street moved to grant the request.
Mr. Ried seconded. Motion carried.
Meeting went into executive session at 8:25 a.m.
Meeting reconvened at 8:48 a.m. Mr. Street moved to accept the selection
process presented by Mr. Webby and to direct Mr. Waldron to proceed with the
process. Mr. Ried seconded. Motion carried.
Mr. Webby informed the Commission that the local Disability Board is meeting
today to make its decision regarding Chief Skewes' disability, which is now in
its sixth month. Then it will go to the State Disability Board for a thirty
day period to confirm. He noted that with Rule 12, Section 4, becoming effec-
tive, there is no problem with urgency.
Due to the firefighter oral board schedule during the third Thursday of
January, the next regular meeting was scheduled for the fourth Thursday,
January 23, 1986, at 8 a.m. in the Council Chambers.
With no further business, Mr. Street moved to adjourn, Mr. Ried seconded.
Meeting adjourned at 9:08 a.m.
