January 17, 1985
The regular meeting of the Civil Service Commission was called to order by
Chairman T. Richard Ried at 8:00 a.m. In attendance: Commissioners Ried,
Hinz, and Street. Also present: Assistant City Administrator Webby, Acting
Police Chief Byerly, and Battalion Chief Bond. City Attorney DiJulio appeared
briefly during the meeting.
Mr. Street moved, Ms. Hinz seconded, to approve the minutes of the
December 20, 1984 meeting. Motion carried.
Secretary reported that City Attorney DiJulio had another meeting to attend
this morning but that he had said that he would have the rule changes
completed for the next meeting.
Secretary reported that the Assessment Lab of the Firefighter Exam will be
held on Monday and Tuesday of next week, January 21 and 22.
The letter of December 17, 1984 from Acting Chief Byerly was read. It told of
the medical retirement of Police Clerk Anne Newcome effective January 1 ,
1985. Commissioner Street moved, Commissioner Hinz seconded, to accept the
letter into the record. Motion carried.
A letter from Firefighter Brian Kruml , requesting permission to take the
Firefighter First Class exam, was read. He has attended Bates Fire Service
and has 1 ,872 hours of instruction. Secretary confirmed that Firefighter
Kruml is eligible to take the test as of January 1985. Battalion Chief Bond
clarified for the Commission on the procedure whereby firefighters must
receive permission from the Commission to take their First Class exam before
the 42 month requirement. Mr. Street moved to accept the letter and to
approve Kruml 's application subject to the approval by J.A.T.C. Ms. Hinz
seconded, motion carried.
Acting Chief Byerly informed the Commission that only two applicants responded
A - to the oral board held this week, and a new test is scheduled for March 2. It
was confirmed that since this test is still under continuous testing, it does
• not require any action by the Commission.
Upon Acting Chief Byerly's inquiry concerning any final disposition on Officer
Dougherty's disability retirement, Mr. Webby responded that the local
Disability Board has approved Officer Dougherty's disability retirement and
the State Board has asked for additional information and has yet to approve
it. Mr. Webby clarified for Mr. Street that the disability retirement request
goes to the local board, who makes its decision based upon doctor's or
specialist's recommendations. That information is sent to the State Board for
review.
Mr. DiJulio made his appearance and he said he had received a phone call from
the court saying that the court had entered its decision on the Towne case and
the decision was reversal of the trial court and returning it back to the
trial court for allowance of the complaint amendment which had been requested
by the police officers. He said he still had no copy of the decision. Mr.
DiJulio stated that he may have to ask the Commission to meet at a special
meeting to review the decision when he receives it.
Mr. Street moved to meet for the next meeting at 8:00 a.m. on Thursday,
February 21 , 1985. Ms. Hinz seconded, motion carried.
With no further business, meeting was adjourned at 8:20 a.m.
