HomeMy WebLinkAboutCity Council Committees - Civil Services Commission - 10/25/1984 CIVIL SERVICE COMMISSION MEETING • MINUTES October 25, 1984 The regular meeting was called to order at 8:00 a.m. by Chairman T. Richard Ried. In attendance: Commissioners Ried, Hinz and Street; City Attorney DiJulio, Assistant City Administrator Webby, Chief Angelo, Battalion Chief Bond, Captain Byerly. Also present: Firefighter applicant Christopher Sproat. Commissioner Ried requested that a correction be made to the September 20th Civil Service Commission Meetings to include the fact that City Attorney DiJulio explained to the Commission that it would be proper for the Secretary- Chief Examiner to remove names from the entrance level eligibility roster upon receipt of recommendations from the applicable department without approval of the Commission. Commissioner Street moved to amend the September 20th minutes as noted, Ms. Hinz seconded, motion carried. City Attorney DiJulio reported the status of three cases he is currently working on. The first, regarding the Nirk Case. The judge has entered an oral decision as to the amount of back pay. The final order is set for the second week in November. The decision will be reviewed to see if an appeal will be taken. The second, regarding the Towne Case, which was heard by the Court of Appeals ten days ago where Police Officers sought rank levels prior to their eligibility. The matter was rejected by the trial court. We are the respondents in this case. Regarding the Cleary matter Mr. DiJulio spoke with Cleary's attorney, Mark Brennan, who advised that the arbitrator had ruled in • the City's favor. The order has not yet been received by the City Attorney's office. A copy will be provided to the Commission upon receipt. Chief Angelo reported that two new firefighters, Mr. Shjerven and Mr. Young have successfully completed their training at the academy. There was also one volunteer firefighter who has successfully completed the training at the academy. Captain Byerly reported the successful completion of all four phases of the selection process. Four candidates have been appointed, Jon Strauf, Doug Glaze, Kent Curry and Joseph Gagner. Captain Byerly requested that two names be removed from the police officer eligibility list, Craig Sheasly and Robert Stevens. The letter from Mr. Sheasly was read stating that he has decided to remain with his present employer at this time. Commissioner Street motioned to remove Mr. Sheasly's name from the police officer eligibility list, Ms. Hinz seconded. Motion carried. At this time the meeting went into executive session. When the meeting reconvened Mr. Street moved, based on the recommendation of the police department, to remove Mr. Robert Stevens from the eligibility list, Ms. Hinz seconded. Motion carried. • Copies of two letters regarding firefighter applicant Christopher Sproat were distributed to the Commissioners. The first letter was from Dr. James Shaw dated 10-04-84 regarding the status of Mr. Sproat's appointment to meet with • him. The second letter dated 10-17-84 from Attorney Mark Brennan to Steve DiJulio requested an investigation into Dr. Shaw's psychological examination. Steve DiJulio advised the Commission that he had spoken with Mr. Sproat's attorney, Mr. Brennan, and advised him that this was not an adversary proceeding just an administrative review of the process. He also advised Mr. Brennan that if the Commission later takes action that Mr. Sproat would have the right to a formal hearing. Mr. DiJulio also advised that Dr. Shaw was unable to attend this meeting but was notified to bill the Commission for any future examinations of Mr. Sproat. At this time Ms. Hinz advised Mr. Sproat to contact Dr. Shaw to review his findings and to have Dr. Shaw bill the Commission for any charges incurred. Mr. Sproat then asked if he would be eligible to take the upcoming firefighter examination. After discussion Ms. Hinz moved to allow Mr. Sproat to take the exam, conditioned upon the review with Dr. Shaw and this Commission, Mr. Street seconded. Motion carried. Mr. Street moved that the letters from Dr. Shaw and Attorney Brennan be accepted as part of the record. Ms. Hinz seconded. Motion carried. Mr. Street moved to appoint Mr. Michael Webby as a temporary replacement for the Civil Service secretary. Ms. Hinz seconded. Motion carried. Chief Angelo outlined for the Commission the following procedures for the upcoming firefighter opening. They will advertise the test from October 28th through November 2nd and accept applications through November 8th. The firefighter examination will be given the first week of December. The physical agility test will be scheduled for the first week of January with the oral board scheduled for the latter part of that month. The fire department would hope to hire in February so that candidates may be sent to the March academy. Currently there are three firefighter openings with six more openings anticipated for next year. Ms. Hinz motioned to approve the above guidelines for the firefighter opening, Mr. Street seconded, motion carried. Mr. Ried read the letter from Chief Angelo to Bob Pessemier regarding his promotion to the rank of lieutenant. Mr. Street motioned to accept Chief Angelo's letter confirming Mr. Pessemier's appointment to lieutenant. Ms. Hinz seconded. Motion carried. The next meeting of the Civil Service Commission was scheduled for November 15, 1984. With no further business, Mr. Street moved, Ms. Hinz seconded ,to adjourn the meeting.
