HomeMy WebLinkAboutCity Council Committees - Civil Services Commission - 08/16/1984 CIVIL SERVICE COMMISSION MEETING MINUTES August 16 , 1984 • The regular meeting of the Commission was called to order at 8 : 00 a .m. by Chairman T. Richard Ried. In attendance : Com- missioners Ried , Hinz, and Street ; City Attorney DiJulio, Assistant to the Administrator Webby, Chief Skewes and Captain Rees. Secretary noted that the minutes of the previous meeting showed the location of the Civil Service conference to be Sea-Tac Lion Inn, but it is to be at the Sea-Tac Marriott Hotel . Ms . Hinz moved, Mr . Ried seconded, to approve the minutes of the July 19 , 1984 meeting with the correction noted. Motion carried. Mr. DiJulio reported that a hearing on arbitrability in the matter of James Cleary was held. He said that a hearing, if necessary, on whether there was cause for discharge , is scheduled for September 14th. He said the arbitrator is to make the decision as to whether or not the issue is arbitrable, but there has been no decision as yet. The City Attorney also gave an update on the Nirk matter. He said the hearing before the Trial Court is scheduled for September 6th. He said that he met with Ms. Heavey and Mr.Nirk and his counsel on Tuesday, the 14th, to see if an understand- ing could be reached as to what the potential liability of the City would be should Nirk be reinstated. He further stated the Court so far has indicated that she will order both pre- judgment and post-judgment interests on the award ,and she will • not allow set-offs for his earnings during the period of his supposed unlawful discharge. He said that should a compromise not be reached, he would recommend the matter be appealed to the Court of Appeals . Mr. DiJulio will report more at the next meeting. Mr. Webby noted the Civil Service conference is on the agenda and if the Commission is interested in attending, to inform the Secretary and the request will be processed. It was determined tat the Commission and the Secretary will be attending the conference on September 21 at Sea-Tac Marriott. The memo of July 19 , 1984 to Officer R.M. Holt from Chief Skewes informing him of his temporary appointment to the rank of Ser- geant effective July 11 , 1984, was read. Mr. Street moved, Ms . Hinz seconded , to accept the memo into the record. Motion carried. Chief Skewes explained that this appointment was made as a result of Sgt. Towne ' s medical leave and Officer Holt was next on the eligibility list. The memo of July 27 , 1984 from Assistant Chief LaBore informing of the promotion of Andy Speier to Firefighter 1st Class , effective July 1 , 1984, was read. Mr . Street moved, Ms . Hinz seconded, to accept the memo into the record. Motion carried. The memo of August 13 , 1984 from Assistant Chief LaBore regard- ing the Firefighter eligibility list was read. Mr . Street • moved , Ms . Hinz seconded, to remove the name of Christopher L. Sproat from the Firefighter eligibility list for failing the psychological exam. Motion carried. Motion was made by Mr . Street , seconded by Ms . Hinz , to remove the names of Patrick Civil Service Commission Meeting Minutes - Page 2 August 16 , 1984 Donovan and Bryan L. Vadney from the Firefighter list since • they are now employed by other departments . Motion carried. Secretary said she had received a verbal request from Mr . Vadney to have his name remain on the list, but Mr. DiJulio cited Rule XII , Section 2 , and concurred that since he declined the appointment, his name be removed from the list. Secretary was instructed to notify in writing the three applicants whose names were removed from the Firefighter eligibility list. Assistant Chief LaBore ' s memo also informed of the employment of Dennis J. Young and Raymond N. Shjerven as probationary firefighters effective August 16 , 1984. The next regular meeting date is Thursday, September 20 , 1984 , at 8: 00 a.m. in the Council Chambers . With no further business , Mr. Street moved, Ms . Hinz seconded, to adjourn the meeting.
