June 28, 1984
The regular meeting of the Commission was called to order by
• Chairman T. Richard Ried at 8 : 00 a.m.
Also in attendance were : Commissioner Joseph Street, newly-
appointed Commissioner Michele Hinz , City Attorney DiJulio , Assist-
ant to the City Administrator Webby, Battalion Chief Bond and
Captain Rees . Also present: Lieutenants Grubb and Moline .
Citing Rule II , Section 1 , Chairman Ried called for the election
of a chairman. Commissioner Street nominated Mr. Ried, seconded
by Commissioner Hinz. Mr. Ried was elected by majority.
Mr. Street moved, Ms . Hinz seconded, to approve the minutes of
May 18 1984 as submitted. Motion carried.
City Attorney DiJulio referred to the Nirk matter and gave a summary
of its background for the new Commissioner . He said the matter was
set for entry of final order on Tuesday morning, but Nirk' s counsel
failed to present the order in the proper manner so the matter has
been set over , at which time the Court will determine whether or
nor to conduct a further evidentiary hearing on backpay. He said
it will be the position of the City that such issues are within
the province of the Commission and the matter should come back
before the Commission. Depending on the nature and extent of the
Court ' s ruling, he said it is likely that will be appealed as well .
Mr . DiJulio will report further on the matter next month.
The City Attorney also gave an update on the Cleary discharge , which
is currently in dispute between the City and firefighter Union con-
cerning the interpretation of the collective bargaining agreement.
He said the arbritrator has been selected , but the City will continue
to assert the position that this Commission is the proper place to
consider the cause for discharge. He further stated that if the
arbritrator decides he has jurisdiction, he will then proceed to
hear the cause aspect of the case . In the meantime , they are trying
to have settlement of negotiations and he will report on this matter
also.
Captain Rees reported that the Police Department is in the process
of testing in the entry level . He requested the removal of the
following names for failing the oral board: Mark W. Otto, Gregory
J. Boulton, Philip R. Monzon, David R. Harrison, Danny D. Hodges ,
Robert H. Collins , Mark Nielipinski, David W. Haynes , and Gary
Roberts . Mr. Street moved, Ms . Hinz seconded , to remove the pre-
ceding names from the Law Enforcement Officer Eligibility List for
failing the oral board. Motion carried .
Mr. Street moved, Ms . Hinz seconded , to accept the letter of May 31 ,
1984 to Officer M.P. Sweeney informing him of his appointment to the
rank of Sergeant , effective June 1 , 1984, into the record. . Motion
carried.
The memo, dated June 8 , 1984, from Assistant Chief LaBore regarding
the Second and First Class exam schedule , was read. Mr . Street
moved, Ms . Hinz seconded, to accept the memo into record. Motion
carried.
• Mr . Street moved, Ms . Hinz seconded , to accept the memo of June 5 ,
1984 to Chief Skewes from Captain Byerly. Motion carried. Captain

Byerly recommended that the provisional appointment to C. E. Miller
• be withdrawn and B.R. Jones , who is now first on the Sergeant Eligi-
bility List, be offered a temporary appointment to the rank of
Sergeant. The memo was noted with a handwritten approval by Chief
Skewes .
The memo of June 7 , 1984 from Chief Skewes to Officer B.R. Jones
informing him of his appointment as a temporary Sergeant , was read.
Mr . Street moved, Ms . Hinz seconded, that the memo be made a part
of the record. Motion carried.
The memo of June 7,1984 from Chief Skewes to the Commission informing
of the temporary appointment of Officer B.R. Jones to the position
of Sergeant , was read. Mr . Street moved, Ms . Hinz seconded, to accept
the memo into the record . Motion carried.
Chairman Ried welcomed Ms . Hinz as a member of the Commission and
presented her with the Certificate of Appointment signed by Mayor
Hogan.
The next regular meeting is scheduled for 8:00 a.m. Thursday, July 19 ,
1984 in the Council Chambers .
Mr . Street moved, Ms . Hinz seconded, to adjourn the meeting. Motion
carried.
Meeting adjourned at 8: 20 a.m.
