HomeMy WebLinkAboutCity Council Committees - Civil Services Commission - 02/16/1984 KENT CIVIL SERVICE COMMISSION MEETING MINUTES February 16, 1984 The regular meeting of the Commission was called to order by Commissioner Donald Whitener in the absence of Chairman T. Richard Ried. Commissioner • Joseph Street, City Attorney DiJulio, Administrative Assistant Webby, Chief Angelo and Chief Skewes were also present. Also in attendance: Assistant Chief LaBore and Battalion Chief Bond from the Fire Department and Captain Byerly and Detective Kelch from the Police Department. Russell K. Runion, Firefighter applicant, was also present. Mr. Street moved, Mr. Whitener seconded, to approve the minutes of the meeting of January 19, 1984. Motion carried. Mr. DiJulio reported that-he has an appointment scheduled with the two Chiefs next week to discuss classification of the position of Chief. He also advised the Commission of the current litigation pending on the Nirk and Towne cases. The memo of January 20, 1984 from Chief Skewes to Officer Charles Miller, informing him of his provisional appointment to provisional Sergeant, was read. According to Captain Byerly, the appointment is effective February 1, 1984. Mr. Street moved, Mr. Whitener seconded, to accept the letter into the record. Motion carried. It was indicated that a date has not been scheduled for the sergeant exam. The memo dated January 23, 1984 to L. Michael Lince from Chief Angelo was read. It informed Mr. Lince of his rejection as probationary Firefighter, effective January 30, 1984. Mr. Street moved, Mr. Whitener seconded, to accept the memo with the reasons stated for discharge into the record. Motion carried. The memo from Chief Angelo, dated January 23, 1984, to James E. Cleary, • informing him of his discharge from the department effective January 31, 1984, was read. Attached to the memo were Violation Notice and copy of Rule XV, Section 3. Mr. Street moved, Mr. Whitener seconded, to acknowledge receipt of the memo and attachments into the record. Motion carried. Relating to this same matter, the letter of January 30, 1984 from Kent Firefighters Local 1747, requesting release of information regarding Mr. Cleary and accompanied by an authorization from Mr. Cleary, was read. Mr. Street moved, Mr. Whitener seconded, to accept the letter and authorization into the record. Motion carried. A letter of Februry 6, 1984 from Mark E. Brennan, attorney for Mr. Cleary, filing an appeal of his discharge, was read. Mr. Street moved, Mr. Whitener seconded, that Mr. Cleary's request be noted as received. Motion carried. The response from the secretary to Mr. Brennan, dated February 7, 1984, was also read. Mr. Street moved, Mr. Whitener seconded, to accept the letter into the record. Motion carried. Mr. Brennan's letter of February 10, 1984 requesting a hearing date after April 17, 1984 was read. Mr. Street moved, Mr. Whitener seconded, to accept the letter into the record. Motion carried. In response to Mr. Street, Mr. DiJulio recommended the Commission grant the motion of the employee to continue the date for setting the hearing date until March 15, pursuant to Rule XV, Section 3. Mr. Street moved, Mr. Whitener seconded, to grant the request to place the matter on the agenda of the March 15 meeting. Motion carried. The memo of January 23, 1984 from Chief Angelo to Firefighter Bob Pessemier granting his request for leave without pay for the period from April 9 to May 4, 1984 was read. Mr. Street moved, Mr. Whitener seconded, to accept the memo into the record. Motion carried. • Kent Civil Service Commission Meeting Minutes - Page 2 February 16, 1984 Assistant Chief LaBore's memo of January 27, 1984 requesting removal of the • following names from the Firefighter eligibility list was read: Russell K. Runion, failed background and psychological, and Mark V. Anderson, failed psycholo- gical. Mr. Street moved, Mr. Whitener seconded, to accept the memo into the record. Motion carried. A letter dated February 9, 1984 from Firefighter applicant, Russell K. Runion, was read.in which he requested permission to view his background investiga- tion materials and psychological evaluations. Mr. Street moved, Mr. Whitener seconded, to accept the letter into the record. Motion carried. In response to Mr. Street, the City Attorney advised that psychological reports have always been confidential but the background findings can be made available to Mr. Runion. Mr. Runion was given an opportunity to speak. He said he was not challenging the decision and accepts the confidentiality of the 'psychological findings, but he would like to know of his background investigation. Assistant Chief LaBore explained the substantiation of the circumstances leading to the removal of Mr. Runion from the list, with letters from recruit academy instruc- tors from the Kent department and conversations with his former employer. Based upon the City Attorney's advice, Mr. Street moved, Mr. Whitener seconded, to allow Mr. Runion to see the background material. Motion carried. Mr. Street moved, Mr. Whitener seconded, that the psychological reports remain confidential. Motion carried. The memo of January 26, 1984 from Chief Skewes to Officer G. Murray was read. Mr. Street moved, Mr. Whitener seconded, to accept the memo on Case #84-00033 into the record. Motion carried. The memo of February 3, 1984 from Assistant Chef LaBore regarding promotional exams was read. Promoted are: John Robinson to Firefighter First Class; Dave Stargel, Brian Kruml, Neal Houser, Gerald Stoumbaugh, Mark Thompson. Kip Ware, Mike Richardson, Ken Ewell and Brain Renner to Firefighter Second Class; and Kevin Kearns, Bill Kennedy, John Keizer, Patrick O'Hern, Jim Carroll, Jeff Barsness, Michael Moore, John Willits, and Chris Martin to Fire- fighter Third Class. Mr.Street moved, Mr. Whitener seconded, to accept the memo into the record and approve the certification of the. names to their respec- tive ranks. Motion carried. The memo of February 3, 1984 from Assistant Chief LaBore informing of the employment of Mark S.Golder, Greg B. Markley and Phillip J. Herrera as probationary Firefighter effective Febraury 6, 1984 was read. Mr. Street moved, Mr. Whitener seconded, to accept the memo into the record. Motion carried. The memo of February 10, 1984 from Battalion Chief Bond was read. It told of the dates and times for the examinations for Battalion Chief and Lieutenant. The battalion chief exam will be held February 21 and 22, written exam at Station 72 and assessment lab at St. Christopher School. The lieutenant written exam will also be held at Station 72 on February 29 and the assessment lab at St. Christopher School on March 1. Mr. Street moved, Mr. Whitener seconded, to accept the memo into the record. Motion carried. Chief Skewes reported that Steven C. McVicar had been appointed probationary officer and currently attending the basic academy. In order to take care of pending Police Department business, Mr. Street moved, Mr. Whitener seconded, to return to 'old business'. Motion carried. Chief Skewes reported that the department is currently in the process of interviewing • Kent Civil Service commission Meeting Minutes- Page 3 February 16, 1984 candidates from the next group on the eligibility list. He requested the removal from the list the following names for the reasons given: • David E. Eskelin, failed polygraph and background Michael A. Hunton, failed psychological Bruce B. Dibble, failed polygraph and background Jeffrey T. Gehrke, failed polygraph and background Stephen P. Peck, failed psychological Steven P. Blanchard, failed psychological Mark D. Weber, failed polygraph and background Mr. Street moved, Mr. Whitener seconded, to remove the preceding names from the Law Enforcement Officer eligibility list. Motion carried. Secretary mentioned that a refund check for $320.00 was received from IPMA which was for return of unused firefighter exam booklets. The next regular meeting will be held at 8:00 a.m, on Thursday, March 15, 1984 in the Council Chambers. Mr. Street moved, Mr. Whitener seconded, to adjourn the meeting. Motion carried.
