Whitener • KENT CIVIL SERVICE COMMISSION MEETING MINUTES December 15, 1983 The regular meeting of the Civil Service Commission was called to order by Chairman T. Richard Ried. In attendance were Commissioners Joseph Street S and Donald Whitener, City Attorney DiJulio, Administrative Assistant Webby, Chief Angelo, Chief Skewes, Fire Captain Bond, Police Captains Byerly and Rees, and Fire Lieutenant Grubbs. Mr. Street moved, Mr. Whitener seconded, to approve the minutes of the November 17, 1983 meeting. Motion carried. Captain Rees reported that the oral board for entry level police officers is scheduled for this coming Friday and Monday. He also noted that the request for the sergeant's exam has been made to the Personnel Department. Mr. Webby extended an official "Happy Holidays" to the Commission. The memo of November 22, 1983 from City Attorney DiJulio was read. He con- firmed the Commission's request for assistance in modifying the classifica- tions and eligibility standards for the position of Chief. He hopes to have a progress report at the January meeting. Before approving the eligibility list for the position of law enforcement officer, Mr. DiJulio clarified for Mr. Street that the list can be approved even though the memorandum from Kent Curry will be considered later in the agenda. He noted that Mr. Curry's name is on this eligibility list . Mr. Street moved, Mr. Whitener seconded, to approve the law enforcement officer eligibility list as follows: Ian T. Carlisle Jo H. Aigner Mr. Street moved, Mr. Whitener seconded, to accept the letter from Chief Skewes in regard to Officer J.F. Fletcher and copies of correspondence to Officer Fletcher from Chief Skewes into the record. Motion carried. Mr. Street inquired if there had been any response on this matter and Chief Skewes replied there was none. Regarding the memo from Kent M. Curry dated November 19, 1983, Mr. DiJulio clarified for the Commission that the Commission had authorized the continuous testing process using the same examination and testing at intervals with all eligible names remaining on the list. He said the Commission has the authority to determine, for the good of the Civil Service, that a new'exam should be given and a new eligible list promulgated. He said there is no rule that requires the Commission to continue having continuous testing once it is promulgated, and eligible lists at the entry level shall remain in effect until cancelled by the Commission, which the Commission did when it authorized Civil Service Commission Meeting Minutes - Page 3 December 15, 1983 a new exam at the October meeting. As to the other issues in Mr. Curry's memo, Chief Skewes explained that when he talked to Mr. Curry, he told him that he did not fail any of the examination process and that he remained on the list. He also told him that in keeping with his and the Commission's philosophy of obtaining the best candidate and with a new test coming avail- able, he suggested to Mr. Curry to take the new test and try to place as high as possible on the list. In regard to to obtaining a copy of his testing records, Secretary said that applicants may see their test records except for polygraph and psycholo- gical reports, if any. Mr. DiJulio declared that if an individual was challenging his place on the eligibility list based on one of those tests, the individual would have the right to see the report in order to make his challenge of the examination process and ranking on the eligibility list, but it is not relevant to eliminating the continuous testing process. He said that Mr. Curry's performance on the polygraph in placing on a prior list does not have anything to do with the issues before the Commission. Chairman suggested that the secretary draft a memo with, the approval of the city atorney, to Mr. Curry. Mr. DiJulio agreed to work with the secretary. The memo of December. 14 from the secretary regarding Mr. Curry's memo was read. She gave her recommendations in regard to Sections 4 and 5 and also recommended someone from the department be appointed to respond to questions from applicants concerning their status after completing the examination process. Chief Skewes offered to send a progress report to the Commission. Mr. Street moved, Mr. Whitener seconded, to accept the secretary's memo into the record. The memo of December 8, 1983 from Assistant Chief LaBore requesting promo- tional examinations for the positions of Fire Lieutenant and Captain (Battalion Chief) during the month of February, 1984. Mr.. Street moved, Mr. Whitener seconded, to authorize examinations for those positions. Motion carried. The next meeting is scheduled for 8:00 a.m. January 19, 1984 in the Council Chambers.
