October 20, 1983
The regular meeting of the Commission was called to order by Chairman T.
Richard Ried. In attendance were Chairman Ried, Commissioner Joseph Street,
•- City Attorney DiJulio and Peggy Powell representing Administrative Assistant
Webby. Also present were Chief Angelo, Chief Skewes, Acting Assistant Fire
Chief Bond and Police Captain Rees. Jailer Kent Curry was also present.
Mr. Street moved, Mr. Ried seconded, to approve the minutes :of the September 15,
1983 minutes. Motion carried.
Mr. DiJulio reported that last week the Superior Court heard arguments of the
city's attorney and attorney for the police officers in the Miller vs. Civil
Service Commission matter. He said Judge Hunter determined that the Court
did not have jurisdiction over the matter and dismissed the officers' appeal.
Mr. DiJulio said he does not anticipate any further appeal but would keep
the Commission posted.
In the matter of the Nutter petition and the subject of promotional examina-
tion, it was moved by Mr. Street, seconded by Mr. Ried, to accept Mr. Cushing's
memo of September 9, 1983 and his recommended amendment to Rule IX, Section 7.
Motion carried. Chairman suggested that each department be furnished with
copies of the memo and proposal by Mr. Cushing and table this issue until the
next meeting when a full Commission is expected. Mr. Street also suggested
that the departments give their comments in writing regarding the proposal.
Also in regard to the Nutter matter, Chief Angelo's memo of October 14, 1983
listing his recommendations was read. Mr. Street moved, Mr. Ried seconded,
to accept the memo into the record. Motion carried. Chief Angelo expressed
his preference that a candidate must have completed the full term of his
rank before being allowed to take a promotional examination, however, he
said it is the Commission's pleasure to change it, but he would recommend
not to allow more than three months. Mr. DiJulio noted that the current
proposal before the Commission is for six months instead of three months.
He explained that this proposal was prepared at the direction of the Commission
to clarify the intent of the provision to provide for that lag time so that
an individual would not be precluded from promotional consideration before
an eligibility list would be in effect for 18 months. He said a six-months'
provision was proposed, which is a frequently used standard. Mr. Street
moved that this whole item be held over until the next meeting and that
the police and fire departments present their proposed changes in Section
6 and 7, if any, andthe matter be considered. Mr. Ried seconded. Motion
carried. Chairman requested the secretary have the city attorney look over
the response from both departments when received. Chairman noted that be-
cause the exam is in February, there is still time to respond to Mr. Nutter's
petition. Chief Angelo stated that the Commission's decision will not defer
him from taking the test.
Mr. Street reported on the Civil Service workshop held on September 16,
1983. He requested clarification from Mr. DiJulio on the open public meeting
law. He also spoke of the classified service payroll being certified by
the Civil Service Commission. Mr. DiJulio advised rules of reason and also
that a meeting is where action is decided and should not preclude social
gatherings.
Secretary reported receiving the 1984 preliminary budget and presented it
for the Commission's review. Mr. DiJulio stated that the budget will be
presented to the Council this afternoon and the Council will begin their
deliberations next month.
Copies of corrected pabe 4 of the rules and regulations were distributed.

The memo of September 19, 1983 from Firefighter John Robinson requesting
• early examination for Firefighter First Class was read. A copy of his
certificate of completion from Bates Vocational School was attached. Chief
Angelo advised that JATC should give prior approval to receive credit.
Mr. Ried moved to defer response to Firefighter Robinson until a report
from Chief Angelo following his contact with JATC. Mr. Street seconded.
Motion carried.
The memo of September 28, 1983 from Chief Angelo was read. He advised that
the department will need to retain Al Bond and John Henkel in their pro-
visional appointment positions longer than previously requested, but not
to go over the six-months' period as prescribed by the Civil Service rules.
Mr. Street moved to accept the memo from Chief Angelo, seconded by Mr. Ried.
Motion carried.
Acting Fire Chief Bond reported that the Firefighter written exam is scheduled
for November 14 at Kentridge High School to establish an eligibility list.
Mr. Street moved to approve the Firefighter exam of November 14, 1983.
Mr. Ried seconded. Motion carried.
Captain Rees requested authorization of an entrance level police officer
for a physical agility on November 19 and written exam on November 28 and
possibly 29th. He reported that the training Commission has received a
new Wallick test which would provide a new entry level exam. Mr. Street
moved, Mr. Ried seconded, to approve the exams as scheduled. Motion carried.
It was determined that every candidate on the present law enforcement officer
eligibility list must be notified that the list will be terminated effective
• with a new and different test.
Acting Chief bond requested the Commission's approval of the dates for the
Firefighter exams: November 14 for the written, December 1 and 2 for the
physical agility and December 19, 20, 21 and maybe 22nd for the assessment
lab and January 3, 4, 5, and 6, 1984 for the oral board. Mr. Street moved,
Mr. Ried seconded, to approve all the dates as submitted by the department.
Motion carried.
Acting Chief Bond read the memo of October 10, 1983 from Chief Angelo regard-
ing a weighted physical agility exam to get a more balanced candidate while
enhancing the opportunity for qualified minorities. Mr. Street moved, Mr.
Ried seconded, to accept the department's recommendation. Motion carried.
Mr. Curry inquired as to the status of the three police officers
who had taken their polygraph examination and also the status of the one
vacant position in the police department. Chief Skewes explained to the
Commission that Mr. Curry is a jailer in the department. He responded that
the vacancy does exist but has decided not fill it at this time. In keeping
with the philosophy of continuous testing in getting the very best candidate
available and as a result of the recommendations of those involved in screen-
ing candidates, he has decided not to fill the position at this time. Mr.
Curry responded to Chairman Ried that his .,question had been answered.
The next meeting date is set for November 17, 1983 at 8:00 a.m. in the Council
Chambers.
