May 19, 1983
The regular monthly meeting of the Civil Service Commission was called to
• order by T. Richard Ried, Chairman, at 8:00 a.m. in the Council Chambers.
In attendance were Commissioners Donald Whitener and Joseph Street. Also
present were Chief Skewes and Administrative Assistant Webby. City Attorney
DiJulio and Lieutenant Grubbs made their presence during the meeting and
Chief Angelo arrived at the conclusion of the meeting.
Mr. Street moved, Mr. Whitener seconded, to approve the minutes of the
April 21 , 1983meeting. Motion carried.
Report by the City Attorney was delayed pending his arrival.
Secretary reported on the request from Assistant City Attorney Heavey for
an authorization from the Commission to hire a court reporter to record
the proceedings of the hearing on May 24th. Mr. Street moved, Mr. Whitener
seconded, to hire a court reporter for the Nirk hearing. Motion carried.
During the discussion of a continuation date for the Nirk hearing, which
secretary said was requested by Ms. Heavey, City Attorney DiJulio made
his presence. Chairman Ried suggested the next day, May 25th, for the
continuing date for the convenience of the out of town witnesses. Mr.
Whitener was uncertain of his availability on that day, but he will notify
the secretary if that date is satisfactory with him.
Mr. DiJulio informed the Commission that Ms. Heavey had had a phone conversa—
tion with Mr. Nirk's counsel yesterday and was told that they were going to
the Court of Appeals this Friday to get an injunction against the proceedings.
Mr. DiJulio said there have been no papers served, which requires five days'
• notice.
The letter of May 10, 1983 from Officer Charles E. Miller was read. He
requested an extension of the life of a promotional eligibiity list to
twelve months and extending itfor another twelve months. Mr. Whitener moved,
Mr. Street seconded, to accept the letter into the record. Motion carried.
The memo from Chief Skewes, dated May 16, 1983, in response to Officer
Miller's letter was read. Chief Skewes suggested that the original life
of the promotional list remain in effect for twelve months with the provision
that it may be extended to six months. Mr. Street moved, Mr. Whitener
seconded, to accept the memo into the records. Motion carried. Since
there was no input from the Fire Department which was notified of the
proposal, Mr. Street moved, seconded by Mr. Whitener, that this matter
be tabled until next month's meeting when a recommendation fromthe Fire
Department should be available. Motion carried. Secretary was instructed
to send a letter to Officer Miller informing him of the action taken.
The letter from the County of San Bernardino inviting the Commission to
join the Western Region Item Bank membership was read. Mr. Street moved
to direct the letter to the Personnel Department for their recommendation
and action. Mr. Whitener seconded. Motion carried.
The next regular meeting date is Thursday, June 16, 1983, at 8:00 a.m.
in the Council Chambers.
Meeting adjourned at 8:20 a.m.
• Chief Angelo invited the Commission to the graduation of their newest
recruit, Jeffrey Barsness, to be held on Thursday, May 27, 1983, at 7:00 p.m.
at St. Thomas Seminary, Kenmore.
