April 21, 1983
The regular meeting of the Commission was called to order at 8:00 a.m. by
Chairman T. Richard Ried in the council chambers. In attendance: Commissioners
• Donald Whitener and Joseph Street; Chief Skewes, Assistant City Attorney Heavey
and Administrative Assistant Webby. Also present: William P. Fite, attorney,
and client, William Nirk, and Mrs. Nirk.
Commissioner Street moved, Commissioner Whitener seconded, to approve the
minutes of the March 17, 1983 meeting. Motion carried.
Because of the attorneys' schedules, rather than begin with the order of the
agenda, the Nirk matter was taken up first. Assistant City Attorney Heavey
requested the Commission set the Nirk matter for a hearing date. She said
the original decision of the trial court was reversed and remanded by the
Court of Appeals and that order of the trial court has been appealed. She
added that the order of the trial court is valid and the Commission has been
ordered to hold the hearing as soon as possible. The problem of continuing,
Ms. Heavey stated, is that some witnesses have already left the City, some
may not be available in the future and testimony could be lost forever.
Mr. Fite noted that the original ruling was reversed for failure to swear
in the witnesses. He said the matter was presented to Superior Court, went
on appeal , ruling was reversed and remanded to Superior Court to proceed.
He said the Court of Appeals did not address some of the issues and did not
clarify just what was to be done. He felt it wasn't a valid hearing, talking
about five years later. Mr. Fite further stated that the Superior Court's
decision is on appeal and setting a hearing date is premature at this time.
Ms. Heavey responded that the original Superior Court ruling upheld the
Civil Service Commission. The appellate court latched on to not swearing
• in the witnesses and remanded it back to Superior Court. They reversed it
on a limited issue. She said her opinion is that the Commission has no
choice in the matter, that the Superior Court has ordered a hearing.
Chairman asked if there has been a precedent set of other cases being remanded
back to the Commission or hearing body and a pending appeal prevented the
body from having a hearing?
Ms. Heavey responded that there are a lot of cases where the Commission
has been overturned and have gone back for another hearing.
Chairman noted for Mr. Fite that the King County Supeior Court ordered a
rehearing in October 1975 and Mr. Fite responded that that decision is on
appeal .
It was agreed to allow four weeks to prepare for the hearing: The hearing
was scheduled for 2:00 p.m. on Tuesday, May 24, 1983, in the council chambers.
Mr. Street disqualified himself from the hearing or anything to do with the
case because of his involvement during his previous position with the city.
Mr. Whitener moved, Mr. Ried seconded,.. to hold the hearing on May 24th as
set forth. Motion carried.

the secretary was submitted for certification by the Commission as follows:

Chief Skewes clarified for the Commission that the list includes all the
names from the lists since continuous testing was adopted. Mr. Street moved,

Mr. Whitener seconded, to certify the Law Enforcement Officer eligibility
list as presented. Motion carried.
• It was moved by Mr. Street, seconded by Mr. Whitener, to accept the memo
of April 11 , 1983 from Chief Skewes to Officer Charles P. Dougherty II into
the records. Motion carried.
The letter dated April 8, 1983 from Firefighter Charles M. Duffy was read.
He informed of his resignation from the Fire Department to become a fire-
fighter in Renton, effective April 11 , 1983. Mr. Whitener moved, Mr. Street
seconded, to accept the letter into the record. Motion carried. The memo
dated April 13, 1983 from Assistant Chief LaBore confirming Mr. Duffy's
resignation was read. Mr. Street moved, Mr. Whitener seconded, to accept
the memo into the record. Motion carried.
Assistant Chief LaBore's memo, dated April 13, 1983, informing of the employ-
ment of Jeffrey S. Barsness on April 13, 1983 was read. Mr. Street moved,
Mr. Whitener seconded, to accept the memo into the record. Motion carried.
It was moved by Mr. Street, seconded by Mr. Whitener, to renew the IPMA
membership dues, which are $165.00 this year. Motion carried.
The next regular meeting is scheduled for Thursday, May 19, 1983, at 8:00 a.m.
in the council chambers.
