HomeMy WebLinkAboutCity Council Committees - Civil Services Commission - 03/17/1983 KENT CIVIL SERVICE COMMISSION MEETING MINUTES March 17, 1983 The regular Commission meeting was called to order at 8:00 a.m. by Chairman T. • Richard Ried . in the council chambers. In attendance were Commissioners Donald Whitener and Joseph Street. Also present were: City Attorney DiJulio, Admini- strative Assistant Webby, Chief Angelo, Chief Skewes and Captain Rees. Commissioner Street moved, seconded by Commissioner Whitener, to approve the minutes of the February 17 meeting. Motion carried. Mr. DiJulio informed the Commission that Dave Williams had an emergency court hearing this morning and will postpone until next month for setting the Nirk matter for a rehearing before the Commission. The Towne matter, according to Mr. DiJulio, is currently pending in the Court of Appeals; they have filed their initial brief and he said he is preparing, his response for the' Court of Appeals. With respect to the Miller case, he said that matter is currently being set for hearing in Superior Court to be heard in about a month and a half. The latter case pertains to the officers seeking credit for education and prior experience for purposes of classification. Mr. DiJulio also stated that a temporary restraining order to preclude the police department from giving the physical agility exam scheduled for March 16, which counsel for Local 1088 was seeking, was denied by presiding Judge Coleman who agreed with Mr. DiJulio that the temporary restraining order was inappropriate and if there was anything wrong with the department's administration of the physical agility, it was remedied. The City Attorney stated there is nothing to preclude the department from giving the exam and if an individual was concerned about the results of the exam or the action the department takes as a result • of that exam, they have an appeal mechanism either through this Commission or the Public Employee Relations Commission for unfair labor practice. The exam was given as scheduled yesterday. Chief Skewes clarified that it was at least a year ago that the department announced that in order to validate the entry level exam and to meet the department's standards, he voiced to the Commission it has to show the physical agility exam to be job related. He explained the union conference board made up of people from the union and people from the department held a discussion and at that time the members of the conference board were in support of it. Chief Skewes further stated that a list of suggestions by the board to make it safer were implemented, but the affidavit filed by the union indicated the department had either refused or neglected to convince them they had done every thing they had asked. He said if an employee is unable to pass the exam, he is sent to the department physician at department expense to determine if it is an overweight, heart, or other problem. If it is strictly an overweight problem, then they are sent to a dietitian. He said a lot of work has gone into this program and that the City Council and city administration saw fit to put over $9,000. in their budget to bring in consultants to work on the weight problem, body strength or whatever needs to be done. Mr. DiJulio also noted that he had moved to dismiss the Court of Appeals action which is set for March 25th at 9:30 a.m. Chief Angelo verbally delivered a formal invitation to the Commission to the academy graduation at Kentridge Senior High School at 7:00 p.m. on April 1st. He also stated that his recruits are among the top 10 out of 23 and that five • are in the top 6. The memo of February 18, 1983 from Assistant Chief LaBore confirming the hiring of the following firefighters was read: John R. Keizer, James S. Moore, Patrick M. O'Hern. Mr. Whitener moved, Mr. Street seconded, to accept the memo into the records. Motion carried. The copy of the letter to Mr. David Paul Williams, Nirk's counsel, dated February 24, 1983, from City Attorney DiJulio, contents of which Mr. DiJulio brought up earlier, was accepted into the record. Secretary reported that 45 out of 110 applicants reported for the Law Enforcement Officer physical agility examination, with 7 fails. Out of the 21 applicants who had paid the $10.00 application fee, there were 3 no-shows. Surveys of the ethnic origin of applicants compiled by the secretary from the ethnic origin forms submitted by applicants to both departments was reviewed. Mr. Street moved, seconded by Mr. Whitener, the report of ethnic origin prepared by the secretary be made a part of the record. Motion carried. The memo dated March 1, 1983 from Assistant Chief LaBore to Finance Director McCarthy advising that the Board of Commissioners of King County Fire District #37 have sufficient funds to cover costs involved in the hiring process of the twelve firefighters recently hired in the event the Civil Service Commission fund is depleted by additional hiring expenses. It was moved by Mr. Whitener, seconded by Mr. Street,to accept the memo into the records. Motion carried. The memo dated March 3, 1983 to Officer W. Himple from Chief Skewes concerning disciplinary action was next on the agenda. The Commissioners, having received copies of the memo prior to the meeting, Mr. Street moved, Mr. Whitener seconded, to accept the memo into the record. Motion carried. The copy of a memo dated March 7, 1983 to JATC Committee from Firefighter Drake requesting early examination for the rank of First Class Firefighter due to prior attendance at Bates Vocational Institute was read followed by a letter dated March 14, 1983 from Marvin N. Berg, secretary of the Kent Firefighters JATC, approving the request. Commissioner Street moved that the memo from Fire- fighter Drake and the letter of approval from Assistant Chief Berg be made a matter of record. Commissioner Whitener seconded. Motion carried. Mr. Street moved that Firefighter Drake be allowed to take the examination for First Class Firefighter in accordance with the Civil Service regulations. Mr. Whitener seconded. Motion carried. Chief Angelo reported there is a possibility of a new firefighter being hired because of a possible resignation. The next regular meeting is scheduled for 8:00 a.m. , Thursday, April 21, 1983, in the council chambers. Meeting adjourned at 8:30 a.m. Respectfully submitted, Amy E.
