February 17, 1983
• The regular monthly meeting of the Commission was called to order by Chairman
T. RichardRied. In attendance were: Commissioners Donald Whitener.and
Joseph A. Street. Also present were: Chief Angelo, Assistant Chief LaBore,
Lieutenant Grubbs and Firefighter Woodin from the Fire Department and Captain
Byerly from the Police Department.
Mr.Street moved, Mr. Whitener seconded, to approve the minutes of January 20,
1983 as presented. Motion carried.
City Attorney DiJulio reported the following relating to the Nirk matter:
(1) To this date $1,530.31 has been spent in the appellate process, which
includes attorney's fees(Kitto) , costs that were taxed against the city
in favor of the plaintiff in the Court of Appeals, statutory fees, filing
fees, and copying costs. The reason he called this matter to ;the attention
of the Commission, he said, was because the City Attorney's office, in the
new budget year, will keep track as much as possible of the costs that incur
that are directly attributable to the various departments. As this time the
City Attorney's office will be absorbing the costs. (2) Regarding the Nirk
matter proceedings, Mr. DiJulio said he had discussed with Nirk's , counsel
concerning the current status of the case and he said it is his feeling
that the Commission should commence with the hearing for a number of reasons
to eliminate the possibility of backpay liability and the longer the delay,
the further opportunity for memories to be shortened. He stated that if the
Commission is interested in entertaining discussion of this matter, he will
advise their attorney to attend next month's meeting. Mr. DiJulio also said
the attorney had indicated that should the`Commission schedule a hearing
• while the matter is pending in the Court of Appeals, he would put'a restrain-
ing order to preclude the hearing. Mr. DiJulio said it is his personal
feeling that the Commission should entertain the possibility as to whether
or not a hearing should be scheduled. In response to the Chairman's question,
he said the appearance of both attorneys next month would not be a formal
hearing but they would argue as to whether or not a hearing should be set.
Mr. Street moved that the City Attorney be directed to inform Mr. Nirk's
attorney that the Civil Service Commission will consider the Nirk matter
at the March 17, 1983 Commission meeting. Mr. Whitener seconded. Motion
carried.
The City Attorney also stated that he had received the brief from the appellates
in the Court of Appeals on the Towne matter and he will prepare a response
and provide copies to the Commission.
Assistant Chief LaBore reported that the first nine on the Firefighter
Eligibility List reported for employment on Monday, February 14. A written
confirmation will be forthcoming. He further stated that #10 and #12 on
the list have also completed their medical and psychological examinations
because the examining physician felt it was doubtful that two of the appli-
cants would pass the medical exam but specialists determined them to be
satisfactory. Numbers 11, 13, and 15 have taken employment elsewhere and
the receipt of their letters of withdrawal is pending.
Chief Angelo informed the Commission that the State Fire Training Service
• Recruit Academy will have a permanent site at North Bend in June of 1984.
The academy has been held in different locations, with the first and last
times being at Station 72. He invited all to witness the graduation cere-
mony of the academy, the place and date to be known later.

Copies of Rule VI, new Section 12, were distributed.
• Secretary reported that the law enforcement officer examination is scheduled
for March 12, 1983 at Kent Junior High School.
Secretary also reported receiving a $10.00 application fee from Mark W. Merod
police applicant, before receiving his application and he was found to be
only 19 years of age. It was moved by Mr.Street, seconded by Mr. Whitener,
to refund the application fee to Mr. Merod due to his age. Motion carried.
The next meeting is scheduled for 8:00 a.m. , Thursday, March 17, 1983 at
Fire Station headquarters.
With no further business, meeting adjourned at 8:25 a.m.
