January 20, 1983
• The monthly meeting was called to order at 8:00 a.m. by Chairman T. Richard
Ried. Present were: Commissioners Donald Whitener and Joseph Street; Assist-
ant Chief LaBore, Captain Bond and Lieutenant Grubbs from the Fire Department;
and Captain Byerly from the Police Department.
It was moved by Mr. Street, seconded by Mr. Whitener, to approve the minutes
of the December 20, 1982 meeting. Motion carried.
It was moved by Mr. Street , seconded by Mr. Whitener, to accept the notice of
appeal of William Nirk sent by the City Attorney's office. Motion carried.
Secretary related that Mr. DiJulio had not made a decision on a hearing by the
Commission.
Chief LaBore reported that the top nine candidates from the Firefighter eligi-
bility list are scheduled for their medical and psychological examinations and
that he anticipates hiring them around mid-February. He also reported that ten
firefighters who were hired in February 1982 will be eligible to take their 3rd
Class exam prior to February 1 , 1983 and two men will be scheduled for their
2nd Class exam prior to the next Commission meeting.
Copies of the revision of Commission Rule IX, Section 4, were distributed.
The Law Enforcement Officer application information sheet which secretary said
has the approval of the City Attorney and Police Chief, was presented for the
Commission' s approval . Discussion followed on the exact dates of the Viet Nam
era. Mr. Street questioned if the Viet Nam war was ever ended by presidential
• proclamation or Congressional action. Mr. Street moved to have the secretary
contact the City Attorney for interpretation of RCW 41 .04.005, paragraph 1 , to
determine its meaning , which was seconded by Mr. Whitener. Before voting , the
Chairman said he would like to have the Commission approve the application
information sheet because the timing is critical , as the application fee is
effective January 20 and applications will be passed out, that he would like
to see the motion amended to include the information supplied by the City
Attorney' s office in order to avoid having to have another meeting to approve
the City Attorney's statement. Mr. Street withdrew his motion. Mr. Ried
moved to approve the Law Enforcement Officer application information sheet
and for the secretary to check with the City Attorney for verification on the
dates for veteran' s preference. Mr. Whitener seconded. Motion carried.
The memo, dated December 28, 1982, from Assistant Chief LaBore was read, inform-
ing of the promotions of Ted Burke, Andy Speier, John Robinson, Ron Johnson and
Brian Felczak to Firefighter 2nd Class , effective January 2, 1983• Mr. Whitener
moved, Mr. Street seconded, to accept the memo into the records. Motion carried.
The memo of December 29 , 1982 from Assistant Chief LaBore was read. It told
of the promotions to Lieutenant, effective January 1 , 1983 , of Michael Scott
and David Thatcher. Mr. Street moved, Mr. Whitener seconded, to accept the
memo into the records. Motion carried.
The letter dated December 29, 1982 from a firefighter applicant, Robert P.
Woolverton, expressing his grievance on the administration and waiting time
• during the assessment lab exam he took on December 16, 1982, was read. Mr.
Street moved, Mr. Whitener seconded, to accept the letter into the records.
Motion carried. Assistant Chief LaBore commented on the 4-day assessment lab
schedule and scores, which the Commissioners were provided copies. He noted

that the applicant took his assessment lab on the third day and he was the
third applicant in his group, instructions being given at 1 :00 p.m. and Mr.
Woolverton taking his test at 2:00 p.m. He also noted that the first five
•, candidates of that group failed while four who took the exam later in the
afternoon passed with only one failing. He pointed out that the results of the
scores according to the times consistently did not show that a candidate's
waiting for several hours affected his score. He said he felt that Mr. Woolverton' s
complaint about having to sit around and wait is invalid. He showed the Commission
the instruction sheet which Captain Bond read verbatim to each group before begin-
ning the individual testing. He further explained the procedure for the assessment
lab. Captain Bond explained the testing process and that applicants were given
opportunities to ask questions during instructions. At this point , it was moved
by Mr. Street, seconded by Mr. Whitener, to accept the secretary's report of
investigation on this complaint into the record. Motion carried. Based on the
review of Mr. Woolverton's complaints and the facts as presented by Assistant
Chief LaBore and Captain Bond, Mr. Street moved that the test was given and
graded in a proper manner and the claim be denied. Mr. Whitener seconded. Motion
carried. Secretary was instructed to write Mr. Woolverton a letter notifying
him of the decision.
The letter of December 29, 1982 from Jan Fell , Kent Firefighters IAFF Local 1747,
advising that Troy Nutter is the new secretary-treasurer for the union , effective
January 1 , 1983, was read. Mr. Whitener moved, Mr. Street seconded, to accept
the letter into the records. Motion carried.
The letter of January 19, 1983 from Assistant Chief Berg , Secretary of Kent
Firefighters, JATC, informing of the committee's opinion that Firefighters
McCartin and Nutter meet the requirements of First Class as a result of their
• time spent in the Fire Training program of Bates Vocational Technical Institute.
It was moved by Mr. Whitener, seconded by Mr. Street , to accept the letter into
the records. Motion carried.
Another letter of January 19, 1983 from Assistant Chief Berg, JATC, informed of
their recommendation that the Commission publish the date of a promotional
examination within the firefighter ranks two weeks prior to the examination.
Mr. Street moved that the letter from Assistant Chief Berg be accepted and that
the Fire Department be directed to give a minimum of two weeks notice prior to
promotional examinations , effective March 1 , 1983, by posting in all stations
where full-time firefighters are stationed, under the instructions of the Kent
Civil :Service Commission. Mr. Whitener seconded. Motion carried.
The next meeting is scheduled for February 17, 1983, 8:00 a.m. at Fire Station
headquarters.
It was moved by Mr. Street, seconded by Mr. Whitener, to adjourn the meeting.
Motion carried. Meeting adjourned at 9:05 a.m.
