Richard Ried. In attend- ance were Commissioners Joseph A. Street and Donald Whitener. Also present : • Administrative Assistant Michael Webby, City Attorney P. Stephen DiJulio, Chief Skewes and Assistant Chief LaBore. It was moved by Mr. Street, seconded by Mr. Whitener, to approve the minutes of November 18, 1982 as presented. Motion carried. Mr. DiJulio reported that the Nirk matter has gone before the Superior Court. He said the current status of the case is that the petitioner's application for reconsideration has been denied by the Superior Court and that he had just signed an order last week denying that motion for reconsideration. When the order denying reconsideration is entered, they will have thirty days to appeal . Should he not appeal , he will come back to the Commission for a hearing. Mr. DeJulio said it may be his suggestion to have a hearing anyhow rather than to waif for the appeal process for another year because this case has dragged long enough and if there is a chance he is reinstated, the backpay and liability continues to mount. On the recent Miller case, he informed that they took a writ of certiorari (writ of review) improperly and so Mr. DiJulio went to court and had it quashed, as they didn' t give him notice and an order against a public body cannot be given without giving notice. He said he reviewed the matter with the attorney and agreed for an entry date for the return of the records for the Commission's decision and he has conferred with the secretary and set a date of February 8th to certify the records , and the hearing will be in March. Assistant Chief LaBore reported that Firefighter Kenneth S. Weatherill success- fully passed the Firefighter First Class exam effective December 1 , 1982. • A letter from the Civil Service Board of Grands Rapids , Michigan, requesting a copy of our rules and regulations was read. When asked his opinion , Attorney DiJulio recommended sending a section of RCW 41 .08 and RCW 41 . 12 and a copy of our rules. It was moved by Mr. Street, seconded by Mr. Whitener, to send the materials requested. Motion carried. It was recommended by Mr. DiJulio and Mr. Webby to omit the copying charge for this type of request, which is sharing knowledge. Secretary reported on the Firefighter exam conducted on November 23, 1982, with almost 700 applications received, 583 accepted, 455 participated in the exam, 250 passed the written with a score of 70% or more, from which 105 qualified to proceed to the physical agility with a minimum score of 83.34% from the written. All 60 who passed the physical agility went on to the assessment lab and oral board. Twenty five failed the assessment lab and/or oral board , leaving 35 on the eligibility list. It was noted that there was no additional credit given for veteran's preference or volunteer credit , as the requirements were not met. Assistant Chief LaBore clarified for the commissioners to their question on educational or experience credit for entrance level firefighter, that no credit is added to their scores for education or experience. Tinsley Motion carried. • Concerning the subject of an examination fee, Mr. DiJulio distributed copies of a proposed amendment to Rule VI of the rules and regulations , an addition of Section 6 on the waiver for indigents , which reads: Section 12. All applications shall include payment of a standard testing fee to be established from time-to-time by motion of the Com- mission; PROVIDED, that an applicant, in lieu of payment of the standard testing fee, may file a LETTER OF INDIGENCE with the application. A false declaration of indigency shall constitute grounds for voiding of test results. Mr. Street moved to adopt the newly written Rule VI , Section 12, to become effec- tive January 20, 1983, seconded by Mr. Whitener. Motion carried. It was also moved by Mr. Street, seconded by Mr. Whitener, for the secretary to prepare a form letter for indigents similar to that improvised by the city of Renton. Motion carried. Mr. Street moved to set the fee at $10.00, seconded by Mr. Whitener. After discussion over the accounting work involved in refunds for rejected applications, it was determined that the fee is imposed for processing applications and be nonrefundable. Mr. Street amended his motion to include that the $10.00 application fee is nonrefundable. Mr. Whitener seconded. Motion carried. Attorney DiJulio recommended, at Assistant Chief LaBore's suggestion , to include a sentence to the amended Rule VI , Section 12 , as follows : All applications shall include payment of a nonrefundable, standard application fee. It was moved by Mr. Street, seconded by Mr. Whitener, to approve the amendment to Section 12. Motion carried. After discussion over the subject of numerous requests being received presently for police officer applications and how to handle them, Mr. Street moved that Chief Skewes and the secretary report back at the next meeting • on their proposal . Mr. Whitener seconded. Motion carried. Assistant Chief La Bore stated that the Fire Department is not giving out any applications at this time. Chief Skewes proposed that from this day forward no applications for police officer be accepted ,nor send out any applications until after Janu- ary 20, 1983, and from that day we would charge $10.00 application fee; then even if there may be no openings , we would continue our testing to update the Civil Service Commission Meeting Minutes - Page 3 December 20, 1982 eligibility list. • The next meeting date is Thursday, January 20, 1983, at 8:00 a.m. at fire Station 1 .
