June 24, 1982
The regular monthly meeting was called to order by Chairman T. Richard Ried at 8:00 a,m.
Those in attendance: Commissioners Joe Street and Donald Whitener; Acting City Attorney
Barbara Heavey; Chief Angelo, Assistant Chief LaBore, Firefighters Fell, Huntington and
Nutter from the Fire Department; and Captain Byerly, Captain Rees and Lieutenant Everett
from the Police Department. Also present: Paul A. Peter, police applicant.
The minutes of the May 20, 1982 meeting were approved as submitted.
Assistant Chief LaBore reported that the next two on the Firefighter Eligibility List, Robert
J. Schneider and Patrick W. Dale, are expected to commence employment on July 16, 1982.
Captain Rees requested that the present Lieutenant and Sergeant Eligibility List be extended
for six months. He reported the oral board for entrance level was just completed and as a
result, six out of seven applicants failed and the one who passed is scheduled for the poly-
graph today. Captain Rees also requested the following names be removed from the L.E.
Officer Eligibility List for failing the oral board: Jack T. Laney, Jan R. Myers, Mitchell
K. Barker, Steven W. Joyner, Dale J. Bradbury and Ronald L. Darling. It was moved and
seconded to extend the Lieutenant and Sergeant Eligibility List for six months. Motion
carried. Action to remove the foregoing names from the L.E. Officer Eligibility List was
postponed at this time until Mr. Peter's case came up on the agenda.
It was moved and seconded to enter the letter from Dr. David H. Smith regarding Paul A.
Peter into the record. Motion carried. At this time, the meeting went into executive ses-
sion to discuss Dr. Smith's evaluations.
When the meeting reconvened at 8:30 a.m. , it was moved and seconded that Paul A. Peter's
_ name to placed back on the Law Enforcement Eligibility List. Motion carried. It was also
moved and seconded to remove the names of Jack T. Laney, Jan R. Myers, Mitchell K.
Barker, Steven W. Joyner, Dale J. Bradbury and Ronald L. Darling from the L.E. Officer
Eligibility List for failing the oral board. Motion carried. Secretary reported sending a
letter after last month's meeting to Kenneth M. Board, who was reportedly hired by another
agency, requesting a Letter from him to have his name withdrawn from the L.E. Eligibility
List, but has not received a reply. It was moved and seconded to authorize the secretary
to send a second letter to Mr. Board asking for his intent to be considered for Law enforce-
ment work with the City of Kent and informing him that failure to reply within ten days from
the date of the letter would be removal of his name from the eligibility list. Motion carried.
Copies of the pre-empLoyment agreement designed for the Fire Department were distributed
by Assistant Chief LaBore. Firsfighter Nutter, representing the Firefighter union, said he
was in favor of the concept of the agreement but that he had reservations about the union's
obligations. He,further stated that they have consulted their attorney and will be advising
within 30 days. Chief LaBore pointed out that the pre-employment agreement was discussed
at previous meetings and they were aware of it being worked on. It was moved and seconded
to adopt the pre-employment obligation agreement as submitted for the Fire Department.
Motion carried.
Letters both dated May 24, 1982 from Firefighter Kent Huntington were read. The letters
requested permission to take the Firefighter First-Class examination in August of 1982 as
he will be eligible August 3, 1982. It was noted that the letter to the JATC was approved
with the initials and signatures of the JATC committee. It was moved and seconded to
accept the letters into the record. Motion carried. It was also moved and seconded to
approve Firefighter Huntington's request to take the examination in August of 1982. Motion
carried.

The letters of June 1 , 1982 from Chief Skewes to Sgt. D.A. Everett, Sgt. K.R. LaBelle,
Officer- R.M. Boone and Officer Robert Cline informing them of their appointments to
Lieutenants (Everett and LaBelle) and Sergeants (Boone and Cline), all effective June 1,
1982, were read. It was moved and seconded to accept the letters into the records. Motion
carried.
The letters of June 1 , 1982 from M.A. Haney, president of Local 1088 of the United Steel-
workers of America, and the letter of June 18, 1982 from Thomas S. Barnes, president,
and Jan Fell, secretary-treasurer of Kent Firefighters IAFF, Local 1747, were read. It
was moved and seconded to accept the letters into the record. Motion carried. Commis-
sioner Street felt that both letters fall into the same category and he made a motion that the
wording of both letters be referred to our attorney and for her to give us an opinion as to
the validity of either of the letters and if there is some validity, ask her recommendations.
Motion seconded and carried. Attorney Heavey answered questions and clarified for the
union representatives that the broader term for "Rejection" is to mean a probationary
employee whose probation was terminated either from that position or service instead
of "separation of a probationary employee from the service" as previously defined in the
rules. Firefighter Fell expressed his concern that the new definition of "Rejection" left
open the possibility of termination of a promotional probationary employee under Section
2. Attorney Heavey explained that the employee would be protected under Section 4 of
that rule. As it was felt by the Commission that the attorney had answered the questions
raised by the letters and representatives of the unions, it was moved and seconded that
no further action be taken. Motion carried.
The new Standard Test Security Agreement with IPMA was signed to be returned to that
office.
It was moved and seconded to authorize the secretary to attend the Civil Service workshop
in Yakima on July 22, 1982. Motion carried. It was moved and seconded to ask the City
Administrator for an amendment to our current budget to cover the expenses which are
required in excess of our budget which would include the additional expenses for this
trip. Motion carried.
The next regular meeting will be held at 8:00 a.m. , Wednesday, July,14, 1982, at Fire
Station headquarters.
