KENT CIVIL SERVICE COMMISSION MEETING MINUTES
February 18, 1982
This regular meeting was called to order by Acting Chairman Terry Yahn. In attendance
were: Commissioner Donald Whitener and Administrative Assistant Webby; Chief Angelo,
Assistant Chief LaBore and Captain Fronsdahl from the Fire Department; Chief &ewes,
Captain Rees and Sgt. LaBelle from the Police Department; and Robert J. Schneider,
Firefighter applicant.
The minutes of the February 4, 1982 meeting were approved as submitted.
Mr. Webby reported that the final phase of the promotional processes for police sergeant
have been completed and the nine participants went through the whole assessment center
and he has given the Secretary the scores and relative ranking of the participants. He
commented that he had observed the whole center, as did the Secretary, and he thought
generally it was one of the better centers, not necessarily from the standpoint of content
but the quality of participation was excellent. He has talked to two of the candidates to date
as:he always does for feed-back of the candidates and he was very much impressed by the
participation. He added he is willing to accept any questions or concerns on the assess-
ment center.
Assistant Chief LaBore reported that ten new men are presently at the Washington State
training academy and that he sat in the first week's training and they seem to be progress-
ing well.
Captain Rees reported that an oral board for new police candidates was conducted Tuesday
and Wednesday of this week and requested the following names be removed: Kevin C.
Alderman for failing the oral board, Lawrence D. Hamblin, withdrawal from oral board,
Roy W. Jipson, Key B. Smith and Steven D. Ohlson, all failing the oral board. It was
moved and seconded to remove the given names from the Law Enforcement Officer Eli-
gibility List for the reasons given. Motion carried.
Sergeant LaBelle read his letter dated February 16, 1982 in which he reiterated his
objections to the changes made in Rule VII, Section 7, wherein he said there is no re-
quirement for prior supervisory experience and suggested for Item 2 a minimum of 6 years
experience with a minimum of 24 months with the Kent Police Department and 24 months
supervisory experience. Mr. Whitener responded that he can understand the concerns
but that he would like to have it considered before a full Commission. Sgt. LaBelle said
he is concerned because there is a.lieutenant examination coming up shortly and he thinks
Item 2 override s:dtemA and he was looking at additional changes in the future. Mr. Yahn
explained that Chairman Ried is away now because of a serious illness and hopes he will
return soon and the letter will be accepted into the record and if there is any further ac-
tion, the Secretary is to contact Sgt. LaBelle of any further meetings pertaining to this
matter,
The memo dated January 26, 1982 from Assistant Chief Fronsdahl was read regarding
the following promotions: William R. LaBore to Assistant Chief, John E. Aldridge and
James L. Moline to Lieutenants, effective February 1 , 1982; Theodore J. Burke, Andrew
E. Speier, Brian W. Felczak, Ronald D. Johnson and John G. Robinson to Firefighter 3rd
Class, effective January 2, 1982; Bruce A. Verhei, Gary R. Read and James E. Cleary to
Firefighter 3rd Class, effective February 2', 1982; Jeffrey R. Drake, Robert C. Pessemier,
Terry J. McCartin, Charles M. Duffy, Kenneth S. Weatherill, Troy W. Nutter, Thomas W.
Smith and Kent Huntington to Firefighter 2nd Class effective February 1, 1982; and the
following personnel to return to their previous Civil Service classifications: Marvin N. Berg,
Assistant Chief, Donald C. Fronsdahl, Captain, and Steven R. Svenvold, Lieutenant. It was
moved and seconded to accept the memo into the record. Motion carried. Mr. Yahn offered

his congratulations to Assistant Chief LaBore.
The memo of February 2, 1982 from Assistant Chief LaBore was read regarding the
employment of the following to the position of Probationary Firefighter effective Febru-
ary 1, 1982: Micheal R. Smith, Mike D. Richardson, Brian R. Renner, Kenneth T.
Ewell, Neal D. Houser, Gerald L. Stoumbaugh, Mark W. Thompson, David J. Stargel,
Kip E. Ware and Brian L. Kruml. It was moved and seconded to accept the memo into
the record. Motion carried.
The memo from Assistant Chief LaBore dated February 2, 1982 informed of the disability
retirement of Firefighter First Class Doug Easter effective February 18, 1982. It was
moved and seconded to accept the memo into the record. Motion carried.
Two letters, both dated January 28, 1982, from Chief Skewes to Wayne P. Himple and
Roger H. Tanaka notifying them of their appointment to the position of C-1 Law Enforce-
ment Officers effective February 1, 1982 were read. It was moved and seconded to accept
the letters into the record. Motion carried. Chief Skewes informed the Commission that
the new officers were former Port of Seattle officers having completed the academy and
presently in field training.
The letter dated February 8, 1982 from Thomas P. Graham of Graham & Cohen, repre-
senting Robert J. Schneider, was read. Captain Fronsdahl gave a summary of Dr. Senaly's
medical report and said Mr. Schneider failed to meet LEOFF requirements. He stated
that we hire the doctor to do the medical examinations and went by his determination and
removed Mr. Schneider from the Firefighter Eligibility List because of that. Mr. Schneider
stated he has every reason to believe that Dr. Senaly's decision was incorrect. He said he
had no indication that he had arthritis. He said his own physician did a follow-up, examined
the x-rays and said that arthritis exists but it is a natural aging process but not serious
enough to preclude him from being hired. He said he had opinions from a specialist of
muscular and bone systems, a radiologist and an orthopedic surgeon who all agreed with
the other doctor. He said the rejection is unfair and it will have great effect on working
for any other fire department or other employment. He also indicated he would retain
his attorney. When Mr. Schneider implied he was advised by the department to hide his
condition, Chief Angelo corrected Mr. Schneider, that Mr. Schneider had asked if it
would 'blackball' him, the Chief said he told him that we do not release that information
and that others do not have the same standards we have. Mr. Schneider acknowledged
that that was what was said.
Before going into executive session, it was moved and seconded to certify the Police

Chief Skewes said there is interest in pursuing an employment contract for those who come
to the department to sign an agreement if they leave the department. He asked if it could
possibly be considered before bringing it on the agenda to check whether it is something

to be considered by the Civil Service Commission or between employer,and employee.
• The next meeting date was set for Thursday, March 18, 1982 at 8:00 a.m. at Fire Station
Headquarters.
Mr. Webby informed the Commission he is currently tracking the legislature and noticed
there is some Legislation that may impact Civil Service Commissions in the state, to
what extent not known, but he will try to track it for us and if anything comes up, report
the nature of it back to the Commission.
At this time the meeting went into executive session, at the conclusion of which, the
meeting adjourned at 9:00 a.m.
