Present were: Commissioner Terry Yahn, Chief Skewes, Captains Byerly and Rees, Sergeant LaBelle and Officers Beal, Fletcher and Holt. The minutes of the regular meeting of January 21, 1982 were approved as submitted. It was moved and seconded to confirm the telephone poll of the Commission on January 22, 1982 to certify the Eligibility List for Assistant Fire Chief as follows: William R. LaBore Dale E. Hanners Referring to the letter of January 30, 1982 signed by Officers Fletcher, Koransky, Beal and Dougherty, Commissioner Yahn stated that the Commission did act on the basis of their previous letters. He said the testing procedure was discussed at some length prior to the decision and he felt the testing procedure was done in a proper manner. He told the officers their letters were considered but he still goes by the original decision. When asked for his comments, Chief Skewes responded that he had nothing other than what he had said at the last meeting, the Commission had reviewed the previous letters and the Chairman felt the pre-screening was done properly and based on that action, the assess- ment center was given yesterday. Mr. Whitener said his personal feeling was that the Chairman did provide ample time for them to be heard. He commented that he was impressed by their presentations and felt that he had considered everything very carefully. Officer Fletcher said that their letters were written in a timely manner and they were allowed to pour our their feelings but it was after the decision was made and they were Kent Civil Service Commission Special Meeting M`nutes - Page 3 February 4, 1982 denied due process. Officer Beal said that their concern was on the procedure of being notified of the January 21st meeting and not notified of the special meeting on January 14, when the decision was made. He added that he felt they were denied a chance to voice their protest. Mr. Whitener told the officers that the Commission is concerned with their perception now and in the future::and the Commission welcomes their input and all of their comments. Sgt. LaBelle remarked that one of his concerns is that at the last meeting on January 21 he had voiced the same objections on the qualifications for lieuten- ant. He also voiced his objections for not being notified of the special January 14 meeting. Commissioner Whitener said that there are a number of special meetings that they would like not have to be made. Chief Skewes suggested an additional regular meeting each month to take care of the increased activity in both departments. The Commission concurred and added that a special meeting should be held only for one topic that couldn't wait until the regular meeting. Action on this proposal will be taken at the next regular meeting. Officer Fletcher remarked that the ones who wrote letters feel very strongly about the sergeant's pre-screening exam. Chief Skewes reiterated his earlier stand that though he had put to- gether promotional tests in the past, this time he indicated to the Commission that he did not feel he should do that anymore and that we should have an examination from some other source and suggested Mr. Webby to do the test, but Mr. Webby's concern was the number of candidates. He said the pre-screening test was related to the job, a skill the candidates must possess to be successful. He said the examination was a test for a raw recruit, that it came from the Justice Training Commission and he felt there is no trouble validating that. The assessment center tests the administrative skills, he said. Officer Beal said some questions were contrary to the way the police department operates here,; the trick questions did not seem quite fair and some of the questions did not necessarily apply to the procedure here. He again objected to not being notified of the special meeting so that he could present his rebuttal of the pre-screening test before the decision was made. Secretary stated again that the special meeting was called to approve the Fire Department lieutenant examination which was slated for the next day and the special meeting date was originally scheduled for Friday the 15th, but was rescheduled to Thursday the 14th, when the Chairman learned he was to enter the hospital on Friday. She said she had notified the Commissioners and both departments of the date and time changes and requested the Firefighter Union and Police Guild be notified and noted that a representative of the Firefighter Union was present at the. meeting. Captain Rees said that when he was informed of the 7:30 a.m. meeting on Friday the 15th, he did in fact notify the president of the Guild and when the time was rescheduled to 12:30 p.m. Thursday the 14th, he notified him of the change. Officer Fletcher said that no attempt was made to contact him. Commissioner Yahn commented that the problem seems to be notification. He said his understanding is when the Civil Service notified the Union representative they can get the word out to the officers and firemen. Officer Beal said it was just a matter of timely notification and notices posted, having specific dates for meetings, Like their staff meetings. Commissioner Yahn said that special meetings should be addressed to only specific purposes. One request was that special notices go to the individuals writing letters. Chief Skewes suggested including in the Civil Service rules and regulations, the function of a special meeting to clarify the issue. Officer Fletcher stated that he thinks his further action with a couple of the other letterwriters at this point is to contact an attorney and,.tie it up, but he said he felt this discussion was helpful. Mr. Whitener informed the officers that the members of the Commission also have strong feelings they might be unaware of. "There are a number of concerns when you are on the Commission'; he said,"and every member of the Commission is quite sensitive to your suggestions and we are proud of the department. You may not get that feedback but we are listening carefully." It was moved and seconded to accept the Letter dated January 30, 1982 from the undersigned officers into the record. Motion carried. Mr. Whitener assured the officers that the Commission Kent Civil Service Commission Special Meeting Minutes - Page 4 February 4, 1982 will make every effort to make some changes, sit down and review them and all in all he thought there were some good ideas that came of this session and they will make a better effort to note everyone's concerns and address them. JI Chief Skewes noted a possible conflict in the rules and regulations. It was moved and seconded to authorize the Secretary to work with Chief Skewes and the City Attorney in resolving the conflict and present it to the Commission.
