HomeMy WebLinkAboutCity Council Committees - Civil Services Commission - 07/18/1974 July 18, 1974 On July 18, 1974 the Civil Service Commission held a public hearing to hear Officer Donald K. Fadden, Jr. ' s appeal from a one day suspension without pay given as a disciplinary action by Chief McQuery. Present were Warren Bell and Hal Cline. The acting chairman, Warren Bell opened the public hearing. Chief McQuery described the incident leading up to the sus- pension and his reasons for the discijt .inary action. Officer Fadden explained his reasons for appkaling the sus- pension.and why he felt the suspension was not deserved. After all questions and answers had been discussed, Chairman Bell moved to close the public hearing. Mr Cline seconded, Motion carried. Mr. Cline moved that the Commission uphold the action of Chief McQuery in suspending Officer Fadden for one day without pay for the reasons that the action was not arbitrary, was hot for religious or political reasons and was for just cause. Motion seconded. After discussion, Mr. Cline moved the pre- vious question. Motion carried. Mr. Bell stated that Mrs. Mauritsen would get a legal opinion in writing from City Attorney Mirk concerning Chief McQuery' s authority to suspend, with a copy to Officer Fadden. Mr. Cline stated that the commission would reexamine the issue if there was not proper authority to suspend. Mr. Cline moved the meeting be adjourned. Motion carried. A verbatim transcription is on recond in the office of the commission along with the tape recording of the proceedings.
