HomeMy WebLinkAboutCity Council Committees - Civil Services Commission - 11/28/2001 • CITY OF KENT - CIVIL SERVICE COMMISSION MEETING AGENDA The City of Kent Civil Service Commission is scheduled to meet Wednesday, November 28, 2001 at 5:15 p.m, in the West Chambers of Kent City Hall. The following information will be discussed: I. COMMISSION BUSINESS: II. HEARING: 1. A decision was rendered in regard to the Captains Promotional exam that was held on September 11, 2001. The Commission found that the written portion of the exam was to be excluded from final scoring and the remaining portions of the exam were upheld as valid. A revised Eligibility List was posted on November 6, 2001. III. OLD BUSINESS: A. Accept Into Record • 1. Approval of Minutes from the October 24, 2001 Civil Service Meeting. 2. E-mail from KPOA member Lt. Bob Cline withdrawing their objections to upcoming Police promotional testing processes, an issue that was tabled at the October 241h meeting. IV. NEW BUSINESS: A. Accept into Record 1. Revised Eligibility List dated September 13, 2001 for Police Captain. 2. Letter dated October 30, 2001 notifying Randy A. Freeman that his name has been removed from the Entry Level Corrections Officer list. 3. Letter dated November 1, 2001 notifying Daniel C. Will that his name • has been removed from the Entry Level Corrections Officer • eligibility list due to the fact that he has accepted employment elsewhere. 3. If a candidate accepts appointment within the period outlined and fails to present himself for duty on the date specified in the notice, without good reason, he may be deemed to have declined appointment. Any person who declines certification or appointment or who fails to report, shall be permanently dropped from the list on which his name appears, unless he shows satisfactory cause to the Commission for this action. Section 3. "EMERGENCY APPOINTMENT": To meet the immediate requirements of an emergency condition which threatens life or property, the Chief of the department may employ any person or persons when they may be legally empowered to appoint without restriction of Civil Service Laws and Rules. Such employment shall be limited to the duration of the emergency period and shall in no event exceed ten (10) days. Section 4. "PROVISIONAL APPOINTMENT': Section 4.1 Provisional appointment may be made only in the absence of lists appropriate for the position to be filled. In such case, the Chief of the department may select a person meeting the minimum prerequisites for the class to which the position is allocated for nomination to the secretary and chief examiner. If the position to be filled is that of Chief, the Mayor shall appoint the person, subject to the secretary and chief examiner's confirmation that the appointee meets the minimum prerequisites for the position of Chief. The secretary and chief examiner shall interview, or may use any other method to determine whether or not the nominee possesses the necessary experience, • training and other prerequisites for the position. As soon as possible, the secretary and chief examiner shall announce and conduct the examination and shall certify a name for regular appointment in the usual manner. Section 4.2 No provisional appointment shall be continued longer than six (6) months and no person appointed provisionally shall be again appointed in the same year unless qualified by competitive examination and is appointed in the regular manner. No time spent as a provisional appointee shall be credited to the probationary period. Section 4.3 Notwithstanding the provisions of Section 4.2, above, and in recognition of the problems created by disability leave and retirement pursuant to Chapter 41.26 RCW, the Commission may extend a provisional appointment beyond six months upon application of the appointing authority. Such an extension may be granted when a position is vacant as a result of a disability leave or retirement, or for such other reason as the Commission finds to preclude a timely, and regular appointment. Section 5. "TEMPORARY APPOINTMENT": Temporary appointment is appointment from an eligible or promotional list in the usual manner, but to fill a position the duration of which does not exceed six (6) months. In making such an appointment, the Chief of the department shall make requisition to the secretary and chief examiner in the manner provided for regular appointment but shall indicate the time at which it is estimated the Position terminates. I will explain the situation: We currently have a Provisional Assistant Chief (Mike Scott) in the position of Administrative Officer. We also have a Provisional Battalion Chief in the position of Safety OfficerNolunteer Coordinator. th of these individuals are working on significant projects which is part of the reason for this � enda item. In addition, we have a second Battalion Chief who is a Provisional Assistant Chief (Tom IF, Chief Marzano is in a new assignment (as of July 1 st), and as you know, I am in an interim position, so our leadership team is in unfamiliar territory, and the above request, if granted, would supply some stability until the new Fire Chief is on board. I believe the need would only be for two (2) months, but don't want to under-shoot the estimate. With all of the change occurring, and unfamiliarity with positions, this would give us more stability. The rule that you quoted (Rule 12, Section 4.2) 5tate5 that no person that i5 appointed provisionally Shall be again appointed in the Same year unless qualified by competitive examination or appointed in the regular manner. Therefore, I don't believe that the appointments can be extended. I understand why you need the extension, but I don't believe the rules allow for ouch an extension. My Suggestion would be to call our Law department (Brett Vinson at ext. 5779) to get their interpretation of the rule. My intention of asking for this is to get a one-time exception to the Civil Service rule. I am not familiar enough to know if the Civil Service Commission ever"excepts" the rules, but it is worth a try. It would be very disruptive to change chiefs in the middle of a time such as this. If they are not amenable to the request, we will go with their decision.
