Your solution looks good to me. My only suggestion would be that, for payroll purposes, that you change the effective dates so that Jon's acting pay would go thru 10/15 and that Mike Evans would become the provisional Battalion Chief/ Fire Marshal starting on 10/16. As far as notifying the Commission, if you could just send me a Memorandum via e-mail that would be great. In that memo, you would need to state something to the effect that you are making a motion to make these provisional appointments. I apologize for that. Jon appeared to be the best choice to accomplish what we want to do in Fire Prevention during this interim period,and I was not aware that we were in violation of the rules. I am sorry. After being made aware of the Civil Service Rule indicating that a Lieutenant is required to have two years "time in grade" prior to filling a Provisional Battalion Chief position,I would like to make the following change: Since the proposal to appoint Lt. Jon Napier to Provisional Battalion Chief is not allowed for under the current Civil Service Rules,I recommend the following: Jon serves in an acting BIC capacity through 10-14-01. Effective 10-15-01 Lt. Mike Evans will become the provisional Battalion Chief/Fire Marshal. Lt. Jon Napier will then fill the position of Assistant Fire Marshal, provided for under the present Collective Bargaining Agreement. I am confident that Chief Tom Shepard will be able to assign duties in order to stay within the respective position descriptions of the Fire Marshal and the Assistant Fire Marshal. In the short term, there may be some overlap as the projects are completed,or an adequate tie-in is complete. What do I need to do regarding notification of the Civil Service Commission? Does a new letter need to be written • reflecting Mike Evans being the Provisional Battalion Chief? Should any mention be made of Lt. Jon Napier and the original mix-up? I would be happy to explain the mistake either in the meeting or in writing. • Please let me know... Jon Napier was appointed Provisional Battalion Chief effective September 1, 2001. He was ineligible to fill the position due to Civil Service Rule XII, Section 4, which requires the provisional appointee to meet the "minimum prerequisites for the class to which the position is allocated." Therefore, effective October 11, 2001, Jon was removed as Provisional Battalion Chief and reassigned as Lieutenant.
