Letter dated December 22, 2001 from Chief Examiner Guiguet to Ms. Rappe notifying her that her removal from the Entry Level Police Officers Eligibility List still stands. IV. NEW BUSINESS: A. Accept into Record 1. Memo dated January 18, 2001 from Chief Angelo informing the Commission that Assistant Fire Chief Dominic Marzano has completed his probationary period and is promoted effective January 27, 2001. 2. Vinson, Assistant City Attorney03 R®: Age Requirements for Entry Level Police Officer Applicants DSO; January 18, 2001 I. Question Presented Pursuant to Civil Service Rule VI Section 2.1, how old must an applicant be to apply for an open position as an officer with the City of Kent Police Department? 11. Brief Answer Pursuant to Civil Service Rule VI Section 2.1, that requires that "no person will be admitted for the position of officer in the Police Department who is less than 21 years of age at the time of appointment", an applicant who is nineteen (19) years old can apply for an open position as an officer with the City of Kent Police Department. I11. Analysis On January 11, 2001, the question was presented to the Legal Department of how old an individual must be in order to apply for an open officer position with the City of Kent Police Department. Significant confusion existed because three different documents established potentially three different dates for when an individual was required to be twenty-one (21) years of age. The first document was the front page of the City's Application for Open Competitive Examination for Entry Level Police Officers. Within the mandatory minimum requirements section the applicant must answer whether he/she `will be 21 years old by the closing date of this current application process." This language has been determined and strictly enforced in the past to mean that an applicant must be 21 years of age when the time for applying has closed. Memorandum: Chuck Miller,Deputy Police Chief Catherine Guiget, Civil Service Commission January 19,2001 Page: 2 The second document was a copy of Rule VI from the City of Kent Civil Service Rules. Rule VI, Sectioh 2.1, entitled "Qualifications for Law Enforcement Officer" states, "No person will be admitted to examination for the position of officer in the Police Department who is less than 21 years of age at the time of appointment." (Emphasis added). The term "appointment' is not defined in the Civil Service Rules. Appointment could occur on three different dates. First, an individual could be appointed when his/her name is selected from the Entry Level Police Officer List (the "list') and offered employment as an officer conditioned on graduating from the academy. At this point, the individual is considered an employee of the City and receives a paycheck. The second date appointment could occur is when the individual graduates from the academy and is sworn in as an officer. Finally, appointment could occur when the individual has completed probation. The most reasonable and most logical definition of appointment points to the date when an individual is selected from the list and is offered conditional employment. The third document was a copy of a Civil Service Job Announcement for an Entry-Level Police Officer that described the position and the minimum qualifications. Under the section entitled "License and Other Requirements," an individual was required to be "Not less than 21 years of age at the time of hire." The words hire and appointment would likely be interpreted the same and thus support the conclusion that a person is hired or appointed when he/she is selected from the list and offered conditional employment. IV. CONCLUSION The controlling document is clearly Civil Service Rule VI which requires an individual to be twenty-one (21) at the time of appointment. Because the list of candidates may be extended to two (2) years, applicants who are nineteen (19) years of age when they turn in their applications must be allowed to apply. Cc: Personnel File Local 1747 • • MEMORANDUM JANUARY 24, 2000 • TO: CIVIL SERVICE COMMISSION FROM: DOMINIC MARZANO, ASSISTANT FIRE CHIEF\{ — SUBJECT: AUTHORIZATION FOR AN ASSISTANT CHIEF EXAM The Chief had to attend a funeral and has asked me to request authorization for an Assistant Chiefs exam. The most recent Assistant Chief list has expired and this test would be used to fill a vacant authorized position. This test would be open to both internal and external candidates. It is the belief of Fire Administration that there is a small likelihood that a sufficient number of internal candidates would apply. The most recent test found only one member that applied. As a matter of fairness it is recommended that the Civil Service Examiner send out a letter to determine if there are qualified internal candidates who are interested in applying for this promotional position. If it is determined that there is an insufficient internal applicant pool the search and testing process would proceed to allow for internal and external candidates to compete in the process. The testing process would • consist of the use of a search firm to help determine the qualification of candidates and to narrow the applicant pool for up to 9 candidates who would proceed to the assessment center. It is our intent to use Waldron& Associates as the executive search firm and to pay Dennis Joiner to work with Civil Service to develop and administer the assessment center. After the testing is completed and the list is certified by the Civil Service Examiner it is the intent of the Chief to use the psychological and management profile instruments as used in previous promotional testing. The Fire Department would like to authorize this test as soon as possible in order to begin the search and testing process. This is a vital position and the department would like to work to fill it quickly.
