Pr I� wa��"k"J Hi Cheryl, I've reviewed your message from yesterday and it sounds like we'll be moving ahead with a before and after analysis of Amrik's property. Given the change in the scope of work (a single,total acquisition appraisal versus a before/after analysis), I'm assuming that it would not be out of line to ask for a modification to the fee since we'll be doing more work than was initially anticipated. We are getting $4,500 for this assignment and I'm proposing that the fee be increased by$1,500 (to a total of$6,000). 1 think that's reasonable for a fairly complex before and after analysis, but I'd like to hear your thoughts. By the way, is there a preference in terms of priority between the Amrik appraisal and the florist's warehouse on 228"'? 1 signed the contract for American Wholesale Florists Monday and I'm thinking with the new streamlined contracting process that I'll see that quickly from the City's end. I'm pretty sure that the Amrik appraisal will take a bit longer given the complexity of the assignment as well as the fact that we've appraised the 228`^ property previously. Please let me know. It is our understanding that while you and representatives from Tierra were on the Property meeting with representatives for the owner you were told that the Property is used in conjunction with real property located at 1100 51h Ave. S. ("Accessory Property"), approximately 300 feet north, for the owner's A-1 Pallet business. The City continues to investigate whether the Property and the Accessory Property are used as a unit for the A-1 Pallet business, but the City, nevertheless, would like your firm to move forward with performing the appraisal that assumes the Property and the Accessory Property operate as a unit and appraise them as a single parcel with a determination of what the severance damages are to the portion of the single parcel that the City is not going to be acquiring - the Accessory Property. z I am attaching an email from our Development Engineer Ozzie Carrasquilla that contains photos of the Property and the Accessory Property over several years, and some history regarding the site development. When we met on January 14, issues were raised regarding the 2008 Covenant Regarding Outdoor Storage ("Covenant") recorded against the Amrik Commercial Rentals' Lot 1. Our attorney reviewed the Covenant and found that it was recorded against the Lot 1 because the City code, at least in 2008, permitted outdoor storage as an accessory use. Lot 1 could not be used for outdoor storage as a principal use without first obtaining a Conditional Use Permit. It appears that the City required the covenant so that a subsequent owner of Lot 1 could not argue that outdoor storage as a principal use on Lot 1 was a legal nonconforming use. The Covenant does not by itself grant Lot 3 the right to use Lot 1 for outdoor storage. It opens up the possibility, but a separately negotiated agreement between the two lot owners would be needed. In 2008 the City would not have had any reason or incentive to require the owner of Lot 1 to record a covenant that allowed Lot 3 to use Lot 1 as outdoor storage in perpetuity.
