MOTION: Authorize the Mayor to sign First Amendments extending the terms of two interlocal agreements in which Kent provides municipal court and jail services to Maple Valley, subject to final terms and conditions acceptable to the City Attorney. SUMMARY: Maple Valley does not own facilities suitable for conducting a municipal court or housing inmates. The original interlocal agreements ("ILA") for Kent's provision of court and jail serves were effective from January 1, 2015 to January 1, 2018. These First Amendments continue Kent's provision of municipal court and jail services to Maple Valley through January 1, 2020, with an option to further extend each agreement for an additional three years. Under the original ILA for municipal court services, Maple Valley paid Kent a minimum of $175,000 per year for use of its municipal court. Maple Valley paid an additional $4,000 per month for any month in which Maple Valley filed more than 333 cases. This fee structure, which per this First Amendment will continue, has been subject to an annual inflator, the terms of which have been clarified by this First Amendment. The First Amendment also requires that if a Maple Valley judge is not able to appear in court for a preliminary appearance of an incarcerated defendant, the Kent judge will preside over the preliminary appearance. Kent may invoice Maple Valley for the cost of handling the preliminary appearance. Under the original ILA for jail services, Maple Valley paid Kent a minimum of $80,300 per year for guaranteed space for two inmates, plus additional fees for booking, additional space and electronic home monitoring. This fee structure, which per this First Amendment will continue, was also subject to an annual inflator, the terms of which have been clarified by this First Amendment. WHEREAS, the Parties entered into the Agreement which took effect on January 1, 2015; and WHEREAS,the Agreement expires on January 1, 2018; and WHEREAS, the Parties have agreed to extend the Agreement for an additional term and make other minor Amendments to become effective at the beginning of the new term of the Agreement; NOW, THEREFORE, in consideration of the terms and provisions set forth below, it is mutually agreed by and between Maple Valley and Kent as follows: A.
