Regarding
Section 15.12 - Corrections Recruitment Incentives
This Memorandum of Agreement (MOA) is entered into between the City of Kent ("City") and
the Washington State Council of County and City Employees, AFSCME, AFL-CIO, Local#2617
(Union), to amend the parties' agreement regarding hiring incentives available to the City, which
may be offered to Lateral Corrections Officers who are recruited to work for the Kent Correctional
Facility.
Background
The City and the Union are parties to a collective bargaining agreement("CBA") effective January
1, 2017, through December 31, 2019.
The City has determined that in order to remain competitive with competing correctional facilities
in the hiring of lateral corrections officers, it has become necessary to increase the hiring incentives
offered to lateral recruits. Police Administration will continually examine the effectiveness of this
incentive program. While the parties have mutually agreed to revise the incentive program as
provided for in this MOA, the Union also specifically agrees that the lateral incentive program
may be terminated or altered at the sole discretion of the Police Chief, and such tennination or
alteration is considered a management right. Furthermore, the lateral incentive program shall not
set precedent with regard to the amount, qualifications, and structure of payout of this incentive,
which is within the Police Chiefs management right to determine.
The Union agrees that this incentive program is for the sole purpose of attracting qualified lateral
recruits to the Kent Correctional Facility and shall not be utilized as a basis for seeking additional
salary for its members.
Agreement
The City and Union agree as follows:
1. Section 15.12 of the CBA, entitled "Corrections Recruitment Incentives," is amended to
replace the existing language with the following:
Section 15.12 —Corrections Recruitment Incentives
A. In an enhanced effort to attract, recruit, and hire qualified lateral
corrections officers, the City may offer lateral corrections officers the
following incentives. The City's offering of any or all of these incentives
shall be at the City's sole discretion and shall not be precedent setting for

future hirings. The City may offer as an incentive any or all of the
following:
1. A Lump sum of sick leave hours.
2. A hump sum of paid leave hours,not to exceed forty(40) hours; if
the employee separates from employment prior to completing his
or her probationary period,the paid leave shall have no cash value.
Once the employee passes probation, all remaining unused paid
leave will be transferred to the employee's annual leave bank.
3. Corrections officers who relocate upon hiring to a residence closer
to the City of Kent may be allowed up to one thousand dollars
($1,000) in relocation expenses per City policy through the City's
receipt and reimbursement procedure.
4, A monetary incentive in the total amount of five thousand dollars
($5,000), less applicable taxes and deductions, payable in two
equal installments. The first installment (hiring bonus) of two
thousand five hundred dollars($2,500)will be paid on the first pay
period of the recruit, and the second installment (performance
bonus) of two thousand five hundred dollars ($2,500) will be paid
during the pay period following successful completion of any
probationary period.
a. As a condition of acceptance of the hiring bonus of the
monetary incentive ($2,500), probationary lateral
corrections officers agree to repay the City the gross
amount received if they voluntarily separate from
employment with the City anytime within the probationary
period.
b. The performance bonus shall not be issued to any lateral
recruit who does not successfully complete the
probationary period.
B. The following qualifications must be met in order for a lateral corrections
officer to qualify for the incentives provided under this Section 15.12:
1. At the time an offer of employment is extended, the recruit must
be currently employed as a corrections officer with a city, county
or state correctional facility.
2, The recruit must have successfully completed FTO and
successfully completed probation with the recruit's current
agency.

2. All other language of the CBA shall remain in full force an effect, and shall not be altered
by this MOA.
3. This MOA was prepared and/or reviewed by both parties. In the event of an ambiguity in
any term of this MOA, it shall be interpreted evenly, and not against the drafter of the
MOA. The principle of contra prgferentem shall not apply.
4. By signature below, the parties agree that the above represents the parties' full and entire
agreement with respect to the subject matter of this MOU.
