MEMORANDUM OF UNDERSTANDING between the CITY OF KENT and TEAMSTERS LOCAL UNION NO. 8117 Affiliated with the International Brotherhood of Teamsters regarding Uniform Services for Sewer Section This Memorandum of Understanding (MOU) memorializes the agreement between the City of Kent ("City") and Teamsters Local Union #117 (Union) to provide and launder City-issued uniforms for Union employees within the Public Works Department, Utilities Division, Sewer Section in lieu of the annual clothing allowance otherwise provided for under the parties' current collective bargaining agreement. Background The City and the Union are parties to a collective bargaining agreement effective January 1, 2017 through December 31, 2019 ("CBA"). Section 28.1 of the CBA states that the City will provide a $500.00 annual clothing allowance to eligible employees, to be paid on the February 5t' paycheck, less applicable taxes. As it pertains to Union members within the Sewer Section, the parties would like to discontinue the annual clothing allowance and institute a new program wherein the City will issue and launder uniforms for these employees, and clarify that the existing CBA Sections 28.](B) and 28.1(C) apply in place of the clothing allowance otherwise provided for in Section 28.1(A). With this background, the parties agree as follows: Agreement 1. Section 28.1 of the CBA, entitled "Uniform Allowance," is amended to add a new subsection (D) as follows: D, In place of the uniform allowance provided for in Section 28.1(A), the City shall provide and launder uniforms for employees in the Sewer Section of Public Works Operations Utility Division. The uniforms shall consist of 11 pairs of' pants, 11 shirts, and 3 coats. Replacement of these items will be provided on an as needed basis per City/departmental policies and procedures. Coveralls shall be provided based on operational need. Employees in these classifications may substitute up to six (6) pair of pants for Carhartt pants. Management reserves the right to determine additional options available. MOU Regarding Uniform Services for Sewer Section page 1 of 3 2. Section 28.1 of the CBA, entitled "Uniform Allowance," is also amended to clarify the original intent and the parties' understanding concerning subsections (B) and (C) as follows: B, In place of the uniform ' lowance provided for_in_Section 28.1 A , the City shall providdee.... and launder uniforms for employees in the following classifications: Mechanic Assistance, Mechanic I, Mechanic 1I, Senior Mechanic and Mechanic Field Supervisor. The uniforms shall consist of I 1 pairs of pants, 11 shirts, and 3 coats. Replacement of these items will be provided on an as needed basis per City/departmental policies and procedures. Coveralls shall be provided based on operational need. Employees in these classifications may substitute up to six (6) pair of pants for Carhartt pants. Management reserves the right to determine additional options available. C. The uniforms shall consist of 11 pairs of pants, 11 shirts, and 3 coats. Replacement of these items will be provided on an as needed basis per City/departmental policies and procedures. Coveralls shall be provided based on operational need. Employees in these classifications may substitute up to six (6) pair of pants for Carharit pants. Management reserves the right to determine additional options available. 3. Any dispute as to the interpretation of application of this MOU shall be handled in accordance with the grievance procedures set forth in the CBA. 4. This MOU was prepared and/or reviewed by both parties. In the event of an ambiguity in any term of this MOU, it shall be interpreted evenly, and not against the drafter. The principle of contra proferentem shall not apply. By signing below, the parties agree that the above represents the parties' full and entire agreement with regard to this matter.
